I drew a map to make it easier to understand.
The rectangles represent cars, hehe.
I (BLUE) was coming from Dela Rosa (Kalayaan Bldg side), turning right to Salcedo, to go towards RCBC.
It was a red light and there was a "No Right Turn On Red Signal". So I stopped.
It was a green light for the YELLOW cars. some were turning left towards RCBC and some were turning right.
When it was the turn of the GREEN cars to go, I noticed that the lanes going towards RCBC were totally empty, since no other cars can pass. Red light for the RED cars, and red light for the YELLOW cars.
The YELLOW cars were being blocked by the crossing GREEN cars anyway, so using COMMON SENSE, I thought it was safe to proceed. Otherwise, our lane would just be wasting time, stopping for nothing.
I proceeded and got apprehended!
I was explaining my sentiments to the police. All he said was that he's basing it all on the street signs, and I should jut contest it in their office, and make a request to have that sign removed!

you should have waited na lang.... may sign na palang 'no right turn on red signal' eh..

no need to contest the vioaltion as it was clearly a violation. the officer's suggestion is for you to go to the office to request removal of that sign (so no more violation in the future). With that sign still there, it would still be "no right turn on red signal" and still be a violation.

talo ka dyan. i always pass this intersection and clearly enough, meron talagang no right turn on red, kaya dapat in cases like this to avoid hassle, wait ka na lang. dito pa sa makati, most of the traffic aides dito puro reactive, hindi poposte sa gitna ng kalye yang mga yan para mag ayos ng buhol buhol na trapik, but magtatago para mangbulaga pag may nakita violation.

I frequently pass by a "No Right Turn On Red Signal" sign on V. Luna turning right to Kalayaan Ave. in QC, at naranasan ko nang mabusinahan ng mga nasa likod ko whenever I stop at the corner on a red light. One time I saw a motorist who made the mistake of turning right habang red pa yung ilaw -- and he was instantly flagged down by a traffic enforcer waiting a few meters from the corner.

Since there was a marking "No Right Turn on Red Signal" your chances of contesting your apprehension is very low...the officer even made a sarcastic suggestion that you make a petition for removal of the sign....ingat na lang next time and charge this to experience.

yup. there was a clear violation. so i don't think it would be worth your time to have it contested.

can contest it if you wish but definitely not going to be easy on your part. “IF” there was no sign - 100% you’re going to win it. baka ikaw pa masabihan ng "use your common sense". be cautious na lang next time, makati pa

You may have the COMMON SENSE; but, you clearly committed a traffic violation. Too bad, the traffic enforcer has also the COMMON SENSE to apprehend a traffic violator. You should have been patient and waited for the green.
I was apprehended for turning right at a corner without a "No right turn on red signal" sign. I told the TE that there's no sign prohibiting the right turn when red. The TE argued that, with or without sign, it is dangerous to turn right on red and cited about the recent accident that happened. Some more arguments then he let me go when I didn't give my license.
