The House of Representatives has approved on third and final reading the bill against motorists who drive under the influence of alcohol and illegal drugs.
House Bill No. 4893 states that it is illegal for any person, while under the influence of alcohol or prohibited substances, to drive a vehicle, a congressional statement said Wednesday.
The statement added that once the bill is enacted into law, it will enforce road safety nationwide.
Based on guidelines, a suspected drunk driver found to have a blood alcohol level (BAL) of 0.06 or higher will be considered under the influence of alcohol.
BAL is the amount of alcohol present in a person’s blood stream. It is recorded in milligrams of alcohol per milliliters of blood.
The bill also authorizes the testing of alcohol content in a motorist's blood, breath, urine or other bodily substance for the purpose of determining his BAL or the presence of illegal drugs.
Police or traffic enforcers may initially do the screening when "the driver shows signs of impaired coordination and judgment while operating a vehicle, if stopped for a traffic violation or when involved in an accident."
Under the bill, a first offender will face 30 days in jail or license suspension and a P1,000 fine. A second offense will be penalized with 30 days in jail, license suspension and a P5,000 fine. A third will have a 30-day jail sentence, five-year license suspension and a P10,000 fine.
If death has resulted from the accident, the offender will be penalized with life imprisonment and an additional fine of P1 million in the event of multiple fatalities.
If the offense resulted to serious physical injuries, the offender will draw up to 12 years in prison, five-year license suspension after the sentence and a P200,000 fine.
The bill is now awaiting Senate action, the statement said.
