April 10th, 2010 02:01 AM #1my friend just bought a car last monday and now ipit sya sa crame. Heres the situation why ipit sya. Nakabili sya ng 2007 altis ng 400K sa sobrang mura at ganda ng kotse minadali nya ang pagbili. Time for change ownership and macroetching nakitang nakawelding ang chassis number at iba ang body number sa CR.
He tried contacting the seller but ihinaharap lang sa kanya ay lawyer at kung ano anong sablay na documents binibigay sa kanya at ngayon mukhang ayaw na magsolian ng pera. Ngayon iniipit na sya ng mga pulis sa crame at mukhang yun friend ko na ang kakasuhan on the criminal case for having a car with illegal tampering of chassis number and incorrect body number. Palagay namin nabili nya ay na total wreck before at inayos na lang by straightening the chassis and putting in a different motor or firewall para sa body number.
Wala kaming kilala sa crame na may mataas na position para matulungan siya. suggestion ko sa kanya na kumuha na ng lawyer para maidemanda yun seller because he sold the car in bad faith dahil marami palang problema yun car. By suing the seller pwede namin icontest na dapat isoli nya yun perang ibinayad at the grounds that yun binenta ay may illegalities. Kesa ayusin nya yun papeles ng kotse which may deem na mas malabiong magkaroon ng solian ng pera kasi inayus na yun papel.
You think na mas ok na kumuha na sya ng lawyer?

April 16th, 2010 04:36 PM #2tingin ko kailangan na niya ng abugado, lalo na na siya pa ang makaksuhan ngayon,dapat demanda niya yung nagbenta kaagad or kung kakasuhan ng pulis, dapat damay siya and later on the courts will find out that the whole fiasco started from fraud on the part of the seller, am not a lawyer so best to consult one right away

he should consult a good lawyer immediately... file a case for rescission of contract if one has already been perfected. likewise, if the unit was the subject of carnapping, he can be indicted for anti-fencing aside from violation of prevailing motor vehicle law. always remember the guiding principle "caveat emptor" so that buyers should always be responsible enough to check the things he is about to buy, otherwise he will be bear the loss.

August 5th, 2010 11:11 PM #6just an update to this one. after so many days have passed nalaman na yun car na nabili was ressurected from a wreck. parang yun show sa Discovery Turbe na from wrecks to Riches.
The garage where the altis was repaired provided a certification to HPG that the car was a former wreck and needed repairs on the firewall and chassis hence the obvious welding marks are seen. Madaming problema ang nagdaan because initially the former owner was not cooperating and HPG was so anxious to file a carnapping case to my friend. Hindi man lang tumulong ang pulis kahit na alam naman nilang hindi carnapper yun friend ko at hindi naman malinaw na talagang carnap yun car. I dont know kung ano gusto palabasin ng mga pulis bakit atat silang kasuhan na agad agad yun friend ko. Although bibigay na kami ng hint about giving them money, tumatanggi sila. probably naliliitan sila sa. i forgot how much yun nasabing amount but i know malaki na yun for a middle class citizen.
Then more days have passed, napakiusapan na yun owner na makipag cooperate kasi may mga certification na yun car was repaired from a wreck tapus siguro alam nya na pati sya dawit sa kaso pag nagkataoon. marami pang nailabas na papeles about the car and soon after nag agree na din yun former owner to return the money.
Because of the power of prayers, nagkasolian na ng pera, wala ng kinaso ang HPG and now my friend is back to his normal life, naka bili pa sya ngayon ng brand new altis.

Iyong iba kasi bago kumuha ng TMG clearance hindi muna nila dinadala sasakyan at pina verify muna lalo na pag duda ka sa presyo nito . Ang mahirap diyan lalo na doon sa mga nakabili ng carnap na sasakyan pwede ka pang makasuhan ng Anti fencing law. Buti na lang nasoli pa pera ng kaibigan mo isa lang ang aral diyan pag may nagbenta ng sasakyan na sobra mura magduda ka na.

Good for your friend bro badtoy!.. Your patience really served you and your friend very well!! Now, time to re-group and learn from that big mistake.. Especially if that big sum of money is involved!! Ang hirap pa namang kitain ang php 1k ngayon..
Pero kung Tsikoteer siguro ang friend mo, palagay ko hindi mangyayari iyun sa kanya.. Ang daming experts dito pag dating sa future buys and transactions..

I would like to know if it is legal to use a chassis number and registration from a local wrecked ek.What about the taxes needed to ba paid since imported vehicle ang hatch na to?
