    Boy killed in alleged drunk driving incident in Manila–MMDA

    MANILA, Philippines — A 12-year-old boy was killed and another was injured after they were hit by a car with an alleged drunk driver behind the wheel in Manila early Thursday, a Metropolitan Manila Development Authority-metrobase official said.

    Alpha 1 Dang Rosolada said the boy, identified as Joshua Tanao de Luna, along with another unidentified victim, were hit by a Mitsubishi Adventure (WSW 194) driven by one Edgardo Cruz Herrera Jr. along the southbound lane of Osmeña Highway corner San Andres,Manila around 6:17 a.m.

    Instead of pulling over to check on the people he hit, Herrera allegedly sped even faster but was eventually cornered and arrested, radio reports said.

    Other information on the incident were not readily available.

    Manslaughter yun hindi murder. Murder is premediated and planned. Ibig sabihin dapat nag-plan ang driver na lasingin sarili, and intentionally na banggain ung bata.

    other countries categorize DUI as grievous crimes. imo, drunk driver who kills is murder, not homicide.

    kung nagpalasing, then plinano nya na papalasing sya. kasi kung hindi, titigil na sya pag inom. you might view it as not intentional, but if you started to drive while drunk, then what ever happens on the road becomes intentional, because you intentionally drove knowing that your intoxicated.

    sa sobrang lasing siguro hindi napansin na naka stop na.. o sa sobrang lasing.. malakas ang loob kaya kahit stop na tinawid pa din.. tapos nakita na nya yung tumatawid.. hindi pa nag preno.. tapos imbes na hintuan.. tumakbo pa.. una pwede namang di sya mag drive kung lasing.. pero nag drive.. pwede namang huminto don sa stop light.. pwede naman nag preno sya para hindi abutan yung bata.. pwede namang tumigil at dalhin nya sa hospital.. pero lahat yun hindi nya ginawa..

    Uh... accidental death is never treated as murder.

    Murder, by definition of law, has to be intentional. First degree murder is pre-meditated.

    A vehicular accident resulting in death, which results from drunken-ness, sleepiness or distraction, is, by definition, not intentional, and will be treated as manslaughter, which already carries a very stiff penalty.

    -

    Of course, one wonders at death resulting from a vehicular accident caused by (sober) homicidal recklessness which doesn't lead to any jail time at all... *cough* *R.Guttierez* *cough*

    wala daw probable cause... may patay hindi pa ba sapat na probable cause yun?

    First of all, do we actually have a legal definition of what "drunk" or alcohol intoxication is with regards to driving.
    Second, do our police officers have the capability or equipment to measure alcohol levels?

    Third, has anyone has actually been put to jail by due to drunk driving or due to vehicular accidents.

    Remember, Richard Gutierez? He was driving when his car met an accident killing one of the passengers. And he was found not guilty? WTF. Probably it was the fault of the coconut tree not his.

    MMDA spokesperson Maria Luwalhati Dorotan said the agency has acquired an initial five Breathalyzers or breath analyzers at P30,000 each.

    O.A. naman masyado texting palang while driving Death na agad... wala naman namatay.... stiffer penalties lang muna... like suspended for 1 year ang license.. 50K fine...

    Same old problem with our law system... if the guilty party reaches an agreement with the victim... no case.

    At the very least, Richard should have been stripped of his right to drive for an indefinite period (ten years to infinity, depending on how he tries to make up for his mistake), and given jail time for reckless driving. We all know he was driving way too fast for the road. There's plenty of evidence and eyewitness testimony. That alone should merit a huge fine and at least some jail time.

    And let's not start on Vandolph... ...strike how many, is it, now?

    In the Philippines, you have to actually commit murder and succeed to get arrested. (If you don't hit them... balewala na...) And even then...

    Or how about talking to your companion? Or looking at a billboard? Or...

    We all know we shouldn't do these things. We do them anyway. (some of us do... some have learned better).

    There are people who've killed others by not paying attentionand making the mistake of letting go of the brake in the parking lot (Ateneo).

    All accidents. If the behavior leading up to the accident was reckless enough that the person should have known not to do it, the person should get penalized with a jail term, but the death penalty for an accident is a bit absurd.
