Closed Van rear ended my ride. Need advise sana..

Sir mods, pakilipat na lang po if this is not right forum.

This happened last Sunday along Ortigas in fronting Robinson's Galleria

Naka stop na ako pati yung dalawang sasakyan sa harapan ko ng matagal dahil may tumatawid na pedestrian. Nakita ko pa sa rear view mirror ko yung padating na van - derecho salpok. Rason ng driver eh nawalan ng preno.

Puno ng Audio Equipment yung van kaya siguro sa bigat eh hindi kinaya yung preno.

Base sa police report, yung van ang nag cause ng damage sa vehicles.

Inako naman nung may ari (sa Cellphone) na sagutin yung paayos. Kaya maayos naman usapan namin nung Sunday. May pinapunta pa siya na latero para assess situation at ang sabi ay palit halos lahat ng nasira. Sa akin OK lang kahit surplus basta mabalik sa dati. Na-tow yung MPV at dinala sa Ziebart for repair estimate.

Dahil alam ko na rin naman ang damage eh nag-canvass na ko sa suking surplus store sa Banawe nung Monday. na-email ko rin dun sa naka bangga pati yung repair estimate ng Ziebart.

Magka canvass pa rin daw siya sa Banawe. Eto po ang problema ko. Last Wednesday follow up ako eh Busy raw siya sa business nila at on-going pa canvass. Kahapon tinawagan ko at text pero wala na reply. Today ay tauhan niya kausap ko sa cellphone niya at busy raw boss niya. Tawagan daw ako after 5 minutes. Pero di tumawag kaya after 30 minutes, tinawagan ko yun cellphone - cannot be reached na.

Yung MPV ay hindi pa rin nagagalaw. Hanggang kailan kaya ako maghihintay? Laking perwisyo kasi ito lang ang ride ko. BTW, TPL po ang insurance nito pati dun sa nakabangga

Any advise on how to proceed?

Did you get the business name, landline phone number and address?

You might want to bring the documents stating the estimated cost of repairs, photocopy of the police report and talk to him directly at his office.

yup police report lang katapat nyan kapag di nakipag ka sundo sampahan mo ng kaso mas malaki pa babayaran nyan.

kaya importante na after ng banggaan eh pagawa kayo kaagad ng police report at papirmahan mo para meron ka laban dahil kung wala ito eh goodbye ikaw lahat sasagot sa gastusin ng sasakyan mo.

I got the business name and telephone landline number. The address I just got from internet.

I e-mailed him already of the parts canvass and estimated cost of labor/ repair. But you are right. Better to talk to him at his office.

Paano sir kung ayaw humarap. sabihin wala o busy, just in case.

Una kong napansin yung projectors mo. Sayang yan, buti nalang at hindi nabasag yung projector mismo.

Anyways kung alam mo ang lugar kung nasaan siya, go straight directly to his office at ibombard mo ng ibombard ng mga questions, claims etc.

And yes, kapag hindi niya tinupad yung usapan bring it to the next step. Sue him.

If he is "too busy", prepare to go "legal".

Include the cost of the repair, cost of psychological trauma, & cost of lawyer fees.

Have those documents sent by LBC or similar.

meron naman sir na police report.
kung wala talaga choice eh sampahan ko na lang ng kaso.
