good morning po.. victim po kasi ako ng undoy car nakabili po ako last month ng flooded car na toyota altis. nalaman ko lang po na flooded ung sasakyan is kahapon lang nung pinagawa ko ung power window nya nakita namin ung buhangin sa mga wiring dun po sa front door.

maganda naman po ung takbo ng kotse at maganda rin po ung makina walang kalampag very smooth po ang takbo, malamig ang aircon at tahimik ang makina..

tanong ko lang po. ano po ba ang mga possible or mga future problems ng isang undoy victim na kotse..

Mostly wiring problems. Short circuits due to corrosion. Possibly rust if water got stuck in some areas where rust protection is inadequate.

Thank you po.. sa reply nyo at sa information.. i feel bad lang po kasi, kasi po naloko ako nagtiwala kasi ako.. well papa check ko nalang po ung mga wiring nung kotse.. natatakot lang kasin ako baka sumakit ang ulo ko after 6 months or a year...

As a bit of advice.. If you feel aggrieved with the contract of sale wherein fraud is present, within 4 years from the time of the discovery you can file a case of annulment of the contract of sale.

Applicable provisions of the Civil Code are as follows:
"Art. 1390. The following contracts are voidable or annullable, even though there may have been no damage to the contracting parties1) Those where one of the parties is incapable of giving consent to a contract;(2) Those where the consent is vitiated by mistake, violence, intimidation, undue influence or fraud.

These contracts are binding, unless they are annulled by a proper action in court. They are susceptible of ratification.

Art. 1391. The action for annulment shall be brought within four years.
This period shall begin:
In cases of intimidation, violence or undue influence, from the time the defect of the consent ceases.
In case of mistake or fraud, from the time of the discovery of the same."

Sir wala po kami contract basta binili ko lang po as second hand deed of sale lang po..

i need some advice kung papano ko po malalaman kung ok po lahat ang electrical wiring ng kotse na undoy victim.. at thesame time ung makina ng kotse...

AFAIK Deed of Sale is a form of contract.

Btw, hindi mo ba tinanong sir kung na-ondoy yung oto before buying it?
kasi kung tinanong mo and sinabi nyang hindi eh fraud talaga yun kahit walang witten agreement (may legal term dun. forgot it though)

Blue, I doubt it if the owner would really be honest with the TS when it comes to discussions like that ( problems with the car or if it has been flooded )

It's a sad thing, but I guess ... everybody should be open up with that fact.

well, its a big risk nowadays to buy a 2nd hand car. they said na even if super ok yung pagkalinis, may bakas pa din na flooded, better have a mechanic check the car para 100% sure.

Surely, fraud is present in your case because you were deceived. Also, there is an abuse of confidence if you know the seller personally. You have two remedies: a criminal case for swindling/estafa, and another civil case for annulment of contract of sale (evidenced by a deed of sale). These remedies may proceed independently with each other. It is time that you get a lawyer in order to protect your rights.

While applicable criminal case provision is stated below:
Art. 318 of the Revised Penal Code: Other deceits. — The penalty of arresto mayor and a fine of not less than the amount of the damage caused and not more than twice such amount shall be imposed upon any person who shall defraud or damage another by any other deceit not mentioned in the preceding articles of this chapter.
