    On Target : A case worth watching

    VICTOR A. Batugal, a businessman, went to a car dealer, Nissan Gallery, at Libis, Quezon City, and bought a Nissan X-Trail sports utility vehicle.

    He brought cash so he would have a big discount. Nissan Gallery gave Batugal a receipt for the car purchase as well as a permit to get the vehicle out of the store.

    But Nissan Gallery sales representative Sheila Osalvo would not accept the money from Batugal, saying he should pay directly to Manhattan Asia Films Inc. So Batugal went to Manhattan and paid for the car.

    There was an agreement between Nissan Gallery and Manhattan that payments for cars sold by the former would be paid to Manhattan. Manhattan, you see, had ordered a number of cars from Nissan Gallery amounting to P18 milllion.

    But Manhattan didn't pay Nissan Gallery P18 million for the cars.

    Batugal, of course, didn't know this. He was an unsuspecting buyer.

    When Nissan Gallery filed a case for replevin, an action to recover personal property,with the Quezon City regional trial court, law enforcement agents went to Batugal to confiscate his car.

    But Batugal wouldn't want to part with the car he bought in good faith from Nissan Gallery. He reasoned that Nissan Gallery gave him the receipt and an exit permit for the Nissan X-Trail.

    When he came to me for advice, I told him he should not give back the car since he was issued a receipt for it by Nissan Gallery itself. He was not at fault if the deal between Nissan and Manhattan went wrong. The important thing is he paid for the car and he was issued a receipt.

    The judge who issued the replevin order should have looked at the documents presented to him by Nissan Gallery before ordering the confiscation of Batugal's car.

    Batugal, meanwhile, can't use the Nissan X-Trail because Nissan Gallery wouldn't issue him the deed of sale and other documents like registration with the Land Transportation Office (LTO).

    Now, this is a very interesting case and is worth following.
