    Guys, im having a problem kasi about the skyway3 project. The project is good naman pero ang problema is tatamaan kasi ang driveway ko sa harap ng gate ko kasi magtatayo ng poste para sa project na ito.. ano ba pwede ko gawin para maiurong.. im along araneta ave. And this post is a big hindrance for me and my business lalo na labas pasok ang container van sa building ko

    Pls advice

    Unfortunately you cannot stop this kind of a project even going to court. Going to court can the delay the project but that will be costly to you. However, you can attain a bargaining chip as an amicable settlement, if ever court tilt to your favor. I suggest you revisit your property and relayout/relocate your gate. The best you can do is try to make a claim on the renovation cost to DPWH.

    Sa malakihang project na ganyan, sigurado hindi ka nagiisa. As posted above baka pwede mong ipagtanong kung sino ung head engineer in charge para kausapin mo sa possible options mo. Di mo naman kasi pwede ipaurong basta basta ung pillar/poste dahil sa structural integrity.

    Can you draw a simple map of the perimeter of your property in relation to where the structure is being built?

    Is widening or moving the driveway and gate an option?

    I reckon you still have two years to try and sell your property before they start digging? Lrt made avenida and taft blight and killed a lot of businesses.

    Acquiring ownership of the land is very important prior to the implementation of infra projects AS PER 9184 known as procurement law no biding or awarding if project not unless the acquisition of the land has been carried out...

    It means i aquire muna ng govt lupa mu thru purchase or barter kung gusto mu babayaran ka(just compensation) problem arises when the TCT of the lot is not yours hindi pa transfered sayu madedelay talaga pag claim mu anyway gudluck pare.

    Well, if the result is blockage of your driveway, so as to completely prevent you from having your vehicle enter or exit your property, it amounts to a denial of right of way to the main road. The property owner has a right to claim compensation for it.

    Of course property owners can claim compensation if they need to move the driveway, that's the least for the contractor can do to compensate him I'm just replying to the quote above mine about acquiring property for right of way purposes. Eh hinde naman ganun yun case ni TS. parang marami akong nakitang same case with TS sa service road ng SLEX yun mga foundation din ng skyway Sa harap mismoeng gate

    Actually yung tatayuan rin ng post/pilar is also my property, my 3 meter setback property

    Wala nga eh.. ni wala ngang pinapadalang letter or anything which is meron dapat. Private contractor ang gagawa dito sa area namin EE yung pangalan ng mga concrete barriers nila. Naiinis talaga ako.. sobrang poor planning talaga ng government natin.. basta lang maitayo.. im paying 150k per year sa land tax ko and this is what i get... #!*/#÷€ talaga

    kahit bayaran ka pa nila ng compensation blah-blah..and which my guess is barya-barya lang yan para sayo kung magkaroon man. it's the daily grind how they would F*** up your business ang mabigat.
    nang dahil lang sa isang abalang poste.

    If it's your property then consult a lawyer already so you can demand just compensation from the project proponent.

    maski na contractor yan.... sino ba ang sponsor ng project? LGU o ang DPWH?

    Yun tlaga i negotiate yan ng govt sayu gusto mu man o hinde kukinin talaga yan pls make a sketch plan para makita namin indicate the area affected.

    Just so you guys know, yung katabi namin sa labas are skwater (informal settler) dapat doon nila itinapat yung Pilar. Kasi yung tinitirikan ng skwater was a right of way papunta sa likod. And kung dito ilagay yung pilar, atleast hindi kami maaabala
