    Guy tulong naman... kunwari bumili ka ng car sa isang buy and sell agent tpos nadiscover mo after 6 months that the car was not the said car, ano ang pwedeng remedy dito?

    kunwari inoffer ka ng agent ng Toyota Altis 1.6E pero sa totoo pala ay Toyota 1.6J lng yun, and nadiscover mo ito after 6 months nung dinala mo na sa casa na mali yng car na nabenta sayo dahil you believed that the said car was a Altis 1.6E. May habol ka pa ba dito? What if pinaggastusan mo na din yng car?(like registration, repairs) Can you still recover the money spent with damages?

    if it's stated in the deed of sale na Altis "E" yung binili mo tapos "J" pala yan, i think may habol ka pa. pero kung verbal lang na sinabi sayo na "E" yan at 6 months na ang nakaraan, malabo na siguro yun.

    anyway, kausapin mo na lang yung binilhan mo at baka makabawi ka pa kahit konti...

    Ibig mo bang sabihin may airbag yan kaya napag-kamalang E?

    O pinalitan ang manibela para kunyari may airbag? Lupit naman nun.

    Raikonen is right. Look at the documents you signed: The deed of sale specifically. Kung wala naka indicate dun na E nga yan ay wala ka ng habol dyan. It will be your word against his. Pwede mo takutin by having your lawyer send him a notice.

    The difference between E and J AFAIK is that the E comes with driver side airbag, ABS, the door handle is body colored and the aircon is digital type with climate control.

    Thanks guys! Yes, it is stated in the deed of sale that the model is E and not J. Guy ano ba ang unang process dito? Pano yng mga nagastos ko na?

    yes. in this case there is infirmity in the element of consent in the contract due to this mistake or fraud. in this case, this is a voidable contract. what was agreed upon (of course you have to prove this either through documentary or testimonial evidences) was not delivered.

    assuming that the deed of sale did not indicate the particular letter of the model, this will not defeat your cause of action. you can still prove that you discussed a particular model through other evidences

    and you can recover your money back plus damages

    pa-certify mo muna sa casa na "J" talaga ang kotse at hindi "E".. tapos kausapin mo yung agent na pinagbilhan mo... kung wala pa din mangyari, padalhan mo notice galing sa abogado... pag wala pa din.. kasuhan mo na...

    try to talk to the buy and sell na lang, keep the car hingi ka na lang ng discount. cheaper yata ang J kaysa E.

    kung pwede ito, mas magandang option siguro ito... kung willing ka... kasi malaki na talaga nagastos mo sa car mo... para atleast manlang, maibalik ang difference na binayad mo for a "E" class na altis pero binigay ay "J". pero kung di pwede, kasuhan mo na lang...
