If the motorcycle driver counterflowed and got killed, the driver of the pickup truck should not be held accountable. After all, it was his fault. They should change traffic laws over here, hindi porke't may namatay may kasalanan agad yung nakabanggaan niya.

i'd put ALL the blame on the bike driver, especially if the pickup was in the right lane.
what if the pickup had no chance to avoid the bike, like may katabi siya or even if he brakes, a head-on impact is still inevitable?

July 15th, 2005 12:37 AM #13sa pagkaka alam ko.. basta may namatay sa road accident, the presumption is yung kabilang party (yung nakapatay) ang may fault... subject to evidence and investigation of course.... pero kung wala naman namatay, the police is there to (sort of) be the middle party for a settlement, if any...
sa pagkaka intindi ko rin.. kaya may presumption na yung nakapatay ang may fault ay dahil sa super laki ng halaga na inilalagay ng batas sa buhay... in english, the value of life, above all.... but then if the police report and other testimony can prove that ang mali talaga ay yung namatayan, then walang laban ang namatayan, at sa fiscal's office pa lang ay dismiss na ang kaso.. yun nga lang.. that is after ka makulong for about 48 hours habang nagkakaroon ng inquest proceedings...
so key dito yung pag construct ng police report.. hehe. minsan dito pa lang nagkakaroon na ng gapangan... if you make the police / investigator friendly to you.. medyo kikiling sa yo yung police report and you can make it really look like hindi mo talaga fault...
another tip... kahit pa sabihin na wala ka talagang fault at yung namatay ang may fault dahil aanga-anga siya... it's best not to argue with relatives (na witness ng accident) kung sino may kasalanan... yan ay kung ikaw ang involved sa accident... walang may gugusto na mamatay ang kapwa.. but things happen... let things cool down.. palamigin muna ang ulo ng mga kamag-anak ng namatayan before initiating any talk...

onli in da pilipins... ibang iba talaga ang pinas, ive been to states, pag tumatawid tao dun the cars literally give way kahit malayo pa ang tumatawid they dont speed up, dito other way around, duon pag me traffic violation people are very disciplined to be obedient, well except for a few bastard, diro iba talaga, yup i agree that pinoys are generally hospitable, good and kind, patience pero hanggang dun na lang ba?

July 15th, 2005 10:47 PM #19Our traffic laws here in the Phils. are almost the same sa tate. hindi po laws ang may problema. tao po ang may problema. kaya matino mga tao, lalo na mga pinoy, sa tate kasi ayaw ng mga tao dun mahuli at magkaroon ng bad record. kasi nga wala silang padrino dun na aayos ng kaso nila at hindi rin sila nababayaran dun dahil nakakahiya sa kanila(cops) kapag nahuli kang nangongotong. Kung mga loko-loko lang din naman ang pag uusapan mas hayup ang mga violators nila dun. minsan lang kung mag violate ng traffic rules preo sandamukal naman ang casualties.(watch maximum exposure sa AXN channel)
