Party-list lawmaker mulls sanction over video footage of 'Pamela' | Sun.Star
Monday, May 21, 2012
MANILA (2nd Update) -- A party-list lawmaker is considering possible sanctions against those who released the video footage of "Pamela," the Filipina who accused a Panamanian diplomat of rape.
Gabriela Women's Party Representative Luz Ilagan called on Youtube and Facebook users and administrators to immediately remove the videos showing Pamela and Panamanian diplomat Erick Bairnals Shcks entering the latter's condominium unit as these plainly showed the victim's face and revealed her identity.
"This is Pamela being violated, raped and humiliated over and over again. Let us use technological advances responsibly and be careful not to violate further the rights of victims of violence and ***ual abuse," Ilagan said in a statement.
The lawmaker said that if it had been the Panamanian envoy who released this video, then it would be telling of his character.
"Whoever released this video clearly intends to further humiliate the victim while attempting to clear Schks of the crime of rape. The video does not in any way prove that rape did not occur. What it does is subject the victim to further violence," she said.
Ilagan is also seeking an investigation on lapses in security procedures, particularly on the release of closed-circuit television (CCTV) footages and violations of the Rape Victim Assistance and Protection Act of 1998, which requires the government to provide necessary assistance and protection to rape victims including that of ensuring the privacy and safety of victims.
Meanwhile, Isabela Representative Rodolfo Albano urged the government to be more assertive and protective of its citizens who are victimized by abusive foreign diplomats.
Albano expressed fear that aggrieved parties and concerned quarters may put the law in their own hands to settle grudge against foreign diplomatic officials who may be accused of rape or ***ual harassment against Filipino women in the future.
"We cannot expect our countrymen to act passive all the time. Filipinos are generally friendly and hospitable but they can do anything drastic when pushed against the wall," Albano said.
"We cannot just sit and do nothing while these crimes against our women are being perpetrated by foreigners who are considered visitors," he added.
In the Senate inquiry conducted last week, officials from the Department of Justice and Department of Foreign Affair admitted that their hands were tied because the suspect is covered by diplomatic immunity under the Vienna Convention on Diplomatic Relations.
A senator, on the other hand, cautioned the public against the possibility of blaming the Filipina following the spread of the video footage on social networking sites.
"Colonial mentality is still with us. We believe a foreigner more than we believe a Filipina who made a sworn statement that she was raped and went through the hassle of filing a case in court. If no rape transpired, why did the accused leave the country immediately?" Senator Vicente Sotto III said.
Sotto, who lashed out at the Department of Foreign Affairs and the Department of Justice for allowing Schcks to leave the Philippines last week, said photo grabs showing the Filipina kissing the Panamanian do not disprove the occurrence of rape.
"The CCTV showing the Filipina kissing the accused is not proof that no rape transpired in the room. She was assured that people were coming over to the room so there was nothing to worry about," he said. (Kathrina Alvarez/Virgil Lopez/Sunnex)Last edited by Monseratto; May 21st, 2012 at 08:20 PM.
