Transfer of Land title

Hello mga friends,

Here i am again, asking for advise from you guys, here's the scenario, we just acquired a house and lot (Bungalow type) in Imus cavite and now planning to have it trasnfer from previous owner to me and my wife name.

I already do research on the Net on the steps for transferring the title to us, but the problem is that ang layo pala ng RD (Register of Deeds) sa imus, ayaw din namin magpalakad sa agent kasi madami ako nakilala na itinakbo ng agent yung pera na dapat pambayad sa mga fees.

My question here is that:

1.) ok lang ba na hinde muna namin pa transfer yung ownership and we have the original title of the Land and original copy of deed of sale with signature ng both parties and ID ng previous owner and we just pay the yearly amilyar fee sa city hall ng imus?

2.) or may penalty napo siya pag dating yung araw ng gusto na namin ipa transfer sa name namin?

sorry for asking too much question, 1st time ko kasi sa ganito po and wala ako mahanap ng site or forums that discuss these type og topic.

1. yes. pwede pa din nasa dating owner nakapangalan ang title, as long as bayad ang amilyar ng property every year hindi kayo magkakaproblema. BUT make sure you can trust the seller of the lot. may instances na yung mga already sold out properties are sold AGAIN to unsuspecting buyers since the title was yet to be cancelled sa RD, making it a valid title. more so, the tax declaration will still be in the name of the previous owner, kaya kapag nag-validate yung other buyer, wala pa kayong personality sa property na binili nyo.

2. yes. may penalty na po once you pay your capital gains tax sa BIR. kung may ordinance for transfer tax ang cavite meron na rin surcharge and penalty once pinalipat mo sa pangalan mo yung title. AFAIK, you only have 60 days to pay the corresponding fees sa BIR and transfer tax, starting from the date indicated sa notaryo ng deed of sale nyo.

pa-transfer mo na yan. having the title and tax dec in your name is the only way to 100% protect your ownership of the property. delaying it will just cost you more later. e kung ogags yung nagbenta sa iyo at sinanla yan sa banko next week e di sakit pa ng ulo mo.

Yebo is right. Hindi brip yan na kahit andun yung pangalan sa tag ng pinagsungkitan mo, pwede mo parin isuot. sorry for the analogy but yeah, iba ang ownership ng real estate unlike lets say vehicles or other things. In the long run baka lalo ka mas mapahamak. Pa notaryo mo na DOAS niyo, dumiretso ka na sa BIR bayaran ng seller ang capital gains at ikaw doc stamp, based onyour selling price sa DOAS, wait for the certificate authorizing registration then bayad ka registration fees at transfer fees, tapos punta ka RD. Pag labas bago mo titulo apply ka for new tax dec under your name.

makisawasaw na din... may binebenta kasi kami na lupa sa dasmarinas cavite, pero di pa nai-transfer yung title sa name namin. advice samin is i-transfer muna sa name namin before maibenta. tama po ba yon? may nagsabi naman samin na i-transfer na lang don sa makakabili. saka may idea ba kayo kung how much ang fees sa pag-transfer?

kakatakot pala mga pwedeng mangyari, aasikasuhin kona to nextweek, ay ga question lang ako..

1.) sa BIR kami magbabayad ng capital gains 6% of selling price and documentary stamp 1.5% ng sellig price then makukuha naba namin agad yung CAR docs?
2.) sa assesor office sa municipal hall kam mag pay ng transfers tax and ask kami ng CTC of TAX declaration and clearance? - pwede koba bayaran to na wala pa ung CAR docs?
3.) sa RD kami magbabayad ng registration fees? Ang dadalhin namin dun is original deed of sale, original title, original mga receipt ng mga binayaran namin and id ng seller and buyer including the seller and buyers TIN numbers?

Please confirm mga sir, kung tama mga nasa isip kopo..

Dapat seller magbabayd ng cgt...tsaka ang car matagal..sa QC abutin ka 3 to 4 weeks unless maglagay ka. Tama get ctcs of all documents para sigurado ka

Ok po..so tama po mga steps na gagawin ko?

1.) BIR to pay capital gains and documentary tax then wait ako marelease ung CAR about 3 to 4 weeks after then tsaka ako pumunta sa munisipyo para humingi ng CTC ng tax declaration and clearance and at the same time pay for the transfer fees then tsaka kami proceed sa RD?

Dapat bago ka pa nagbayad sa seller kumuha ka na ng kopya niyan..well siga andiyan na nga kumuha ka na kahit bukas para sigurado

*oliver - Hi Sir, kaibigan ng byenan kopo yung seller po, parang agreement nalang na babayaran niya yung due niya para sa amilyar then at the same timehingi nadin siya ng CTC of tax declaration...then since mababa na benta niya samin yung house and lot, kami nalang raw magbabayad ng capital gains..i think fair naman po kasi medyo mababa benta niya samin..hay sana walang aberya sa pag bayad ko sa BIR nextweek...wish me luck..

one of my major problem sir anyone knows kung paano computation ng penalties at surcharges for late filing ng title transfer bc kasi 5 years ago p yung lot ko in nova qc pero nasakin n lahat ng papers pati original n titulo ng lupa,, kailangan ko lng p transfer s name ko

If hinde pa kayo nag start mag process ng papers niyo, best thing to do is gawa kayo ulit ng deed of sale ni seller dati pero date ngayon tsaka mo pa notirize at the same time paprocess mona, pero if na notarize yung deed of sale niyo dati pa..then sorry to say but ang laki na siguru y ung penalty and surcharges niyo po, kasi ang penalty sabi sakin is per day hinde per months..HTH
