    guys, i need your opinion. Yesterday while going to my in-laws house in marikina a bnew innova rammed my car. The lady driver apologized and admitted kasalanan niya since she was eating burger while driving. Nakita ko pa yung mga fries sa carpet niya. Pumayag siya na siya na gagastos ng pagawa since the car i drove yesterday TPL lang. Problema, gusto niya 3.8k lng ibibigay niya. My rear fender and bumper ang nadali. I told her misis, may gumagawa sa akin ng oto namin for more than 10 years na gusto ko don dalhin. Ngy0n kung magkano estimate niya yun ang isettle m0. Ayaw pumayag dahil yung kapitbhay daw niya na may talyer eh 4k lng ang gastos niya. I told her na anlayo ng talyer niyo and ayoko sa iba. Which i think is fair. To make the story short 3.8k lng ibibigay niya take it or leave it. Im planning to go to the brgy and police station to report the incident. All i got from her is her address and contact number, fullname.

    btw, hindi na ako nag antay ng traffic police to file the incident on the spot. We just drove to my in-laws house and don kami nag usap since my 9 month old son was crying sa loob ng oto. Then we went to her house to show her kapitbahay talyer yung damage.

    wala kana magawa dyan.

    hit and run lang pwede mo ikaso dyan dahil wala kang police report or any evidence na sya may kasalanan at sya bumangga syo.

    may photo copy kaba nang license nya?

    Claim to her insurance na lang kung sa tingin mo di sapat yung 3800 na inaalok nya. Since brand new yung innova, tyak naka comprehensive insurance pa yan. Medyo madaming paper works nga lang kapag sa insurance ka nag claim like kukuha ka pa ng cert of no claim sa insurance mo kahit TPL lang yan, pictures, police report or affidavit nung innova owner na fault nya yung accident, etc....etc..... good luck!

    Mukha ka atang mabait bro, takutin mo ng konti bibigay din yan. Siya na nga tong namerwisyo, siya pa tong ayaw magbayad.

    Dapat di ka pumayag.dapat tumawag ka ng barangay or police para may report tapos punta kayo sa isang autoshop pa estimate mo tapos doon ninyo paguusapan kung magkano dapat ang babayaran niya.tatakbo na yan kasi tinangap muna 3.8k sabihin niya wala na siyang pakialam baka mali pa binigay niyang address or fullname sana pina xerox mo ang drivers license niya.sana kumuha karin ng picture doon sa mismo tama ng innova niya sa sasakyan mo para may ebidensiya ka.

    para clear tell us first kung tinanggap mo na yung payment... based sa statement mo parang hindi pa...

    iba kasi ang legal implications kung nagbayad na siya...

    I wont advise this... based from the subsequent events that transpired, it is no longer an issue of hit and run. TS will be liable for perjury and, worse, falsification of public document if he will execute affidavit to that effect... my cent

    baka ang sinasabi nung nakabangga sayo eh yung participation nya sa insurance nya.. which is around that.. mga 4T.. linawin mo sa kanya.. kung i cla claim nya sa insurance.. eh yun nga ang babayaran nya.. tapos yung insurance nya na ang kausapin mo..

    hindi kamo sayo bibigay yung 3.8T don sa insurance kamo nya.. mag claim sya.

    thanks sa mga replies. the reason why i did not wait for the proper authority is because my son hit his head sa window. the house of my in-laws are just a few blocks away so i just decided na ihatid na siya. we went to her house mga 10 kilometers away from the incident. nandun yung laterong kapitbahay nya and made an estimate. technically, talo ako pero is there something that i can do? i don't after her money. magkaroon lang siya ng record sa fiscal that's enough for me.

    have you received na ba yung 3.8k or hindi pa? have you put your agreement for the repair in writing or verbal lang?

    sige, mahaba habang discussion to....

    kung nareceive mo na yung pera, thats it, you will shoulder the difference o balance ng cost of repair..

    kung hindi pa, you can insist on your terms under threat of resorting legal remedies if she will not agree...

    what case you need to file? RIR to damage to property....but kung yung anak mo ay nag suffer ng injuries, have it checked by a medico legal (gov't doctor/hospital) and then make a separate case of RIR to slight physical injury... if the injury is severe, the case will be compounded, meaning it will be RIR to damage to property and physical injury...

    what docs you need aside from the medical certificate? as much as possible a police investigation report...but since you removed your car already, investigation is no longer possible. just go to the police station and cause a blotter report of the incident.

    sa insurance side naman...

    kung may agreement na kayo that she will be the one to shoulder the expenses, but to some extent, it will be binding between you. but as far as the insurance is concerned, she can no longer ask reimbursement of the advance payment gave to you since the the agreement was reached without the concurrence of the insurance...

    on the other hand, if you will ask the insurance to shoulder the balance of the cost of repairs, the insurance will deny your claim for the same reason... in short, you cannot agree for a certain amount from her and at the same time seek damage claim from the insurance... isa lang ang dapat, mag settle or mag claim...

    di ko na discuss yung side ng insured, di naman material sa query mo.... regards..

    phez, maraming salamat. very informative. i forgot to mention that i did not receive any amount from her. no written or verbal agreement. i have pics on my i-touch of our vehicles focusing on the damage. i had my son checked yesterday at med. city so far he's fine, very fine. nagulat lang siguro during the impact and slightly bumped his head. Question, bro. What is RIR? Where can i file that? And saang presinto? I'm from qc. The incident nangyari sa marikina. The innova driver is from san mateo rizal. Thanks again guys.

    RIR - reckless imprudence resulting (to damage to property, physical injury or both)

    kung naimpbestigahan ng police, sila na dapat mag file sa Marikina fiscal's/Prosecutors Office (yun yung me territorial jurisdicition sa criminal aspect)
    but since hindi, or malamang hindi na pumayag kung irequest mo sa kanila, you have to file it on your own... you need to prepare/execute complaint affidavit and file it...

    kung civil case naman i file mo, you can select sa 2 venues.. sa residence mo or sa residence ng kalaban mo.

    PS.
    sayang, dapat pinapirma mo kahit sa papel lang admitting her fault para you can easily prove your case.. saka me proof ka to claim sa insurance niya...

    Paano sir kung hindi na nagpakita?

    Kung mali na yung name and address nya? Hindi na ba consider na hit and run ang reklamo nya sa LTO?

    Kung walang wala na eh kahit sa rehistro lang magkaron na nang case at mahirapan na sya makapagregister na ulit.

    the rule of thumb in giving advise is to confine and limit on the facts given... do not go beyond it, speculate or make unwarranted conjecture or conclusion coz it might lead to a different or improper remedy... simple logic will do but do not add additional facts...

    the same rule applies in giving legal advise...parang exam sa law school, pag ang sagot ay based don sa hypothesis or facts na wala sa tanong and simply supplanted or presumed by the examinee but did not qualify or explain how he arrived in such conclusion, mas malamang he will not get the best score for that manner of answering.... no one knows what is in someone's mind...

    anyways, to answer your queries, please consider this...

    pag hindi na nagpakita after she agreed to pay 3.8k, the only logical conclusion is that she no longer want to make true of her promise or the aggrieved did not agree to it.. in short, its a failed settlement, plain and simple...file the case or cases i mentioned...

    elaborated scenario naman tayo...

    nagkaroon ng agreement, perfected and both parties agreed to it... then hindi nagpakita yung party and you want to file a case other than RIR or damage suit, kailangan mo i prove na yung pag enter niya sa agreement was a mere ploy or craft just to evade her responsibilities.. in short, deceit or misrepresentation was employed which made you decide to let her go and it turned out that she has no intention to fulfill it, dito papasok yung question mo na paano kung mali na yung name or address niya and it was really her intention to mislead you, kailangan mo mapapasok sa deceit or misrepresentation yung ginawa niya... file estafa case yun nga lang medyo mahirapan ka to prosecute her para ma convict, kasi mahirap i prove ang deceit without tangible evidence since sa criminal case ay "proof beyond reasonable doubt" ang inoobserve...

    kung lagpas na ng 60 days, wala ka na option but to file civil case... light felonies prescribe in 60 days, so more on collection nalang ng damage ang pwede gawin...

    BTW in hit and run cases, presence of danger or imminent fear of life or limb is a valid defense... in short, to fall as a hit and run, there must be no supervening event that transpired, dapat after the incident tumakbo na yung culprit but not because me danger sa kanya... in appreciating that defense, dapat sa authorities siya tumakbo at hindi kung saan saan lang...

    sa case ni TS, nagkaroon pa sila ng bargaining at nakarating pa sila bahay na magkasama.... malabo na mangyari yung hit and run scenario...

    here's my advise bro:

    wag mo kunin yung 3.8k. (pero kung nakuha mo na, gaya ng sabi ng iba, pag nakuha mo na yung pera na yun, tapos na ang deal.) kausapin nyo yung babae at encourage her to get a police report.. kailangan nyo both parties yan for insurance claims, and then sabihin nyo na lang sa police na kayo (bumangga at nakabangga) na lang ang magsettle. wala na kaso mangyayari (pero nasa sayo pa rin yun).. tapos, pag napagusapan nyo na yung settlement, gawa kayo ng kasulatan na naka indicate doon ang terms and conditions ng settlement nyo together w/ the signatures of both parties and pa notaryo mo at ibigay mo yung xerox copy sa police / baranggay. kasi in instance na tinakbuhan ka nya, pwede mo pa sya makasuhan dahil hindi nya natupad yung nandun sa letter of agreement nyo at witness ang police o baranggay.

    this is based from what i experienced.

    thanks again, guys! i filed a report na at the marikina police. hopefully in a week or two may result na. i texted the LTO vehicle info. I entered her innova's plate number to 2600. No record was found. Hmmm...

    Your 9 month old child hit his head on the car's window??!!!.. kung ako mas mag aalala ako sa anak ko kesa sa kotse, mas inuna pang ipacheck sa talyer yung kotse kesa dinala sa hospital or clinic yung bata??? head trauma to children are far worse and might endanger your child's life lest have some life long effects..

    right away you should've called for police and ambulance assistance.. and this coulve made things easier for you..
