    Mga Peeps,

    Hingi nmn po ako ng tulong nag park po ako sa isang paid parking area, ng pa uwi na ako nakita ko yung driver side door ko na may malaking dent plus scratches... nag tanong ako sa parking attendant wala daw syang nakita o na pansin na nabanga yung car ko.... Meron po ba ako habol sa parking management kahit alam ko na nakalagay sa ticket nila na wala silang liability kung ano man mangyari sa car mo sa loob ng parking area nila.???!!!

    Ano kya po maganda gawin?

    You shouldn't leave the car-park without at least an incident report or affidavit. You can legally claim that they're liable, as the non-liability clause on the parking ticket constitutes an unsigned contract... in other words, you don't sign on the parking ticket, you don't necessarily agree to the conditions... and according to Philippine law, you cannot sign away your rights anyway.

    For example, even if you sign a contract with a guy permitting him to kill you, he can still be charged with murder... :lol:

    Unfortunately, since you've left the premises without such, your best bet is to go through insurance instead. I doubt the management will accept your claim without a report, and so long after the incident. It's worth a shot, but it's dubious.

    Claim against the parking area owner would not prosper as it was not the one who caused damages to your car but an unknown party. Better claim against your insurance - if you have one.

    Halos lahat ng parking lot business ngayon (kahit paid parking) usually ang policy na is that they are not liable to any damages or theft in/on your car. Parang "park-at-your-own-risk" or "pasalamat-ka-meron-ka-pang-naparkingan-dito" policy.

    Saka kung iisipin mo rin, pag pumasok ka sa parking lot nila, they don't inspect your car if you came in with a damaged or scratched door already. Kaya kung ikaw rin mismo yung may-ari nung parking lot, malay mo ba kung dati ng merong scratch at dents yung pinto niya at gusto ka lang kwartahan. Diba 'pre.

    So malamang insurance na lang pag-asa mo pards. Good luck! Ma-karma sana yung mga ungas na yun na dumale sa tsikot mo.

    haay naku, dami talagang taong irresponsible... ako dati nadale sa simbahan pa... di manlang nag iwan ng contact info, kasisimba pa naman

    malamang nga po insurance na ang pagbabalingan ko... hay.... actually sa ortigas area na dali yung car ko... halos professional mga tao dito!!! sa damit lng pala... they don't even bother leave any contact number... as if prang walang ngyari.... wish ko nlng eh mangyari din sa kanila ng mas malaki pa ang damage... hay uli!!!

    ingat na ingat ka sa mga sasakyan katabi mo pero sila walang paki alam...

    lahat ng damage na tamo ng car ko puro sa parking area... nakaka inis tlga...!!!

    sawa na rin ako dyan. tignan nyo yung rear window pillars ng oto ko, parehong may small dents. tingin ko lang dyan sa mga driver/passengers ng mga ganyang sasakayan eh low life scumbags...
    tsaka ko na lang papaayos...

    tsktsk... yan ung mga passengers/kids na wla pakelam mag bukas ng door! hehe! nayari narin ung frend ko nyan pero dun nmn sa condo nila. mga bata na sinisipa pinto pra bumukas sabay hampas sa car mo!!

    kya ako as much as possible park ako mlapit nlg sa wall/post pra iwas sa ktabing car..

    Usually the carpark ticket has a fine print disclaimer saying that they are not liable for any damage or loss. So the fact that you accepted the ticket and agreed to park in their place, eh di na daw nila problema.

    But then, there are some senators / mayors who want this practice abolished. The last I heard regarding this was a year ago. Siguro nagiingay lang sa mga mall para bigyan sila ng 'contribution' para tumahimik hehehe...

    Mahirap mag-negosyo ng parking lot pag ganyan ang nangyari 'pre. Isipin mo, meron lang isang mag-claim ng damage, limas kagad isang linggo mong kita. Hehe. Dapat lahat ng papasok sa parking lot pi-pik-churan lahat ng sides, isusulat lahat ng location ng gasgas, tataas ang parking fee kasi dagdag security guards or surveillance camera. Hassle. Malamang baka sa dami ng mag-ke-claim ng damages, pambayad pa ng attorney kung magka-demandahan, mukhang magsasara na lang yung parking lot hehe.
