    Question po sa deed of sale:

    a. Since foreigner ang bibilhan ko ng car, pwede bang passport number na lang instead of CTC?
    b. Short bond paper lang ho ba ang CTC kung ako mismo gagawa? Sa National kasi meron pero handwritten ang important info so I didn't buy it pero napansin ko, nakaprint sa long bond paper.
    c. Yearly ang car registration, correct?

    Hi newbie here but so far the threads have been very informative...

    Would anyone know of updated rates for TMG/HPG clearance in Pasig? Am thinking of going there since it is the closest to me but I feel that P1250 is a bit too much especially kung 300 lang ang receipt ng payment sa Landbank like they say.

    I hope someone can advise me, ako na yung third owner ng sasakyan, and I'm planning to have the car painted and the color changed. Should I transfer the ownership to my name first before having the color changed? Naka-open deed of sale lang kasi yung sasakyan ko, and common sense dictates na ipatransfer ko muna sa pangalan ko before ko gastusan yung sasakyan hehe.

    yes po. follow your common sense.
    i wouldn't spend big bucks on my car if it wasn't registered to my name. and changing the color would conceivably make it only the more difficult to transfer ownership or to sell it..
    yes, in theory, it's possible to have a car registered to you after a long chain of buyers, for as long as you have all the original deeds of sale..

    I just want to share my experience so others can benefit from it just in case they find themselves in a similar situation.

    This of course assumes you are buying a used vehicle...

    In case the seller presents you a CR that still shows ENCUMBERED, make sure that they include the Release of Chattel Mortgage document issued by the bank. This should also include the OR and signature/stamp from the Registry of Deeds (RoD) which confirms that the cancellation of chattel mortgage has already been completed.

    If you don't have the above, request the seller to accomplish this as a prerequisite for the sale. If they don't want to, walk away from the deal. But if you really want to buy the vehicle and are willing to process the papers yourself, make sure that the seller provides you the two original Release of Chattel Mortgage documents issued by the lending bank. It has to be the original or a certified true copy (issued by the bank). If the seller is not able to provide this, walk away from the deal. You'll find yourself in unnecessary trouble unless you are satisfied with the CR remaining as is (encumbered and registered under the first owner). Btw, also ask for the Promisory Note/Chattel Mortgage (PN/CM) document (original or CTC) as the RoD might ask for this as well. This is issued by the bank as well.

    I had an unfortunate experience where I was given only one copy of the Release of Chattel Mortgage (RCM) document and an encumbered CR. In my naivety, I thought that was sufficient. When I went to the RoD, they asked for the second copy. That's where my problems started. I asked the seller (who is already the second owner) if he had another copy of the RCM doc, of which he said he didn't. I called the bank and they said they will only honor a request for a certified true copy if it came from the original owner. Just getting hold of the right person at the bank who could help you out is already challenging. So, I had to get hold of the original owner, luckily the copy of their ID had a contact number and it was still valid. I talked to the owner, requested them to sign an authorization/request form that I will submit to the bank. Luckily, the original owner and the bank contact was cooperative and helpful. But I had to do everything so that all the owner had to do was sign the doc. I created the doc, went to their office to meet them to have them sign the auth/request letter, etc. You have to make it pain-free for them so you can at least get their cooperation. After almost a month and a half of constant follow-up and legwork, I was able to complete the change of ownership and registration of the used vehicle I bought. It was important to me for the CR to be transferred under my name so I will not have difficulty selling the vehicle in the future.

    Other reminders: Make sure you have all the required Deed of Sale documents (2 sets in case you're the 3rd owner, originals & notarized), photocopies of the IDs of all past owners with original specimen signature (not photocopy); 2 valid IDs to be sure. If agreeable to the seller, only complete your payment once you get the PNP-TMG clearance or if they are able to present one to you. You can pay them earnest money first, then request to bring the car to PNP-TMG. Once cleared, pay the remainder of your balance. As advised as well on this post, keep a photocopy of the PNP-TMG clearance for future use, in case you will sell the vehicle. At least you'll have something to show to potential buyers to prove that the vehicle has legitimate ownership.

    average time of procedure : 3 hours. can be lower. na late kasi yung chief ng tmg sa patts last wednesday eh. baka na traffic sa baclaran.

    registration with change of ownership procedure (should be done at lto branch where vehicle is previously registered, in my case, i went from tmg-pasay to manila south, which is lampas ng pedro gil, manila - san marcelino corner nakpil street)

    a) have your car stencilled (again)
    b) have your insurance (tpl) certificate validated
    c) submit documents, including receipts of landbank (for clearance), smoke emission certificate, yung tmg request for clearance tsaka yung actual clearance. syempre, it should include the deed of sale and yung old or/cr.
    d) after being found in order, ilalabas ng lto yung old vehicle file. ivavalidate yun ng inspector.
    e) after validation, papers will be processed.
    f) just wait until name is called sa cashier.
    g) after name is called, pay cashier
    h) wait for the new CR to be released
    i) get stickers.

    average time of procedure (alang lagay): 2.5 hours.

    boss! bagong member lang po ako.. Tanong ko po sana kung anong requirements kapag benenta ko ung sasakyan ng father ko.. ung father ko 1 year deceased na..Ok lan po ba na deed of sale sign by my mother kahit na naka register sa father k ung car? ok lang din b na attached k ung dead certificate nya?thanks..

    Short answer: NO.

    Haba ng process ng change ownership ng deceased owner. Haba paperworks tapos kailangan ipublish sa dyaryo na may nagcclaim ng kotse.

    After paying all the necessary and taxes and publishing the notice sa dyaryo, thats the only time pwede transfer.

    Or... gawa ka deed of sale. Pagawa mo sa kakilala mo na notaryo. transfer mo muna sayo yung kotse. Then kapag natransfer na, tsaka mo benta.
