i'll definitely consult a lawyer, pero alam naman natin na ang mga lawyers, palaging sasabihin kaya natin yan, mananalo tayo, dahil matalo or manalo, may bayad sila. kaya dito muna ako nag tanong para malaman ko rin ang mga naka experience na ng ganito.

bro -- best to deposit the check and have the bank reject it (DAIF or DAUF). this way, you have a prima facie case now for violation of the bouncing checks law. by the way, it is easier to prove violation of bouncing checks than estafa as the evidences needed for the former are far less stringent and more clear cut.

once the bank rejects your check, consult your lawyer and have him/her send a demand letter. if demand fails, then you will of course have to pursue legal action

you can either file a civil or criminal suit. but in my experience, mas convincing (and less expensive, relatively) ang criminal suit. once it hurdles the preliminary investigation and a criminal complaint is filed and a warrant of arrest issued, most of time mag settle na yan

as for your lawyer, he/she should give you a frank assessment of your chances in the case. a simple "kaya yan" o "mananalo yan" is not enough. at the very least, you should be given some percentage odds as well as a run through of the evidences required and the time that will be spent. you need all these information for a proper cost - benefit analysis
