    I certainly don't want to get hit by a lemon but I definitely want a safety net just in case. Stuffs are getting to be real complicated and no matter how extensive a manufacturer tests its products, something's bound to fail somehow, somewhere.

    New Senate bill seeks major changes in the Philippine Lemon Law | Autodeal

    A new senate bill has recently been filed that seeks to put in major changes to the Philippine Lemon Law. Senate Bill 2356 (SB 2356) which substitutes Senate Bill 2064 seeks to make some major amendments to the Republic Act 10642: the Philippine Lemon Law.
    The new bill was filed on August 23, 2021, by Sen Koko Pimentel II. One of the amendments of the new bill seeks to reduce the individual repair attempts on a vehicle before the consumer can available of his or her rights under the law. The bill seeks to reduce this amount from four down to just two instead.
    Another amendment that Senate Bill 2356 seeks to fix is that the dealer/distributor/retailer should provide new parts for the vehicle under repair within 14 days. If they cannot do this, then the consumer can file a complaint with the Department of Trade and Industry (DTI) to avail of their rights. It is important to note that the “days” mentioned are calendar days and not business days.

    Solon wants 'Lemon Law' for used cars | Autoindustriya

    If passed into law in its current form, no used motor vehicle will be sold by a private second-hand dealer to consumers unless accompanied by a written warranty covering the full cost of both parts/labors that will be necessary to repair the defects that impair the use of the said vehicle.

    SC affirms CA ruling to refund or replace purchased car with ‘product imperfection’ – Manila Bulletin

    The Supreme Court (SC) has ruled that dealers of motor vehicles are liable to refund or replace the unit sold to a buyer if the defects complained of and admitted by the seller could not be fixed within the warranty period due to “product imperfection.”.

    That should be a class action suit na pala. The infamous Mazda ka-"toking" rack and pinion.

    Wow 10 years after initial case filing. Good on him for sticking to his guns!

    I wonder how Mazda will comply with the judgement? Will they give him a brand new replacement? full refund?

    yung mga ganyang bagay ay di na dapat pinatatagal.. kasi sa huli, yung consumer ang talo....

    dapat protektado yung buying public eh..

    Full refund would be cheaper. The price we are talking about is 10 years ago, even if we put 6% pa interest until paid upon judgment unless the 6% is from the first time the issue/problem was reported and deemed product malfunction/defect.

    i wouldn't want to risk another issue, were they to give me another of their products.
    heh heh.

    one way to lose costumers, is to not stand behind one's product.

    In this regard, is it now Berjaya *BERMAZ AUTO" that is responsible for restitution and claims of this case? They were only incorporated in 2012 if the about us page is in line with when they acquired Mazda Philippines distribution.

    Our Businesses – Berjaya Philippines Inc.

    Or will it be Ford Philippines? Or whoever was in charge of Mazda Philippines during the time of sale?

    Ano ba ang #1 defense in this country of litigants with unmeritorious causes?

    Even if they eventually win in the end, the plaintiff just winds up with a pyrrhic victory like this.

    This could have happened to anyone here, with any dealer. Ang tanong for all though is, what would you do if this happened to you? Ang sagwa isipin...

    why the 10 % ? because he wasn't able to enjoy the use of the car all that time.
    and the interest clock is ticking still, at an additional 0.834% more for every month after nov 11, 2021.

    somebodys should be made to feel that it does not pay to procrastinate.
