    There's a vacant lot beside my warehouse and I would like to use it to park my delivery trucks. I tried to get the contact number from the subdivision developer but they don't have it. If I can contact the lot owner, I'm willing to pay rent for the lot to park my trucks. I'll even pave it with gravels at my expense.

    Can I still do it even without informing the lot owner and just the subdivision developer? Will I be charged with trespassing if one day the lot owner came and checks on his lot and found out that I've been parking my trucks on his lot?

    I think yes. Dapat kausapin mo talaga yung mayari ng lot. Kung ako yung lot owner, magagalit ako kasi i'll think you're taking advantage. Pero kung makakausap mo, mas mabuti.

    Yes, get permission first as courtesy. You may be able to get away with it without asking, but that's generally frowned upon.

    You might be charged with trespassing on private property. Owner dapat since the developer has no legal personality with regards to the lot.

    Wala kasing nakakaalam kung nasan yung owner. Tagal ko na gusto magpark dun pero natatakot talaga ako magalit yung owner.

    Walang contact details yung developer? Mahirap yan. Baka kasi magaway kayo pag ginamit mo without his approval.

    baka sa assessor's office makuha mo yung pangalan. kung may tax map sila, madali mo mahanap yan.

    huwag lang nag-abroad yung owner nung lot. samin sa bulacan gustuhin naming bumili ng mga house and lot dun, majority ng gusto namin bilhin wala na dito, nasa ibang bansa na mga may-ari.

    Mayroon bang homeowner's/locator's association diyan?

    If yes, then you can appeal for a board resolution to use the vacant lots as parking lots instead of clogging the streets with vehicles... Plus, the vacant lots are maintained.... Okay na iyan....

    ganun din sana dito sa manila lahat ng vacant lot pwede gawin parking lot para maluwag yun gilid ng daan minsan kasi double parking na dahil wala ng mapag parkingan...yun lang sana payag yun mga mga owmer.

    Better to really exhaust all means to find the owner. Mahirap na at may masabi against you. You're right in keeping to your principles pards.

    Is the lot owner up to date with his subdivision dues and taxes (c/o city assessors office)? He should be passing by there from time to time to update these or perhaps someone goes there to maintain the property?

    ^ basta all efforts are made to locate the owner. saka di mo dapat lalagyan ng fence, plus hindi lang exclusive na ikaw lang ang pwede mag-park. no structures din gaya ng shed o guard house. parking lang talaga.

    at pag dumating yung owner di dapat siya ang maghihintay sa iyo para magusap kayo. have a letter ready stating that you made all efforts to locate him/her, that the homeowners/locators association agreed to use vacant lots for parking, that you occupied the lot starting when, that you are willing to pay rent, and will vacate the property and restore it to its former state whenever told to do so by the owner. pag bigla dumating yung owner then the letter can be presented to them by whoever is in charge in your office.

    Kung ako ang may ari ng vacant lot na yan matutuwa pa ako kasi may income galing sa rental kesa idle lang.

    at pag siningil ka ng rent, be ready with your payment. have the rate set by the association.
    other users of the lot can pay to the association, to take care of the association fees of the lot owner. di na siguro magagalit yun bayad na association fees nya.

    This is one possibility but Boybi should also make sure he's covered in case the owner takes advantage and demands too high in terms of back rent, charges him with trespassing, or claims he's been using it longer then actual. He can check also the status of the property's real estate taxes as if it's not paid up, then it can also possibly be up for auction by the city government or something.

    Other option on this angle, try to get officials of the homeowner's association AND barangay officials as witness... Set it up na may video etc ng initial condition, then may video din nung naka park na... Then transparent din sa association that they keep the rental in trust lang... And immediately remit to owner's upon demand... Shows good faith...
