bro -- best to deposit the check and have the bank reject it (DAIF or DAUF). this way, you have a prima facie case now for violation of the bouncing checks law. by the way, it is easier to prove violation of bouncing checks than estafa as the evidences needed for the former are far less stringent and more clear cut.Originally Posted by boybi

as for your lawyer, he/she should give you a frank assessment of your chances in the case. a simple "kaya yan" o "mananalo yan" is not enough. at the very least, you should be given some percentage odds as well as a run through of the evidences required and the time that will be spent. you need all these information for a proper cost - benefit analysis
