    Hi guys,

    any lawyers here... Ask ko lang, ano ba talaga ang law in terms of parking in side street... Hindi ito main street pero yung mga 2ndary street in Manila... May mga kapitbahay kasi ako ang daming kotse puro sa labas na ka park..

    Ang reason nila public road ito... hmmm ... pwede ko ba sila paalisin if they would block my exit of my garage.. ang sama kasi nasa right lane kami... Kung may nakapart sa left lane.. medyo mahihirapan na akong lumabas... many of them sinasabi hindi mo namang harap yan.. harap na ng kapitbahay ko na which pinapayagan naman magpark...
    Ano ang pwedeng gawin... kinausap ko na kaso maga pasaway...

    AFAIK - driveway mo un kaya dapat may right ka.

    hirap ng ganyang mga tao - kinausap na ng matino baliktad pa ang sagot sa iyo.

    Ang hirap kasi matanda na yung lalaki.. yung mga anak ok pagsabihan... ... thanks anyway... hirap kasi kapag nasita mo ikaw pa ang mayabang..

    public roads belong to the public domain and for the use of all. this likewise means there is access for all

    first, check with your barangay or municipal or city government for any ordinances governing street parking in your area. book 1, title 1, chapter 2, section 21(d) of the local government code provides:

    "Any city, municipality, or Barangay may, by a duly enacted (sic) close and regulate the use of any local ordinance, temporarily street, road, thoroughfare xxx"

    second, your access to the public road from your garage should not be blocked as the road belongs to the public domain and not exclusively to the person blocking you. Art 420 of the civil code states:

    "The following things are property of public dominion:

    (1) Those intended for public use, such as roads, canals, rivers, *******s, ports and bridges constructed by the State, banks, shores, roadsteads, and others of similar character; xxx"


    (see also Art 424)

    thus, without any claim of ownership, whoever is by blocking you is considered a nuisance. Art 694 of the civil code, it is provided:

    "A nuisance is any act, omission, establishment, business, condition of property, or anything else which:

    (1) xxx; or
    (2) xxx; or
    (3) xxx; or
    (4) Obstructs or interferes with the free passage of any public highway or street, or any body of water; or
    (5) Hinders or impairs the use of property."


    the venue for your complaints will be with your barangay

    Didn't Lito Atienza pass (or was planning to pass) an ordinance in Manila stating that cars that do not have garages will not be allowed to park in the streets?

    before, may SIDEWALK parking permit ka dapat na kukunin from City Hall.

    di ko lang sure kung uso pa ito ngayon.

    Dati akong taga manila, yes may sidewalk parking permit nga kaming tinutubos either quarterly, semi-annual or annual. tama c 111prez sa lahat na sinabing provisions. Pero before resorting sa barangay, try to talk to them first ng mahinahon preferrably sa mga anak na mas madaling kausap. Minsan kasi pag dinala sa barangay kaagad eh sira na ang relasyon nyo bilang magkapit-bahay.

    bro -- the reference laws are the local government code of 1991 and the civil code of the philippines. as for a specific local ordinance, you will have to check with manila city hall records.

    there are law pero ask a mayor or a governor on top of your head that question and i bet you a thousand bucks, sagot niyan uhh, ahhh, papaikutin ka lang pero he or she didnt ans the problem; para sa akin when there a driveway, its a right to respect not to park on their driveway, minsan nakalagay pa nga do not block the driveway, stupid lng minsa ibang tao; it happened to me thrice na, i was about to go out tapos me nakapark outside our driveway, although nakalabas ako 1 inch from both side lang ang pagitan sa car ko, the hell with that owner who parked their car, kaya i put a sign and clip it on the wiper, sa susunod at naiinis ako puputukin ko ang gulong ng sasakyan

    mahirap talaga ang ganyan problem.....try to talk to the owners children first.....dapat mahinahon lang usap......

    i had the same problem before pero ok na ngayon

    On a different albeit related topic, one of my frustrations really is when establishments put "customer parking only" on the street fronting their establishment. Ang alam ko maski nga sidewalk hindi na sa kanila tapos yung kalye aangkinin nila

    parking in side street eh talagang problema,lalo na sa street na maliit at makipot.sa akin ang magagawa mo na lang ay maki-usap,kasi nga mahirap may kaaway lalot kapitbahay,cguro naman hindi magagalit kung maki-usap ka ng maayos-yung bang tamang approach at kung maaari eh hanapin mo ang kiliti nya.kasi kung mag-rereport ka naman sa mga autoridad o'kahit sa barangay lang eh baka naman sumama ang loob at magtanim pa ng galit sayo.ewan kulang kung adviceable pa ang salawikain na"kapag binato ka ng bato eh batuhin mo rin ng tinapay" ang sa akin nalang iwas nalang sa gulo at kung hindi ka makatiis eh if,necessary to find a new home or place...

    bro, I dont think you should use the law in this. it's not diplomatic. kung minsan nakaka-offend sa other party and you'll end up arguing na mag-demandahan kayo.

    I witnessed the same thing in GB3 sa cinema noon bagu-bago pa yun.
    may dalwa pasosyal na nanay, nagsigawan dun, ang sigaw noon isa, idedemanda kita!, sigaw din nun isa idedemanda din kita! sino tinakot mo!
    and all that fiasco bec. of an argument on their kids on who got first in the popcorn line ...

    padalhan mo na lang ng lutong bahay na adobo or something.

    Sir hagisan mo na lang ng mag-asawang butiki yung sasakyan na nakapark sa harap mo. Proven na dito sa Tsikot na mahirap hulihin mga yun. Pagkahagis, sabihin mo "Go and multiply". Pero seriously speaking, you should exhaust all means as suggested by our peeps bago ka pumunta sa legal solution. This includes the butiki. He..he..

    makipagpalit ka na lang sa kanya. sabihin mo sa parking mo na siya mag-park tapos ikaw sa driveway! tapos pag gagamitin nya kotse nya syempre di siya makakalabas kasi pagtataguan mo ehehehehe!

    hehehe. Ginawa ko na ya sa kapitbahay namin ang kulit sabi ko kasyang kasya sabi ko palit kami nagpalit kami nailabas ko nang walang kahirap hirap yung kotse ko sa garahe nya na nasa kabilang kalsada nakapark yung car nya.

    hehehehe. Ngayon tawa lang sya pagnagpapark ako sa tapat nila. hehehehe

    Tama sila minsan dapat kausapin natin nang maayos kung ayaw turuan mo.
