at least hindi naman nila kaya kunin buong kabuhayan mo like what happened to these 168 traders. kung legal ka, you can contest legally the acts of the govt. pero ito sitting duck na talaga. I doubt if even hiring of lawyers can save them now. tantamount to smuggling ito d'ba. naconfiscate na goods without assurance of reclaim, tapos criminally liable pa yun owners.

The prices of good at 168 Mall and Tutuban / Divisoria are the same. It's a wonder why people think it's cheaper at 168 Mall. AC's observation is agreeable. It's common knowledge that these sidewalk vendors pay blood money. That is why they will fight to death when they are being dispersed. Just like the jeepney drivers who block the entire road to pick up passengers in Divisoria. Rumour has it that it was a giant mall that requested for 168 Mall to be closed down. However, the other legitimate businessmen who are being blocked by the sidewalk vendors do not have enough connections with the government.

if there's one thing we should know about the govt. or the court system for that matter, comparison is not evidence. same thing as when a corporation got raided for piracy, corporation cannot claim "eh bakit kami lang? andami maliliit na kumpanya dyan na gumagamit ng pirated. yan ang ebidensya na dapat hindi kami hulihin."

same thing when I got flagged down by a traffic aide while entering a one way street in Rockwell, sabi ko: "sumunod lang ako sa nasa harap ko". ang sagot sa ba naman sakin ng pulis "eh bakit kayo sumunod, alam nyo na nga bawal." hindi nya nahabol yun nasa harap ko kasi nakatakbo kagad. a day or two after, na-realize ko may point nga sya.

actually, if you're concerned about the smuggling, it's not the vendors' fault. why? because its the forwarders that are tolerated!

each time there is a new shipment to 168, sacks upon sacks of mechandise arrive--how are they able to send the goods there without problems then? wala naman lagay yun palabas ng forwarders eh!

and no, it's not just 168 with the "smuggling" practice-isama nyo na tutuban, Divi mall pati quiapo!

the system is just so F'd up!

and yes i've heard it's the BIGGEST RETAILER IN THE COUNTRY who's behind the 168 raids. like those 168 vendors, he's chinese too. with enough wealth to effect a change in GNP/GDP and surely even retail laws, oh well that's just far too much power. oh yeah, his mall is also selling as cheap as 168 nowadays.

nothing against the chinese, im chinese myself.

simple lang yan, bakit gusto ng mga tao ang murang bilihin at dinadayo yan. dahil mahal ang bilihin sa mall, tingnan nyo, madalas kokonti ang tao sa mall, kaya nga ang dalas nilang mag sale, tingnan nyo yung mga pirated cd and dvds, kahit sinabi nila na huhulihin daw yung mga bumibili nito. natakot ba yung mga bumibili? hindi. mas lalong dumami ang mga bumibili, kasi nga, sa kaunting halaga na kumpara sa mga original. eh, kahit paano sa ilang oras na palabas, makakalimutan mo ang mga problema mo. ang tao ngayon di na tumitingin sa quality, sa murang presyo na tumitingin, dahil mahirap talaga ang buhay ngayon.. sa akin lang sa totoo nakakatulong yang mga yan, 168, divisoria mall, etc dahil bumibili ako dyan at binebenta ko rin sa murang halaga, ANG GOBYERNO? hindi nakakatulong yan. true by way of taxation. double if not triple taxation pa nga. you're taxed when you earn, you're taxed when you spend, and you're taxed when you save.

Does this mean that any customs official can go to any mall and ask any legit store there if they have import papers? Then proceeds to confiscate the merchandise if the employess cannot show the papers. Can they do this to Bench, Kamiseta, etc.? Just another twisted logic of our government. Isn't the jurisdiction of Customs at the port of entries? If smuggled goods got through, then raiding the importers is an admission that they did not do their jobs properly.

i discussed this with a friend who's quite knowledgeable about taxes and duties (BIR and BOC)... it is really within the powers of the BOC (Customs) to check the store of the retailer and check for proof of payment of taxes and duties... in an ideal setting where the playing field is level, all the retailer has to do is show proof of payment of taxes / duties (kung siya ang nag-import) or show proof of purchase / payment from a supplier... the BOC then will trace up the chain until it reaches the importer to check if taxes and duties are paid for...

yung authority naman nila to confiscate the inventories of the retailers SUSPECTED of being smuggled is parang yung logic behind fencing.. (yung bibilhin mo ay nakaw ng ibang tao)... regardless if you know or you don't know that the item you're buying is stolen, liable ka pa rin sa batas basta stolen yung goods na bibilihin mo... kung baga... the buyer has to first exert ALL <?> efforts to check kung nakaw yung bibilhin niya bago nya tuluyan bilhin ito...

as for my own opinion... no way out talaga ang mga may pwesto sa 168... in a way common knowledge na smehow smuggled ang goods dito... ituro nila supplier, malamang chinese mainlander... walang taxes and duties paid... it just sucks big time na dapat dito ang burden of proof ay nasa customs, since sila ang nag -accuse na smuggled goods.. they should be the ones to prove na smuggled nga... hindi puwedeng suspicion pa lang ay kikilos na sila...

on the vendors at divisoria... well.. the smuggled goods also make their way into the vendors... yung isa nga dyang pwesto sa may recto / soler (near 168 mall) is actually allegedly owned and operated by a policeman himself!! so may proteksyon nga talaga...

if the rumors are true nga....actually nagtataka nga ako kung bakit ngayon lang umaksyon e

and yes, i am chinese. And no, i don't shop at 168.
