ktm 777 ford E150 VAN with blinkers pa..wala namang traffic at humaharang sa daan.duh
isa kang malaking DUH
ask ko lang, paano ba tinitignan ng mga operatives ng task force wang wang kung meron sirens and blinkers ang mga vehicles? do they actually stop every car and tell them to open the hoods? kung ganyan nga hindi ba nagiging sobrang traffic dun sa check point and sobrang nakakaabala na sa mga walang nakakabit na sirens and blinkers?

bro -- siguro naka abang lang sila ang mang huhuli lang pag nag wang wang ka or nag blinker. given that it is not a real checkpoint in the true meaning of the word, then it makes no sense to announce that an operation or checkpoint will be set upOriginally Posted by boybi
marami akong narinig na wang wang at mga traffic enforcers and police walang ginagawa. hindi man lang pinara at i-inspect
so much for government will power![]()
last year, before the may presidential elections, if you will remember, nagtayo ng maraming check points ang NAKTF yata yun. naka commemorative plate pa ako nun, so pinara ako sa checkpoint, i opened my window, and the police asked me to honk my horn, e hindi naman naka-wang wang, so pinaalis din ako. in cases like this, can they really do this? asking motorists to honk horns or switch on the headlights? can the motorists refuse? ano lang ba ang mga pwdeng gawin ng mga law enforcers manning checkpoints? ang alam ko lang bawal nilang ipabukas ang mga compartments, including the rear trunk. does this include the engine compartment?

bro -- dami mong tanong ah, heheheheheOriginally Posted by boybi
in sum (and based on the supreme court rulings on the matter), check points are a valid exercise of state authority under the doctrine of police power. however, we have to be mindful of the plain view doctrine. those manning the checkpoints can only look at your car and they cannot compel you to open anything or to even have honk your horn, if you do not want to.
unless crime is being committed in their presence, all police officers need a warrant of arrest or search warrant before they can inspect anything that is not in plain view
however, once you open your trunk or glove compartment or engine hood voluntarily, this may be construed as a waiver of your constitutional right against unreasonable search
ako nga, one evening along the road from silay city to victorias city in negros occidental, nag check point ang rmg doon. i opened my windows but refused to open my glove compartment. wala silang nagawa. hanggang flashlight lang loob ng kotse

if memory serves me right, may pinalabas na guidelines ang pnp for a proper checkpoint. the policemen must be in uniform (well, holduppers and kidnappers can also do that), may patrol car with lights on and flashing, proper signages and must be courteous
more often than not, instinct nalang talaga in determining if it is a proper checkpoint or one of those hulidap or hulinap points![]()
boybi -- i got this from the internet. this was published in the philippine star
