    Hi, I recently got into an accident involving my car, and a PUJ, now this is the first time ever that I have gotten into an accident, anyway, I was on the right side of the road ready to make a right turn, wen all of a sudden this puj to my left decides to abruptly cut in front of me to turn to the right as well wc the result was his vehicle ripped my bumper off, i just have a few questions, after all the photo taking of the police/investigator, he called my attention and informed me that my license was expired for 7 days, amusingly had it not been for the accident,I wouldnt have known about it cos all the while i thought it was going to expire 2018, my insurance is TPL and i believe its the same for the puj, and my OR/CR is still under the name of a specific company, I didnt have time to transfer the registration to my name yet, so question is what will be the likely outcome of this whole scenario? Will the puj's insurance cover it? Or not? Or whats going to happen?

    I doubt that the PUJ has insuramce though...

    Agreed. Most PUJ have TPL only which is required by law in annual registration of the vehicle which does not cover car damages like comprehensive does and is seperate, more expensive and not required to have by law (unless the vehicle is new and bank financed which requires insurance but again is very unlikely since its a jeepney). Unless he has comprehensive insurance then it's a moot point and you should have asked for cash settlement agreement at the police station during the filing of police report since his insurance won't cover it most likely. The only thing you can claim from TPL is if you were injured and can claim damages for hospital bills. Again all this is could be considered moot due to the validity of your license.

    Applicable ba tpl ba dyan? Di ata. Not sure though. Talo ka na dahil you're not allowed to drive dahil expired license na

    Afaik compulsory tpl is for people only and not for property damages.

    1) CTPL or compulsory third party liability coverage applies ONLY to the liability of the insured in respect of the bodily injury and/or death of any THIRD PARTY in an accident caused or arising out of the use or operation of the insured vehicle.

    2) considering that you were driving with an expired license, you were then violating a law, and because you were violating a law, you are presumed to have acted negligently.

    Pahelp din, newly joined lang ako dito. di pa ako makapagpost ng new thread. nagfull stop kasi ako kasi biglang may tumawid. kaso nabanga ko pa rin. tapos binanga naman ako nong nasa likod ko na car. kaso ang problema need ko the next day umalis ng bansa so nagswitch driver kami ng erpat ko kasi baka pahold pa flight kung sakaling mamatay yung taong nabanga at pumayag naman yung nakabanga sa amin at pumirma sila sa pulis report.
    Ang problema, tinatakot kami ngayon nong nakabanga sa amin at pati insurance nila na ipakita daw nila yung dashcam nila na ako talaga ang nagdadrive at pababago ang pulis report. kasi gusto nila kami magbayad ng pagawa ng car nila.
    Ang tanong may laban ba kami? (additional info: valid po DL ko at running 40-50kph lang ang takbo ko.)

    Diba kasalanan nila yun kasi wala silang proper braking distance?

    Yun nga rin iniisip ko, kahit pa nagpalit kami ng driver. di naman naming tinakasan yung tao. pinagamot namin. kung may safe braking distance sila di nila ako mabanga.

    Kaso may ground ba sa insurance yun? mavoid ba insurance claim namin kung may binigay kami ng false statement sa pulis?

    ano naman kaya kinalaman kung sino ang driver dun eh sila ang bumangga sa inyo, ipababago ang police report? how?

    Ingat ka bro. You have everything to lose. Sa tingin ko your insurance will deny your claim if they found out that you falsified a report. Technicality ito na pwedeng i-exploit kung hindi ka malakas sa insurance mo at lalo na kung malaking amount involved.

    Yung naka bangga sa iyo and their insurance are working together so that both of them won't have to spend a single centavo on this incident. Dapat sila mag shoulder ng damage nila kasi prima facie fault ng driver kung harapan ng sasakyan ang may tama but since they know you falsified the report alam nilang mayayari yung magiging claim mo sa insurance mo if they squeal to your insurance that you falsified the incident report. They are betting that the expense for the treatment of the pedestrian is large enough such that paying for their damage to keep them quiet is worth it for you. Ang lalabas nyan you have to shoulder all the expenses of the person na nabangga mo if your insurance company denies your claim for submitting falsified documents.

    Nasa pedestrian lane ba tumatawid yung nabangga mo? I know this is weak defense here maski hindi but it could help.

    Sayang, maliit lang sana na bagay ito if you did not swap drivers on the report. Wala naman kaso sa iyo if you leave the country since it was not a premeditated act to escape from liability (pre-booked tickets/itinerary etc) and you had a willing family member that is probably more financially capable than you to assist the injured.

    Sir, bakit sila pa yung may ganang mag sampa ng kAso? Where in the first place wala dapat sila sa kalye driving w/o license or expired license.

    wala naman akong nabasang may nagsampa na ng kaso... investigation lang ang nabasa ko..

    can TS argue that, "the expiration of the license does not result in loss of driving ability.." ?
    but if insurance is the question, having an expired license will deliver you "at the mercy of the insurance guys".

    Ayos ang reply mo..nagising ako bigla.. Oo nga nmn. TANDAAN ntin lahat: Pagwalang lisensya, pagnawawala ang lisensya o pag-expired ang lisensya e ibig sabihin commuter ka na automatically. Hindi tayo dapat humahawak ng manibela hanggang naayos na natin ang importanteng bagay na ito. Hindi na puede yun "bahala na, bka makalusot nmn." Dun sa naaksidente ng jeep, hala pre, mg-win-win n lng kayo nun jeepney driver or operator kc tagilid ka jan.
