I guess the police will just have to make do with a clean bathroom, a newly washed Pajero, a mishandeld Walther PPK , and a delay in reporting the suicide to make a "fair" judgement. Sa kaso nga ng Vizconde Massacre, yung pulis na "nag-tampered" ng crime scene nakulong. Tapos si Failon et al papakawala lang? Gusto ata ng ibang tao is for Mr. Failon to recieve a mere reprimand for these "error in judgement". If Mr. Failon doesn't get his way, expect the "bias" media to play up the political angle.

According to her, obstruction of justice should take into consideration two things: One is the intent to deliberately mislead an official investigation into a crime, the other is the educational attainment of those involved.

The househelp have claimed that it was not their intention to mislead the investigation, because they didn't even know that the bathroom where the victim was found would be used as evidence. And, being househelp, their orientation is that everything in the household should be maintained in order, whether they are told or not; nakita nila na hindi maayos yung banyo, kaya inayos nila, since that's what they are accustomed to. Since they are of limited education, how can anyone expect them to know proper crime scene procedures and protocol (even police officers can f*ck up a crime scene big time, and those people are the ones who should know what they're doing)? It's not like crimes like this happen frequently in their household, for them to automatically know what to do when they chance upon a dead body in one of the rooms. And yes, another reason brought up was that they didn't want the youngest child to see the crime scene as it was.

Why wasn't the incident reported to the police? My take is that, of course, when you have a loved one on the brink of death, your first priority is to see to it that that person gets immediate medical attention, and collect your thoughts properly while you're at it, so that you'll be able to eventually give even a halfway decent statement to authorities with which to help in their investigation.

I wouldn't be surprised at all if the QCPD got overzealous with their actions, considering the media frenzy surrounding the incident; they're bound to pounce on the event as a chance to publicly 'redeem' themselves, especially as it involves one of their harshest critics.
i agree bro. but sa akin, whether or not Ted Failon shot his wife is not the issue. The issue is how the police is handling the case. If this happens to a media man, much more of an ordinary citizen.

There is some level of high-handedness in the way the QCPD are handling this. Sheesh! Kung talagang kaya nilang patunayan yung obstruction of justice charge sa husgado e gawin nila. I'll bet a month's salary they can't convict since they can't make the elements.

I hate these police officers who did a scandalous invitation to Ted's in-laws, they have brought fears and anxiety to the patients inside the hospital.

For everyone's information, here are the provisions of the Rules of Court on warrantless arrests:

A peace officer or a private person may, without a warrant, arrest a person:

    (a) When, in his presence, the person to be arrested has committed, is acutally committing, or is attempting to commit an offense;

    (b) When an offense has just been committed, and he has probable cause to believe, based on personal knowledge of the facts or circumstances that the person to be arrested has committed it; and

    (c) When the person to be arrested is a prisoner who has escaped from a penal establishment or place where he is serving final judgment or is temporarily confined while his case is pending, or has escaped while being transferred from one confinement to another.

Dito pa lang, medyo malabo ang basis ng arrest and detention ng PNP sa kasambahay at kapatid ng asawa in Failon. Ano ba naman ang mag-apply sila ng arrest warrant sa huwes?

Those arresting officers better prepare for one big hell of an admin case if not a daily flogging from the media if the warrantless arrests are held to be invalid.
