Eh yun na nga diba, sinabi na ng dalawa dito na they will only give the deed of sale after the terms up...so intayin niyo na lang, tinanong niyo ba kung ganun nga like yun Sabi ng isang kumuha ng lease rin sa Toyota and yun Sabi ng nag work sa Toyota?
Saka laki pala Kita ng uncle mo, bayaran na lang niya ng buo para matapos na...

yun na nga eh. Wala naman nakalagay na "they will only give the deed of sale after the terms up" sa contract. Ang nakalagay isosoli talaga sa toyota after ng contract. Pinabasa na namin sa lawyer ang interpretation nila isosoli talaga yung sasakyan at walang nakalagay na magbibigay ng deed of sale.Iba yung sinasabi nila sa nakalagay sa contract. Ngayon ang request namin we want guarantee na sa uncle ko talaga mapapangalan after bayaran ng 5 years kaso ayaw nila gumala ng kasulatan na ganon ang mangyayari. simple lang naman sir di ba?
kung pwede lang i cash nalang eh. marami din kasing binabayaran kaya installment lang gusto.
The question here is kung talagang in good faith ang toyota why not change the contract to lease to own?.. Wala naman mawawala sa kanila di ba? kung di makabayad uncle ko madali naman nilang mapapahatak yung auto.

Here's my take on this...
Agent says lease muna then convert to lease to own after a month. The buyer (uncle) agreed to the agent and I can't blame the uncle for trusting the sales agent that is employed by Toyota and sales representative nila. So the buyer is operating in good faith and put his trust into the sales agent.
Now, after a month or so, expected na ng buyer to convert the contract to lease to own. Agent cannot deliver on his word (worst kind of person to deal with). He is now operating on bad faith since a verbal contract was executed and he broke his word (contract).
After all that, management said, deed of sale after 5 years but contract stipulates otherwise. After going through a broken verbal agreement, who in their right mind would trust any form verbal agreement again by the same company?
It's not because the buyer did not read nor ignorance of what he is signing.
My 2 cents worth.
From the additional info the TS provided, it seems the uncle is not qualified at all to get traditional bank financing for the car --- that's why the resort to leasing.
My take: the term of the lease is 5 years. TFS stands to earn from the rental/amortization being paid for the car. At the end of the lease term, the buyer/lessee can take ownership of the car. Hindi talaga ilalagay sa Contract of Lease ang conversion to sale kasi magigin taxable siya as a sale transaction tapos pababayaran upfront sa TFS ang full amount of the VAT and CWT.
The sale happens after the end of the Contract of Lease and it will be the subject of a separate document.

Bottom line, the SA told a lie by saying the lease will be converted to a purchase. Ang kasalanan ng buyer nagpaloko sila, ngayon tali sila sa contract na pinirmahan nila. Radz, nabanggit mo na naipabasa nyo na sa isang lawyer at talagang isosoli nga yung car after 5 years...so obviously parang rent-a-car ang labas nito for 5 years.
ok so hindi natin masasabi na hindi nagbasa yung tito upon signing the contract kasi sabi kamo ng SA e papalitan yung contrata after 1 month. MALI PA DIN ang tito mo, bakit? kasi dapat humingi pa din siya ng written agreement from toyota mismo sa ganung kundisyon na papalitan after 1 month. verbal agreements e pwedeng mawala, paano kung i-deny nung SA? paano kung mamatay yung SA or kung sino mang nagsabi ng verbal agreement? mas mabuti talaga kung lahat ay written at signed (kahit addendum lang sa contract), mamatay man yung pumirma, at least may proof ka pa ding ipapakita in the end.
ewan ko lang kung papaboran ka ng DTI dyan, kasi napirmahan na e. meaning, nag-agree na yung tito mo sa contract. balewala na yung verbal kapag nag-deny na yung nagsabi. try mo ulit kausapin yung SA, i-record mo ng video kung ayaw gumawa ng bagong agreement about sa 1 month change ng contract. tapos kapag after 1 month hindi pinalitan, may proof kana at this time pwede na ito sa DTI.
Yun nga ang mali ng tito ko. Ngayon according sa TFS after mabayaran ng 5 years mapapangalan na sa tito ko yung auto. Kaso ayaw nila gawing written panay verbal lang at walang nakalagay sa contract na ganon ang mangyayari. Kaya ang plano kausapin ang TFS w/ DTI representative na gumawa sila ng proof na talagang ililipat sa name ng uncle ko yung auto after bayaran at hindi isosoli sa toyota.
Ang sabi ni DTI samin tatawagan nila TFS para mag sked ng hearing.

napirmahan na yung contract - meaning both parties totally agreed on the terms inside the contract.
paano kung i-deny nung toyota yung "verbal agreement"? again, babalik sa contract, at pirmado ito.
teka, lumipas na ba yung 1 month na sinasabing papalitan yung contract? kung lipas na, pwede sigurong i-consider na "niloko" talaga kayo dahil sa pangako na papalitan yung contract. saka bakit kailangan pang maghintay ng 1 month para palitan yung contract? well mali talaga yung tito mo, pirma ng pirma...

Lease sa papers pero hindi lease?.. kung talagang makukuha ng uncle ko yung car after paying ayon sa lease contract na to bakit ayaw nila gumawa ng kasulatan na ganun nga mangyayari?. At kung ayaw nila dahil magbabayad sila ng tax etc. Bakit di nila sabihin yun samin? Madali naman kausap tito ko. Gusto nya lang ng assurance na sa kanya talaga mapupunta yung car after paying for 5 years kaso puro verbal lang si TFS ayaw nilang i black and white yung sinasabi nila.
