Need help po mga sir and peeps.
I bought a pre-owned car last Feb and now due for registration this month. Also planning to transfer the vehicle to my ownership . I did not notice until only yesterday that in the (Open) Deed of Sale where the
"IN WITNESS WHEREOF...." and "WITNESS MY HAND AND SEAL...." portions, the year typed was 2010 instead of 2011., NOTARY PUBLIC until Dec 2010 but Series of 2011
As I recall the seller furnished his own computerized format of the Deed of Sale to the lawyer's secretary in Manila City Hall where it was notarized though it's an open DOS.
AFAIK alterations/corrections will void this document, how will I go with the TMG and LTO process of ownership transfer?
I can no longer reach the previous owner/seller for his signature to execute a replacement deed of sale.
My questions are:
1. Will a Notary Public notarize a DOS without the presence of the Seller supposing I make a new copy and scan the seller's signature.
2. As the last two digits of my plate number is 1 & 5, will there be a penalty if I get to register until next week or week after.
Any enlightenment and suggestions will be greatly appreciated. Thanks in advance.

I am not a lawyer, pero tama bang i-notarize ang isang open deed of sale? Parang mali yata...
Anyway,- go to a notary public,- ask for their opinion if it's alright to change the year (I think it is), fill out the deed of sale and have it notarized.

1. yes they can notarize the document basta may valid id xerox and 3 specimen signature of the previous owner plus TIN id.
2. just do the reg with in the month and you will be fine.
also, im no lawyer pero parang may mali na may notarize yung open deed. usually there will be an open deed then a separate deed of sale between the owner and buyer that has notary signed for security purposes.

Oo nga,- dapat fully filled-out ang deed of sale...
And with that,- puwedeng kanya-kanyang notaryo na.
An owner normally does that for peace of mind,- para he has a public record that he has sold his car... Baka kasi gamitin sa kalokohan...
Maybe this is what he has in mind when he notarized an open deed of sale,- pero mukhang mali. At kung tama ngang mali,- mas mali ang Notary Public for executing it....

June 16th, 2018 08:18 PM #5Ask ko lang po kpag nagpapa renew ng OR/CR pwede po ba ung hndi notarized na DOS? and yung ngbenta saken student ID lng ung binigay nya kaya Im worried na baka hndi ko pwde ma renew to..hndi ko na po makontak ung dating may ari...need help po...

anyone can go to the LTO, ORCR in hand, and car, of course, with tpl and emissions test, and pay for its renewal. no questions asked.
of course, the name on the OR and tpl is un-changed.
but yes, as already said, transfer it to your name asap, before it becomes more impossible for you to do so later on.

Ang inabot po skin ay open deed of sale with xerox ids ng owner na nakaname sa orig OR CR... Nakaalis npo ung seller nung napaansin ko na wala pirma ung DOS. Tinext ko sbi nya open po yan kya blanko... As in wlang fill up ung owner... Blank form lng po talaga... Meron lng is check sa vendor na line... Ung IDs nya na xerox eh wala pirma... Sabi ng seller marerehistro ko rin daw naman ksi updated OR... Kya lng tanong ko sa kanya maibebenta konba in case time comes... Sagot nya ay oo.. Dko po alam kung hot car to pero sa LTO TXT no alarm naman... Tkot dn ako mgtanong sa HPG... maibebenta ko pa ba to o bka ma anti-fencing po ako ng dko alam....

Isa from the original owner na nakasulat yung name ng nasa CR as the seller. Kahit blank yung sa buyer. Ito yung open deed of sale. Kailangan din ng valid ID ng original owner with 3 specimen signature. Ito pinaka importante. Ito ang open deed.
Tapos yung isa pa na deed of sale, between you and yung pinagbilhan mo. Ito naman dapat pirmado ng pinagbilhan mo at pirmado mo din. Ito naman ang proof mo na binili mo yung sasakyan in case maghabol sya. Kailangan mo din ng signature dito and notarized.
Pero kung ililipat mo na sa pangalan mo yung kotse, dun sa open deed, ilalagay mo pangalan mo then notaryo no. Then go to HPG for clearance then sa LTO ng mother file para iprocess.
