    nasa news kagabi.. sumuko na sya before pa mailabas yung warrant.. since non bailable yung kaso.. don sya naka detained sa NBI.. VIP treatment na naman.. kung ordinaryo tao yan.. sa city jail na agad yan..

    I wonder what will happen though. I don't think there's a quick solution how lawyer can do to get him out at least for temporary. Can the lawyer convince a judge that he is not a flight risk? Or tuloy tuloy na to hanggang matapos ang trials?

    mag issue daw nang motion to reconsider na mahina yung kaso to warrant RAPE.. para ma downgrade.. then they can file bail..

    Not automatic naman na kapag non-bailable eh hindi na maka-bail. If you can convince the court that the evidence is weak, then bail can be had. Discretionary kasi yan sa Judge.

    No person charged with a capital offense or an offense punishable by reclusion perpetua or life imprisonment, when evidence of guilt is strong, shall be admitted to bail regardless of the stage of the criminal prosecution.

    Presumption of innocence pa din kasi mangingibabaw at yung filing of a case is based on probable cause lang kasi kaya hindi naman kelangan ng sobrang bigat na evidence. Sa actual hearing na kasi yan magkakaalaman.

    If evidence is strong naman like yung sa Mamasapano case eh hindi naman papayagan. Discretionary talaga yan sa Judge eh. Ganun talaga. Yung iba diskarte eh wheelchair setup or hospital arrest kuno hehe

    Mas pinagtakahan pa nga yung case ni JPE. Yun kasi malakas evidence during that time.

    Since wala naman talaga normally witness ang rape, depende na lang sa narration ng biktima lung kapani-paniwala at nakaka antig damdamin. Well atleast thats how my lawyer friend puts it.

    Alos kung wala naman daw penetration (not limited to penis), walang rape.

    And kahit mag mapunta ng lalake sa condo, hinde ibig sabihin pwede na mang rape.

    ang kwento kasi nung babae.. ni rape sya nung 1st time pumunta si Vhong don sa condo nya.. ni rape sya.. tapos ni invite pa nya for 2nd time? tapos ni rape na naman daw sya.. ano yun nagustuhan yung 1st rape? kaya nagpa rape ulit nung 2nd time?
