    May violation ako "Passing thru red light" around 3am because of an emergency pero ayko na ijustify alam kong may mali ako. Hiningan ko ng Mission Order, deputation order or time sheet para malaman ko ang area of responsibility, time of duty dahil nga 3AM na at official function walang maipakita nasa opisina daw. Pinagtulungan ako ng 5 enforcers hingin ang license ko pero pinakita ko lang at hindi ko sinurrender. Di pa nakuntento nag tawag pa ng pulis tapos dinala pa ako sa police station at threathening ng arrest nag display pa ng posas.
    Nagpatiket nalang ako nong nasa police station na ako dahil hindi ko na alam kung posible ngang maaresto sa ganitong sitwasyon?

    Naka file na ako ng adjudication at malapit na ang hearing.
    Any thoughts or insight na posibleng makatulong sa akin?

    As a general rule they can't arrest you unless you committed a crime or assaulted them when they apprehended you.

    If we go by your narration of events I think they violated some protocols when apprehending a traffic violator.

    Like only one officer should be talking to you and not gang up on you.

    Hindi mo ba agad pinakita license mo? Bat umabot sa natawag sila ng 5 enforcers? Hindi naman magkakaroon ng time magtawag yun pag binigay mo agad, nagpaticket ka na lang.

    Nawala saysay ang emergency mo, at tumagal ka pa sa precinto.

    Walang excuse yun nag beat ng red light...even nga mga Emergency Vehicle they are bound to obey traffic lights unless guided by an enforcer. Dapat syo kulungan..kse pwede ka makadisgrasya or makamatay.....petty issue nga lang yan License confiscation mo. Sa ibang bansa, outright kalaboso ka sa ganyan case. Wow naman, tapos hihingi ka ng advice ditto sa thread? haha...

    if it's a real emergency, just say so.
    no decent traffic enforcer will harrass you. baka nga, i-escort ka pa.

    now, about your case...
    just tell the truth.
    do not be emotional in there.
    are you entitled to a lawyer? if so, get one.

    Ano ba yung rule na bawal mang gang up and dapat may mission order? is it for MMDA only?

    Ang nagiging leeway kasi nila is, may kanya kanyang city ordinance when it comes to handling traffic violations/violators.

    Sa ibang city pwede sila mang confiscate ng license yung iba hindi pwede, ano ba talaga.

    You have a solid, provable violation and refuse to surrender license so now you're at an impasse with the enforcers. They call the actual police, who now have grounds to suspect you (because you're not cooperating with the enforcers).

    If it's really a legit emergency why not just say so? If your 'emergency' is questionable then just give your license and take the violation to avoid the hassle. Getting a record on your license is way better than getting one with the police.

    Tone down your arrogance, you broke the law. Jyst admit you made a mistake. In law enforcement, there is something called "briefed and released" mostly dependent on the attitude of the apprehendee if there is no harm done or danger of life or property. If you have the bslls to break the law, have the balls to accept consequences.

    saang lugal yan na may limang enforcer at may mga pulis pa, at 3 am in the wee morning?

    Get a lawyer, plea guilty and pay the fines. Case hearing is a pain and you don't want to do it more than once. It will affect your work, your personal life and your mama's bp will shoot up even more.

    Dapat nag pa ticket ka na lang. Alam mo naman din may violation ka, Tapos sabay alis. Edi Parehas pa sa inyong walang na abala sana,

    Minsan yung mga yan nasa pakikipag usap din. Lalo na ramdam nila nag papakumbaba ka kahit may violation ka minsan pagbibigyan ka ng mga iyan.[emoji846]

    Somethings fishy, you said may emergency ka right, to justify yung beating the red light mo? How come nag wawaste ka pa ng time to argue sa enforcers? Why not just let them issue you a ticket and contest it later on, magkakaron ka naman ng medical records to prove it. You have the right to do this. Umabot pa kayo sa antayin mga police officers vs emergency justification mo.

    Good thing may mga enforcers pa rin ng ganyang oras, I always see drivers not following traffic light on wee hours coz "wala namang bantay". Sana hindi ka tulad ng mga to at legit yang emergency mo.

    Since emergency naman justification mo, just contest it. Wag mo ipilit yung pwde ka ba hulihin, coz mali ka naman din talaga. Contestable yan if emergency, show them papers, tapos problema.

    So, I think parang ganun din yung nangyari.

    Pero since hindi ka naging cooperative and defensive, lalo pa tuloy lumala yung kaso na umabot na pinapulis/blotter ka.
    This I think is reasonable, they suspected that something is not normal besides the violation so they decided to pursue in a group. With the argument contesting their authority, they asked for the assistance of the police.

    The problem now is, as pointed out by *Sebastian Bach , how to prove that it is/was an emergency considering that he wasted his time to argue and even went to the police station.

    This is true. I was just recently flagged down in Edsa because I was inside the yellow lane. When I spoke to the officer, I said sorry, & that I was wrong. I was about to give my license, he just waved me to go.

    Makipag settle na lang sir ng maayos with the assistance of a lawyer para wala ka ma overlooked. . Mas mahal ang time and stress pag makipag matigasan pa.

    i remember, many years ago.
    makati uniformed traffic person flagged me down, "for on the spot emissions test".
    i got a look at his ID on his chest, and noticed, "sir, expired na ID ninyo. ayokong makipag-usap sa un-authorized person". and away i drove, before he got a chance to say anything.

    I think only mmda doesn't confiscate license. City police or enforcers deputized by the mayor do confiscate licenses. Why? Because a percentage of the fine goes to the ticket issuing enforcer and cities are not centralized. Cities want u to claim and pay fine. U can escape that if license returned to u and u just throw away the ticket. So ano katibayan, right? Pero may loophole pa rin. Ex. Pwede ka mag loss license sa qc pero nahuli ka sa manila.

    Your arrogance made a bigger problem. Instead of cooperating by surrendering your license you argued and asked for their "mission order". So what if it is 3am? And so what if they are not assigned to that intersection? Ordinary citizens can make citizens' arrest, why not traffic deputies in uniform and on duty if they actually saw you commiting the violation? WTF were you trying to do? Serves you right if they file charges against you and cancel your driving license. For me your canceled license will be one less a$$hole on the road.
