Help... Need Your Advise

Mga Peeps,
Papunta kami ng Clark ng Nob 30 galing Baguio, sa parte ng San Manuel, Tarlac merong batang biglang tumakbo sa pagtawid... biglang iwas nung driver ko pero nahagip pa rin siya ng side mirror at dahil sa pag-iwas pati yung tricycle na nakaparada sa tabi ay nadamay.
1.) Itinakbo namin yung bata sa Ospital ng Villasis, Pangasinan for full and thorough check up for 2-days (CT scan included). Thank God she's OK. Tanong ni esmi sa bata nung conscious na at pwedeng ng lumakad bakit tumakbo siya, "sagot ay... akala ko auntie malayo pa kayo". Case settled with the parents.
2.) Yung tricycle sa tabi... ang driver nagpapahinga sa loob. Sa prisinto na nakausap ni esmi, tapos ayaw magpa-check up o magpa-confine...

Bigay si esmi ng 5K at pumirma siya ng kasulatan (saksi ang police chief sa agreement) na hindi na raw kailangan magpa confine o check up na kasama si esmi at lahat ng resibo ay ibigay niya pagkatapos niyang magpa check up ng sarili. Lahat ng findings ay normal, mga 2k+ lang nagastos niya di na kinuha ni esmi yung sukli.
>>> yung tricycle niya ay kailangan ipagawa... pina estimate yung damage mga 10k daw, pero ginawa ni esmi ay tinawag ang kuya ko (may alam ng konti sa motor) siya na lang nag-ayos at pinalitan lahat ang sira pero yung kailangan na ayusin sa side car ay sa welding shop na.

Heto ngayon ang problema... nung bumalik na sina esmi para iuwi yung sasakyan namin, ayaw payagan ipa-release nung tricycle driver. humihingi ng 50k kundi daw magbibigay ay magdedemanda. Ang Police Chief na ang kumausap sa driver pero ayaw pa rin... tapos sabi nung Hepe, pabayaan mo na siyang magdemanda. Bago naka-alis sina esmi ay meron inabot ng driver na 8 pages na sulat galing sa kanya at yung hinihingi daw na 50k ay tulong na raw namin dahil daw meron siyang sakit sa bato??? Insurance na ang kausap nitong diver sa ngayon. Pero panay pa rin ang text ni mamang driver kay esmi at medyo naiirita na. Ano ba ang pinaka magandang gawin para tumigil na itong "luko-lukong" driver.

Pasensya na kung medyo mahaba at magulo ang aking paglalahad. BTW, am going back to Malaysia at that time kaya nag commute na lang ako at di ko nasamahan si kumander sa pag-ayos ng problema.

gumusut, sorry to hear about your problem.

from a legal perspective, when the driver swerved to avoid the child, he was justified in hitting the tricycle because this caused less harm (though it may have been unintended), hence at least you know there's no criminal liability but only civil liablity for the damage.

on this point, i take it you have already restored the tricycle to its original state by fixing it. hence wala ng ihahabol yung tricycle driver dahal kung ano mang damage sa kanya, indemnified na siya. mag file man siya ng kaso, wala na siyang mahahabol.

parang naghahanap lang ng balato yung kumag. you can take the active route and deny his claims in some way (lawyer's letter, harsh text) or just have your wife and driver change their telephone numbers. good luck.

panggagantso na ang ginagawa ng tricycle driver...palitan na lang ninyo ang SIM ng cellphone para hindi na niya maistorbo si esmi mo.

me sakit daw siya sa "bato" ? me sakit nga sa bato -"batugan" - at gustong magkaroon ng easy money na hindi niya pinaghirapan.

Hindi na rin reasonable yung ginagawa nung mamang driver. Alam niya na willing kang magpabayad kahit magkano kaya sinamantala na niya. Sorry to say this pero may hangganan din naman ang kaya mong i extend na tulong sa kanila. Yung hinihingi niya para sa sakit nya pero bakit naman ayaw pang ipa release sasakyan mo at mukhang iipitin ka pa ata. It was unfortunate that it happened pero accidente naman yan na walang me gusto. If I were you, bigyan mo na lang yung kaya mo at sa tingin mo eh reasonable. Or hayaan mo na lang siyang magfile ng kaso.. anyway, matatagalan naman yan kung sakali at makapag isip isip na rin yung mamang driver kung tama nga ginagawa niya o hindi. Do not be blackmailed into giving in to something which you know is not fair and just to both sides. Hindi biro ang 50k. Puwede naman siyang (mamang driver ng tricycle) tulungan in another way basta madali siyang kausap, hindi po ba?

yung nga sabi ni esmi, napakalayo naman yung sakit niya sa bato sa aksidente!
yun din ang sabi ko kay kumander na palitan na lang yung sim niya dahil pati yung abugado raw ni kulukoy ay tumatawag din sa kanya.

get a lawyer to write you a letter, stating the facts, etc. etc.

to everyone: when you give money to pay off damages, get them to sign a notarized letter (what was that called again? a quit and something something).

so when they go back to get "extra" money. send them the letter they signed together with a letter from your lawyer.

that'll shut them up.

Mga tao nga naman... mananamantala na! Sinasamantala nya kase nagbigay ng pera nuong una. Sa simula pa lang eh obvious na, biruin nyo humingi ng pera at nde nagpadala sa ospital. Nung napansin siguro na nagbigay eh nagisip ang mokong na ito kung paano pa makakagantso. hayy grabe.

When a motorcycle hit our car (naka full stop yung kotse namin ha) ganyan den drama sana nung magasawa sa motorsiklo. Okay daw sila at ayaw mag pa check up pera na lang siguro. My mother insisted na magpacheck up sila na kasama sha. She didn't give them any money. You can't trust people to be honest these days. kung may pagkakataong makagantso, mang gagantso talaga.

it's called a quitclaim. and sana nga may nagawa kayong ganito.

gumusut, by the fact the tricycle driver has acquired a lawyer, it would seem he intends to escalate his actions. this could get messy.

by law, i know you're not liable, but if he does file a case, whether criminal or civil, you can just imagine the hassle of having to attend hearings in pangasinan. at this point, i would not recommend ignoring the lawyer and suggest you communicate with them to at least to get an idea of their intentions.

but it's a good thing you were insured. since ultimately, they will be the ones to pay, they have a legal interest in the matter and they should assist you.
