1. yes. pwede pa din nasa dating owner nakapangalan ang title, as long as bayad ang amilyar ng property every year hindi kayo magkakaproblema. BUT make sure you can trust the seller of the lot. may instances na yung mga already sold out properties are sold AGAIN to unsuspecting buyers since the title was yet to be cancelled sa RD, making it a valid title. more so, the tax declaration will still be in the name of the previous owner, kaya kapag nag-validate yung other buyer, wala pa kayong personality sa property na binili nyo.

2. yes. may penalty na po once you pay your capital gains tax sa BIR. kung may ordinance for transfer tax ang cavite meron na rin surcharge and penalty once pinalipat mo sa pangalan mo yung title. AFAIK, you only have 60 days to pay the corresponding fees sa BIR and transfer tax, starting from the date indicated sa notaryo ng deed of sale nyo.
