Ung doctor na unang nag react sa shame campain ng BIR kinasuhan na ng tax evation.
ang sagot ni doc, pwede naman pag usapan kung kulang ung naibayad na tax.
ang sagot ni henares, sabi ni doc maghanap ang BIR ng tax evader na doctor at kasuhan kesa gumamit ng shame campain, wish granted, hehehe.

The doctor said that he cannot comment on it until they send their demand letter to him, which they have not, and that if he truly owes back taxes, he is willing to pay them and the penalty.
The BIR says they gathered the data from the "withholding agents"... ergo... the schools at which he teaches.
Which is strange, because, working at a school, my taxes are automatically withheld (kaya nga withholding agents). So either they didn't withhold taxes, which case, the employer is also liable, or the BIR is trying to hit him with double jeopardy.
This is going to be... interesting.
Walk the talk, BIR. But if it turns out that they have no case, this will be embarrassing.

Ang pagbalik ng comeback...
On unang hirit this morning after henares interview; clavio then interviewed olarte, and he did said that he "may have" "some" back taxes that he is willing to pay if proven.
Niky, your case is probably different from olarte. Yes he was teaching, and yes his employer deduct tax from him, BUT, teaching is NOT the only his source of income. If you have more than 1 source, you are required to submit your ITR (consolidated from all sources of income); the usual employer substituted filing is NOT applicable here, becuase the school has no business to know or to track his OTHER sources of income (Doctor; business; . . .)
to add: it is also different setup on who has the burden of proof, yes bir comes up with their estimates that you owe them taxes, but it still lies on an individual to prove to bir his income, if you contest their estimate, you have to prove them wrong with documents to show that your computation is more accurate. Hindi pwede pakita sayo ni bir yung mga nilista nilang kinita mo, kasi if they did, alam mo na kung alin yung mga nakalusot, at alin lang yung nakita.
In the end though, 2.9m inaccurate? Feeling ko pinatungan ng pinatungan lang ng fines para magmukhang big fish. If there's anything he owes there, it will be through technicalities and miscalculations. It would not make sense to cheat on taxes for income that is already a matter of public record.
Like I said, we'll see.

Do note: I fully agree that no one should get a free pass on taxes, and a lot of doctors really don't pay them, but I'm puzzled, really, that the BIR is going via this avenue, through official records of employee compensation, to get at Olarte. That would seem to indicate that they lack a smoking gun and are going after him on technicalities. (Again, though, if they have a smoking gun, good for them!)
All you have to do is gather affidavits from patients who paid and did not get receipts, then present that as a clear violation of the law.
Hard to do. Who would like to admit that they didn't bother to ask for a receipt, merely to get a discount?Remember, the big "come on" for doctors to not give receipts is by telling their patients that they have to charge extra if they issue a receipt (very familiar song and dance). Thus people do things off the books to save money.
