    Tanong ko lang kung meron na dito na pinatigil ng pulis para i-check ang loob ng oto at kapkapan ang driver at mga sakay nito.

    Last night, while we were on our way to San Juan, we took the 3rd St. in New Manila. We saw two taxis being searched by QC policemen & what's more disturbing is one man was being bodily searched.

    When we were on our way home naman, right in the intersection of Edsa & Ortigas Ave (Galleria). The car right beside us was flagged down by an MMDA traffic enforcer. He asked the guy driving the H.Accord to park his car right at the middle of EDSA (this is the area near their outpost). Along with that car, there were about 3 other cars being searched by MMDA t.enforcers. One was even checking the gym bag in the trunk of one Nissan Sentra.

    What's bothering me is, LEGAL po ba ang ganong ops? Considering it's not a check-point area. Di ba kailangan ng search warrant? Are MMDA t.enforcers allowed to do such search?

    AFAIK they would need a search warrant.

    yup kelangan ng search warrant yun unless you waive your right and you say yes you can search my ride.. but you can always say no to them and if they still checked your car then you can sue them for tresspassing maybe? violation of privacy,illegal search and too ugly for being a police officer kung police nga sila

    yes. i agree, there should be search warrant, or they can file a formal complaint to the apprehending officer. unless, they are being caught in the act of doing something against the law (i.e. being suspected of illegal activities, entrapment operations, etc).

    bro -- nag post na ako ng rules of engagement ng police with respect to checkpoints sa wang wang thread

    (mga mods -- suggestion lang po: why not open a new thread on checkpoints para alam ng lahat)

    unless hot pursuit yun, hindi lang basta basta mag establish ng checkpoints ang mga pulis

    kung nag mamaneho ka at bigla ka lang pinara and its not a properly set up checkpoint, you can refuse to allow them to serach without the necessary warrants.

    of course, ingat lang mga bro. when people with guns stop you, manatili pa rin ang patience, diskarte and most of all, wisdom.

    ako biktima ng ganyan, nangyari sa roxas boulevard kanto ng kalaw. it helps din if u have a number of a lawyer para dial agad kung mapilit pulis mag search ng kotse. its illegal for them to search your vehicle without a search warrant. pwede search pero dapat visual inspection lang through the windows lang and pag may nakita sila sumthing illegal (in plain sight) dun ka na dapat mag-comply if pinapabuksan sayo kotse for searching.
    ako noon, mahina loob ko kc wala ako number ng lawyer and ayoko ma-agitate pulis kaya sunod agad ako nung pinababa ako ng kotse.

    bro -- we now in the process of forming a tsikot law group. puede naming pag-uusapan ito at kung sino sino sa mga tsikot law members gusto makibahagi at magbigay ng numero nila para maging serbisyo sa kapwa tsikoteers

    This is indeed a good move, sir. I hope your plans will push through. Just like what boy torotot suggested, I think I have to get a printout re:rules of engagement. Sa dami ng mga abusado na cops ngayon, particularly in the QC area. Kawawa kaming mga walang mga contacts na katatakutan nila.

    Nope. It was a H. Accord '96mdl. Funny thing was, at random lang ang pagpili ng pipapatigil nila.

    i second the motion... good move nga yan sir prez regarding tsikot law group. at least magkakaroon ang mga tsikoteers ng lakas ng loob umangal pag mali procedures. ma-print nga yong rules of engagement...

    or baka naman.... wala silang plate number sa ride nila.
    uso kasi dito sa edsa-ortigas hanggang C5 ang mga nanghuhuli ng mga vehicles with no plates/tampered plates.
    sana lang isama na nila sa mga "search" nila ang mga naka-motorcyles, kasi ang mga holdaper/snatchers ngayon ay mga naka-motor.

    IMHO, unless armed with a valid search warrant, their (MMDA's) search of your vehicle was illegal.

    Baka bogus na MMDA enforcers yan. If they're the genuine article, I'd write a strongly-worded letter to the Office of the Chairman.

    ano tayo, under martial law? bka pati mga babae ganyanin nila e andami pa namang manyakis na parak...illegal yan

    Palagay ko, ang Rule No.1 para sa ating mga motorista: Huwag makipag-talo sa taong may baril. Kahit wala siyang search warrant, sumunod ka na lang muna.

    1) Isulat/tandaan/i-record sa cellphone ang plate number/body number ng kotse ng parak.

    2) Tanungin mo kung ano ang pangalan ng parak na nag-se-search sayo. Ang legitimate na pulis na ginagawa lamang ang trabaho niya ay masayang sasabihin sayo ang kanyang pangalan, ipakikita ang kanyang badge, at magalang makipag-usap sayo (meron pa bang ganitong pulis?!)

    3) Kunan mo ng patago ang eksena using your camera phone para meron kang ebidensiya na talagang hinarang ka ng pulis (pwede nilang itanggi kasi ito sasabihin nila nasa beer house sila nung ganong oras).

    4) At wag mong kalilimutang tandaan ang kanilang mga mukha o ano mang palatandaan sa kanila.

    5) Kapag ikaw ay nakauwi na (thankfully), saka mo kausapin ang iyong lawyer, o di kaya mag-hain ka ng reklamo sa NBI or sa presinto. At kung wala pa ring hustisya, sulatan mo si Mon Tulfo.

    eto rin dahilan kaya i had to comply..may baril e. ang nakaka-yamot lang sa ganyan, pag sunuran ka palagi mas lalo ka aabusuhin. pwede ka pa lagyan ng droga nyan. basta, if ever nasindak na kayo ng pulis and you have them searched your car, better look at their hand movements din while searching your car. its best talaga if you had a lawyer's number stored sa phone ninyo...hirap na.

    I agree. Never quarrel with a person who is holding a gun. Maaring manalo ka sa debate during an argument, pero kung napikon sayo at binaril ka at natodas ka, bale wala yung pagka-panalo mo sa argument nyo. So just report the incident to the proper authorities.

    OT:

    Napanood nyo ba sa "24 Oras" sa GMA-7 yung incident na merong kotse nahagip ng taxi yung side mirror niya? Lumabas yung machong driver at pinag-sisipa yung taxi in broad daylight. At may hawak pa siyang hand gun sa kanang kamay at short-arm automatic sa kaliwang kamay. Isipin mo, papatay ka ng tao dahil lang sa side mirror. Meron talagang mga driver na utak ipis lalo na pag may hawak na baril. Huwag ka ng makipag-sabayan at bumawi ka na lang sa ibang paraan na legal.

    Kailangan talaga natin ng mga abugado, tulad sa Amerika.
