correct, let the the party at fault to shoulder your participation and deductible.
With my insurance company, they let me pay up the participation and deductible first but return it to me once the insurance of the other party settles.

may nabasa akong thread na kinasuhan ng insurance agency yung insuree kasi di na nila mahabol yung nakabanggaan.
may document yung nakabanggaan na di na maghahabol yung insuree sa kanya dahil sya na ang nagbayad ng participation fee.

Which insurance is this? Bpi ms said that if i choose to claim against them, i have to pay the deductible aand wont be reimbursed. The other option they said is to claim against the other insurance for third party property damage but I will have to be the one to process the claim against the other insurance. I find this absurd since kaya nga tayo kumuha ng insurance para di ma hassle e. Kaya i am looking for an insurance that would either do the third party claim on mu behalf or at least waive the deductible and let them cover the damages since they would chase the other insurance for sure to claim for whatever expense they incurred.

Why don't you just file a claim on whoever damaged your vehicle?
Hindi naman siguro masalimuot ang claim ninyo?
If they have insurance, you wont pay participation.
Your present insurer should be able to guide you on this.
Your servicing agent should be able to guide you on your claim.
There is no guarantee that your next accident will involve another covered vehicle,
so no underwriter will assume a future loss as recoverable.

Kasi naman kasalanan nya na pirma sya ng pirma sa hindi nya naiintidihan.
Ang dapat kasi dalawa lang kayo ng insurer mo ang nag uusap. Kayo lang naman ang may kasunduan,
so bakit may kinakausap pa sya na iba.
Kahit ikaw hindi ka papayag. Pababayaran mo sa kakilala mo ang magiging lugi mo pero
hindi sila puede makialam kung kanino ka magpapalugi.
Hindi tama hindi ba?

This is very true, if there is an agreement between you and the party at fault better make it in written form. For example both partues agreed at the party at fault will shoulder the participation and detuctible, its better in black and white siya na hanggang doon lang sinagod ng other party para sa ganon may habol pa rin yun insurance in claiming the damaging balance of the damage done due to the accident.
Our entire clan is being handled by one agent and single insurance company kaya mabilis kausap and flexible. Aslong they feel na tama lang yun request namin, they always make amends to their company policy.
Claiming as third party is a fustrating process plus 100% hindi ka magiging satisfied. As third party, titipirin ka g insurance company. No brand new parts policy yan, neither surplus or reconditioned(gawang pampanga) or worst repair lang talaga. Dealt with insurance before, all of them have the same policy with regards to third party claim.
