    BIR has been conducting 10 day surveillance on businesses recently. The local supermarket across the street that used to pay 250k in taxes now has to pay 60 f*cking million in penalties. WTF!? F*cking b*st*rds. And they don't even issue f*cking receipts for f*cking penalties.

    style yan ng mga hinayupak na yan.... (ok lan sana if we taxpayers enjoying it. eg: nice roads)

    pagkatapos sabihin yun "bagong/higher pay": "ser, pwede naman natin pagusapan eto"

    the reason why these WTF BIR (di naman nilalahat) guys get away with this kind of thing is:
    1. they target SMEs
    2. they target big business, that think they (business owners / management) are still SMEs
    3. they target big business, that don't know the law

    same thing with labor din... (due process sa pagtanggal ng tao).. although now.. kahit with due process... pumapasok yung social justice (which wala naman standard... very subjective).. but i'm digressing..

    going back to the topic.. the best way to "fight back" on this kind of tactics... is to:
    1. get a legitimate, and knowledgeable tax consultant
    2. know the tax laws and the impact on your business
    3. implement / follow the tax laws..

    It may not be guaranteed that doing all these will prevent you from being targeted by BIR (hell.. they even targeted Manny Pacquiao just to set an example na wala silang pinipili.. ).. but then by following all of these, you minimize your exposure...

    ang challenge talaga dito is how to do all these, and yet still remain competitive sa market (with competitors not following these... ).. in a way. they are bound to be targeted eventually... una unahan lang..

    question na lang is kung may enough funds silang naitabi to make the problem go away and start over...

    mahirap din magpatulong sa nbi para magpa entrap.. kung alam mo rin na may basis (kahit papano, although may not be that big yung magnitude)...

    as a business.. going concern yun.. continuous... maaaring this year, ibang revenue officer kaharap mo.. next year iba uli.. but word goes around din within the BIR circles.. they also exchange notes kung sino ang easy target at sino yung hard targets... di naman yan gaya ng private citizen na nagpa entrap sa tulong ni Mon Tulfo.. one time transaction ganun... entrap agad...

    dito.. every year.. sila makaharap mo.. (unless plano mo magsara ng business agad after ma entrap sila)... or unless by the time ma entrap sila.. ready ka na to comply on the laws (by next year.. makakaharap uli sila eh)...

    Ang tanong dyan is nagbabayad ba sila ng tamang taxes? sa tingin ko kasi kung tama ang binabayad di ka tatargetin ng mga yan since kumpleto documentary evidence mo kung sakali. baka naman tax evader kaya walang resibo at under the table lang.

    anybody who has done real business has to realize.. you have to keep pristine records of all your transations... yan ang pinaka protection mo para malaman mo kung kumikita ka talaga, at kung magkano ang TAMANG buwis na dapat bayaran.

    however, it isn't so simple depending on the kind of business you are in, the volume of business / turnover you have... to keep your records really pristine, either you record each and every transaction yourself, or you hire more people to do it for you (which may not be a guarantee that they do it properly), or you invest in a computerized system and still invest in people to make the computerized system work properly... all these record keeping efforts will eat into your profits either thru added opex and/or capex... which means less profit... and when you go into business... you are in it for the profit... yung mga nagsimula sa maliit.. yan ang mentality.. and.. most of the businesses here nagsimula sa maliiit.. even government stats reveal na mas marami di hamak ang mga SMEs compared to the multi nationals / Large Taxpayers...

    yung records mo ang magsisilbing protection mo (and at the same time, yan din ang magbabaon sa yo in a way) sa mga ganitong BIR operations.. however... it isn't enough that you keep your records straight.. you still have to know the pertinent BIR issuances... which records to register with the BIR, etc etc.. in the legal world.. paying the right tax is as much as following the technicalities of it... in the process.. you get to see / discover some loopholes...


    Now sa malalaking businesses... na nagsimulang malaki agad.. they know that paying the right taxes should be a part of it... pero sa mga nagsimula sa maliit.. mahirap.. kasi nung maliit pa lang.. nakakalusot.. pero nung lumaki ng bahagya... nagtuloy tuloy na ang practice...

    and the BIR isn't making it a lot easier for these SMEs to comply... parang MMDA / Traffic enforcer din sila... mas pinipili nila magtago sa after the intersection para hulihin yung mga nag violate ng traffic rules.. instead of doon sila bago pagtawid ng intersection para sila mag control ng traffic...


    ibahin natin.. sa mga fully employed na na withhold ang taxes... given the situation that the BIR didn't deputize the company to make the computations and withhold and remit the tax... sa ordinaryong empleyado... will you also compute by yourselves properly and pay your taxes and file your returns properly? the fact na ginagawa ito ng company.. it already loads some level of costs / expenses for the company to comply with this... libre na yan sa empleyado.. kasi kung empleyado mismo gagawa nyan.. ilang oras din mauubos nyan for each individual to do that...

    Problem is, even if you do follow the law, there are just people in the don't give a f*ck and abuse them.

    Fighting back in the provinces will just get you into deeper sh*t.
