    galit lang naman sa MMDA yun mga bus driver and jeepney driver na lagi lumalabag sa batas. kung bubuksan lang natin ng malawak na pagiisip at papansinin marami naman sila ginawa na para sa pedestrian, public utility and private vehicle. lahat tayo nakikinabang sa lahat nila project. marami ng dumaan na chairman ng MMDA may naiwan ba sa atin na alala na naging project nila?

    maybe technically, the MMDA has no power to apprehend or whatever,...

    but then again, i think that it's only right that the MMDA be given that power (to apprehend). kung hindi MMDA, e sino? mga LGU? sobrang labo nun, magiging sobrang inconsistent yung mga rules and regulations sa daan between cities in the metro.

    imo, mabuti na yung merong isang authority across the whole metropolis, para standard and enforcement

    hhmm..i'm sure naman me basehang legal kung bakit nandya-an ang mmda..i'm sure din na ang pinagbasehan nila ay yoong mga existing laws sa mga big metropolis sa kung saang-saang panig ng mundo..i'm sure ulit na pag-hinalukay nanaman 'yan ng mga naninirang mga interes kutakotakot na naman ng ingayan 'yan sa media at sa mga pilosopong indibidwal sa ating lipunan..i'm sure pa rin talaga na habang me natitira pang sibilisadong pamamalakad sa metromanila sa pamamagitan ng mmda maghunusdili na lang tayo at patuloy na tangkilikin ang pamamahala ni chairman bayani fernando..

    hindi ko mapigilan banggitin ang isang magandang halintulad na iniwan sa aking alaala kung ano na ang marikina ngayon kumpara noon..

    In fairness to BF, madami din siyang nagawa biling MMDA chairman. The U-Turn slots proved to be effective on several areas. Malalaki lang talaga EGO nila Mayor Binay at Mayor Peewee Trinidad kaya ayaw sundin ang mga patakaran ng MMDA. Ngayon kung walang power ang MMDA ano pa silbi nila?

    so paano nila ma enforce kung hindi sila maka confiscate ng license, Plates o kotse? hehe parang inutil na ata, mag aantay pa sila ng local police para hulihin ka?

    Marami lang talagang against kay Bayani Fernando. Ayaw sa kanya ng Mayors kasi nagmumukha silang inutil when BF goes about doing the work which mayors are PAID (by us) to do. Galit sa kanya ang mga vendors dahil pinapaalis niya ang mga ito to ease congestion and make sidewalks usable. Galit sa kanya mga PUV drivers because he is actually exerting effort to discipline erring drivers.

    Hindi madali ang trabaho ni BF, I'd stick with the work I do now rather than trade places with him.

    Malamang politically motivated na naman ang move na ito.

    Kung malapit lang sa UST ang Marikina, I would really like to live there.

    Dapat talaga may uniform set of rules and regulations, napaka inconsistent kasi, gagawa sila ng ordinance di naman nasusunod sa ibang lugar.

    Bayani shrugs off clipping of MMDA powers

    Metropolitan Manila Development Authority (MMDA) Chairman Bayani Fernando shrugged off yesterday a Supreme Court (SC) ruling which virtually stripped the government agency of its law enforcement powers to manage traffic in the 17 cities and municipalities in the metropolis.

    Since the MMDA no longer confiscates driver’s licenses anyway under its Metropolitan Traffic Ticketing (MTT) system, Fernando said the SC decision was "moot and academic."

    During the Tuesday Club held at the Shangri-La Hotel in Mandaluyong City yesterday, Fernando said the MMDA would continue with its traffic enforcement duties and powers as provided for by its Charter under Republic Act 7924.

    In an 18-page decision, the High Tribunal noted the MMDA has been engaged in "unauthorized exercise of its police power" in confiscating, suspending or revoking drivers’ licenses of traffic violators in the issuance of traffic violation receipts (TVR).

    But until yesterday, Fernando said he has yet to receive an official copy of the SC ruling, penned by associate justice Minita Nazario-Chico, reportedly issued last April 22.

    The MTT itself is also a subject of a suit at the Makati Regional Trial Court which issued a TRO in May last year to temporarily stop MMDA from implementing the scheme.

    But Fernando said the same court did not issue a permanent injunction on the MTT.

    "So we will continue with it (MTT) while this is being resolved by the court," Fernando said.

    Fernando explained the MTT is merely a "notice" of traffic infractions and that traffic violators are given seven days to contest or file protest of their alleged traffic infraction without paying fines while their petitions are being heard by the MMDA.

    For transparency and to deter bribery and corruption of MMDA traffic aides, Fernando said, the fine is paid at any of the 500 branches of the Metropolitan Bank and Trust Company.

    "This is to make it more convenient for motorists and the MMDA as well because confiscating licenses is troublesome," Fernando pointed out.

    "That SC decision may have been taken over by events because we neither issue TVRs nor confiscate licenses under the MTT," Fernando explained.

    Nonetheless, he said the MMDA would seek a clarification of the SC ruling which he admitted has very serious implications on the very existence of this government agency.

    The MMDA chairman said he would ask government lawyers to file a motion for reconsideration.

    Meanwhile, Malacañang defended the MMDA’s powers to enforce traffic rules and regulations.

    Chief Presidential legal Counsel Merceditas Gutierrez said Republic Act 7924, which enumerates the functions and powers of the MMDA.

    In another development, the mayors of Metro Manila are set to meet this week for a formal manifestation of its position urging the MMDA to refund the fines it had collected from erring drivers.

    Metro Mayors League (MML) spokesman and Pasay City Mayor Wenceslao "Peewee" Trinidad said the decision of the SC to strip the MMDA of its power to implement traffic ticketing system was a "long-standing principle, which we mayors have been raising against MMDA."

    Trinidad argued that the legislative power necessary to create an ordinance to implement traffic laws, including confiscation of licenses of erring drivers and collecting fines from them, belongs to the mayors.

    "We have maintained the position that legislation is exclusive to local government units and that the MMDA has no legislative power to implement ticketing system," Trinidad told The STAR in an interview.

    Trinidad stressed the MMDA should have secured an ordinance from the Metro Manila Council, which is composed of all 17 mayors, or a law from Congress before it implemented its projects.

    Among the MMDA programs that do not have supporting ordinances or laws are the Unified Vehicular Volume Reduction Program, Sidewalk Clearing Operations, Organized Bus Route along EDSA, and the Wet Flag Scheme.

    For his part, Manila Mayor Lito Ateinza reminded Fernando that the MMDA’s function is limited to planning.

    "The MMDA should stop using police powers since they do not have it. It is the LGUs that have it," he said.

    galit si peweee kasi mga kababayan nya sa pildera pasay ang binigyan ni BF ng magandang parking and denevelop yun lugar. sya ano na nagawa nya sa pasay basura nga lang di nya mapatino yun pa kaya development ng lugar nya.

    si BINAY dba naupo rin sya sa MMDA may naging pag babago ba sa trapik wala may naiwan ba sa atin magandang project wala dba.

    yes go Bayani. I remember when he became marikina mayor and he did drastic things for the improvement of marikina. lots of people bitched and complained and cursed his decisions. but when they saw the improvements they stopped bitching and started supporting him. and reelected him continously. now the wife is continuing his legacy with his reforms with equal success since she has been again reelected.

    GMA had one order to him. make metro manila like marikina

    Remember when he goes, disipline at edsa etc will go down the toilet and traffic will worsen
    go go go!

    Metro mayors want to take control of traffic in their area but i think it has already been proven that they cannot do this job. They just don't want someone like BF doing what's supposed to be their job and getting praises/curses from it. its no publicity for these mayors. so EGO rin.

    tamo si Binay na ipokrito, dating MMDA pero ala naman magawa nung time nya. kung meron, can we say its more creative than what BF is doing now? palagay ko di rin. or baka naman "money-making" scheme lang ang inaatupag? nagtatanong lang po.

    correct me if im wrong but the local governments only get a part of the amount paid to the MMDA by traffic violators. baka naman these mayors want the whole amount that traffic violators pay. ganid!

    oo marami nga nababangga si BF. pero he should stay the course. most of all, lets help him stay the course by supporting him. HOW? first of all, by following and continuing to follow his traffic rules.

    Si Mayor Atienza, yung mga proyekto niya sa MayniLA puro pan dagdag traffic -> Park conversion ng isang stretch ng Avenida, Baywalk (parking lot na yung isang lane), mga kung ano anong activities during rush hour.

    Seryso si Pewee Trinidad na ipa-balik ng MMDA sa mga motorista yung lahat ng traffic violation fines na na-collect ng MMDA. Question is, kaya ba nilang i-enforce kay BF na ibalik?
