for me ba itong reply mo? nalito lang kasi ako sa "^^" na reply mo.
'coz you uses two "^" it means two posts above you and so on. anyway, what's a good defense sa ganyan situation, atty?
self defense probably? hinde be enough yun na they forcibly open mg car's door and tried to rob me?
kung makukulong ako in trying to defend my property and my life by shooting them paano ko maprotekthan yun sarili ko sa ganyan situation?
diba part ng residence natin ang kotse, so pwede ba trespassing sila the same na pwede ko barilin yun trespasser sa bahay ko?Last edited by shadow; June 20th, 2010 at 07:18 PM.

*shadow: Yes, you can interpose self defense. In self defense, you're telling the prosecutor and eventually the judge that you killed the victim and that the killing is justified. Here, once you go to trial, the procedure will be reversed. The defense or the accused will now convince the court that there is justification to kill the victim. The burden of proving that you're innocent is now shifted on you, prosecution is now relieved from the burden of establishing your guilt. Self defense as a justifying circumstance requires the following:
Art. 11. Justifying circumstances. — The following do not incur any criminal liability:
*
1. Anyone who acts in defense of his person or rights, provided that the following circumstances concur;
*
First. Unlawful aggression.
Second. Reasonable necessity of the means employed to prevent or repel it.
Third. Lack of sufficient provocation on the part of the person defending himself.
-in the eyes if the law you commit no crime from the very beginning if you establish those requisites.
- in legal contemplation, your car isn't a dwelling. When youre inside it when the thugs were shot, then you can pursue the theory of unlawful aggression with the use of sumpak, while the traffic light went red,by plurality- that is, they were so numerous. Dami pa. Just comply those requisites, youre good, provided you have a good lawyer and a good judge.Last edited by ab_initio; June 20th, 2010 at 08:25 PM.

nasaksihan ko rin yan sir.. i dunno kung same cab.. sa akin kasi southbound din, dun sa ilalim ng buendia flyover pag-mag-u-u-turn ka papuntang Global City. sa likod lang ako ng taxi but sa bandang left nya. gulat ako may bigla tumakbong bata sa right-side ko (bale left-side ng taxi), yung isang kid naman dun right side ng taxi, sya yung nag-open ng pinto. e since walang nakuha, takbo sila pabalik pero iniwang nakaopen yung pinto. baba tuloy yung driver para i-close. tapos kami, hintuan lahat.. baka kasi masagasaan mga yun. pagdating sana sa U-turn slot, sasabihan ko sana yung MMDA, kaso baka businahan ako ng nasa likod.. i decided wag na lang. next time na lang siguro. so, medyo nauuso na pala sa kanila ito.

June 21st, 2010 01:13 PM #17Different cab and time po malamang ito, but it seems to be happening alot. Ang dami kayang MMDA dyan sa Edsa, I would believe that somehow these reports have reached them already pero wala silang ginagawa.
Nagtataka lang ako, if this is an MO to get things inside the car, why go for taxis in the first place? Tapos yung na-witness ko pa, walang sakay na pasahero yung taxi... and I would think it is the same case here, kasi the taxi driver got down to close the doors pa. Kaya dahil dito naisip ko na baka hindi ito MO, at talagang mga #$*%&*! walang magawa lang sa buhay itong mga batang ito kungdi mamerwisyo ng iba.

mukhang ganyan po yata style talaga nila. pini-pickup yung driver lang yung sakay na alam nilang mabubuksan yung pinto, hence, usually taxi pinupuntirya. sabi nung kakilala kong driver, ganyan nga daw yun, bubuksan yung pinto say sa passenger side, pag tipong isasara mo na, may ibang bata bubuksan yung kabilang pinto and magta-try kumuha nung kung ano man of value while the driver is busy closing the passenger door.

June 22nd, 2010 05:49 PM #20makes sense.
:batman: :swear:
Buhay na buhay ang BGC this evening. Bukas halos lahat ng restaurants. Sabi pa nung isang cashier...
Traffic!
