    Just now naka receive ako ng letter from my insurance company UCPB GEN asking me to reimburse the amount they have spent sa pag repair ng car ko when i got to an accident and filed a claim earlier this year which was 6 months ago. Their reason is humingi daw ako ng settlement sa adverse party na nakabanga sakin without letting then know, and now they have loss their chance para marecover ung nagastos nila by charging it from the taxi company na may hawak ng taxi na nakabanga sakin. The truth is, humingi talga ako ng ng settlement pero ndi para sa pag repair ng car, para lang pambayad sa participation fee which is around 4k and I also signed a document from the taxi company that hindi na ko hihingi pa ng further settlement aside from that. This is my first time sa ganitong situation thats why i didnt know what to do, so ngayon the letter is asking me to pay around 15k, I think thats the amount they spent to repair my car when I filed the claim. If sakaling iignore ko daw ung letter/demand nila, they will explore other legal remedies. Now I believe mali nga ung ginawa ko na humingi ako ng settlement sa adverse party without them knowing it nakalagay rin kasi sa policy na every letter/correspondence with the adverse party dapat may copy sila. Gusto ko lang naman malaman thats why I post this in this forum kung may laban pa ko dito or do I have no choice but to pay? Ang sakin lang, pambayad sa participation fee lang naman ang hiningi ko, wala akong binulsang pera from the incident.

    after the repair.. hiningan ka ba nang participation nang insurance?? dapat kasi wala ka nang binayarang participation kung napatunayang ang may kasalanan yung taxi.. sila na maghahabol don sa taxi..

    ano ang wordings ng settlement agreement mo with the taxi company?

    kung malinaw doon na ang settlement ay para lang sa participation fee mo and without prejudice sa habol ng insurance company, may lusot ka pa

    if the wordings are a comprehensive and final settlement of the issue/accident, medyo delikado posisyon mo at naisahan ka ng taxi company na yan

    *Qwerty yep hininga pa ko ng participation fee which is siningil ko pa from the taxi company.
    *prez - hindi ko kasi talga alam na hahabulin pa sya ng insurance company, akala ko they all care about the police report and participation fee. Wala akong copy nung agreement with the taxi company, ang naalala ko lang stated there is no further settlements akong hahabulin after that. But really ung participation fee ko lang talga ang sinigil ko sa kanila.

    try to talk to the insurance.. tell them na participation lang yung kinuha mo.. di ka naman humingi nang settlement..

    *Qwerty - un nga rin ang plano ko sir, but im trying to hear other opinions as well para meron akong PLAN B in case insurance company insists. thank you sir sa suggestion, it is greatly appreciated

    Your problem started when you did not have your own servicing agent. Your policy is not compliant.
    Kaya tira ka ng tira.

    You did not even have to pay participation. You only have to use the network of service providers
    of the insurance co covering for the taxi co. if they are properly insured.

    Huwag kayo makikinig sa kwentong barbero na you dont need servicing agents.
    Always have a servicing agent for your insurance policy, you already paid for it.

    You violated your contract. It will make it more expensive to recover for your insurer.
    If they can recover.

    Try mo makiusap. But the problem is ano nga ba ang pinirmahan mo?
    Were you with your counsel when you signed?

    Hindi sya naisahan, the taxi co. representatives only exercised due diligence on the matter and hindi masama ito.

    Ang pinirmhan ko sir is a document they made na hindi na ko hihingi ng further settlements from them once I received the 4290 na ginamit ko lang naman para sa participation fee, and walang counsel when I signed that cause im not even aware that time kung anong dapat gawin. Akala ko I just have to file the claim and provide the participation fee then ok na. Ung servicing agent ba dapat ang mag aasist sakin during this incident? Nakausap ko lang sila nung finafile ko ung claim other than that wala na kong nakausap or anyone na kumontak sakin.

    Hmm. Dapat nga kinausap mo muna service agent mo from UCPB... Sila kasi maghahabol nun sa taxi company para yung taxi company magbayad sa repairs...

    Kung ganun naman na participation fee ang hiningi mo, dapat yung report na binigay mo sa insurance company is hit and run. para walang hahabulin si insurance company... try mo na lang kausapin sales agent mo from UCPB kung ano ba dapat gawin...
