Jaywalker killed in Pasay

A jaywalker was killed last Tuesday evening when he tried to evade a vehicle on the South Superhighway in Pasay City, according to the Southern Police District (SPD)-Traffic Division.
Senior Police Officer 4 Oscar Alicando identified the victim as Domingo Antonio, a native of Barangay Magsaysay, Carmen, Davao del Norte.
The driver of the vehicle Jovanie Naa, 24, a resident of Barrio Iba, Meycauayan, Bulacan, is currently detained at the SPD-Traffic Division Office and is facing charges of reckless imprudence resulting to homicide.
Naa told Alicando that at around 6:15 p.m. Tuesday, he was driving his white Toyota Corolla (TFA-301) and headed for Makati on the northbound lane of the South Superhighway when the incident took place.
Naa saw the victim making a dash toward the other side of the highway and immediately stepped on the brakes, but could not stop his car in time.
"Despite his efforts, Naa hit and bumped the victim on the right side of his body and as a result of the impact, his head smashed into the vehicle’s front windshield that caused his death," the police officer said.
He said it was not entirely Naa’s fault because the victim was jaywalking and crossing a dimly lit area, with the light only coming from headlights of speeding cars. – Evelyn Macairan
IMHO lang, hindi dapat i-charge ng reckless imprudence ang driver, it's not his fault.

SOP na kasi sa atin ang kasuhan. Pero malamang abswelto din iyan. So what's the point na kasuhan pa diba? Kaya naman ang bagal ng hustisya sa atin, eh.
Kung ako si Naa, sisingilin ko ng danos perwisyos ang mga kamag-anak ng jaywalker. Mahal din magpaayos ng sasakyan.

December 18th, 2003 10:47 AM #4tingin ko dapat compromise...e.g. driver should be charged, pero not as serious as reckless imprudence...the court should take into consideration that the victim willingly put himself in the wrong place at the wrong time
For highways like South Super or EDSA, pedestrians like these not only put themselves in danger, but other motorists, pati pasahero ng bus at jeepney who are dog tired and just wanna go home to their families, at risk as well
One would wonder though: baket dimly lit ung South Super?

I think the only reason drivers are charged is to prevent them from intentionally running over jaywalkers. :D

December 18th, 2003 12:34 PM #6ewan ko ba, talagang ang hirap minsan pasunurin ang mga tao sa atin. nakaka-inis din ang mga driver na hindi marunong mag-menor o huminto sa pedestrian lane. nakikita na nga nila na me tumatawid sa pedestrian lane eh ikaw pa ang bubusinahan.

December 18th, 2003 12:41 PM #7medyo off-topic, pero ung QC circle, madalas bang me nasasagasaan dun? they have pedestrian lanes leading into the park at the center, pero mukhang nakakatakot dumaan...mga 6 lanes of traffic ata, tapos ang bibilis pang magpatakbo kotse dun.

Ewan ko sa nasasagasaan pero marami nang muntik magbanggaan diyan sa Circle dahil biglang tumatakbo across 6 lanes yung mga tao. Muntik na ko mahampas ng lumang Toyota diyan dati. Biglang may tumawid, preno kami lahat. Yung Toyota nag-skid and came to a stop facing sideways na. Close call talaga.

December 18th, 2003 12:52 PM #9during peak hours me nag-aasisst sa mga tumatawid. nakakatakot nga talaga tumawid dun, ang laki ng daan at ang bibilis ng sasakyan.

The presence of a Pedestrian crossing does not give you the absolute right to cross the road with reckless abandon. You still have to use your better judgement.
