MANILA - Independent senatorial bet Francis Tolentino failed to secure any halt order from the Supreme Court (SC) to stop Thursday's proclamation of the 12 winning senators in the recently concluded May 9 polls.
The high court did not issue a temporary restraining order (TRO), as prayed for by Tolentino in a 10-page petition he filed on Wednesday afternoon.
The SC is on decision-writing break and will resume sessions in June. Any TRO, however, may be issued, if warranted, by Chief Justice Maria Lourdes Sereno and will be subject to the concurrence of the rest of the magistrates upon resumption of the sessions.
In his petition, Tolentino asked the high court to stop the Commission on Elections (Comelec) from proclaiming the winners in the 10th to 12th senatorial slots. Tolentino is on 13th place with former Justice Secretary and Liberal Party candidate Leila de Lima trailing him by over one million votes.
Tolentino alleged that the elections was compromised when automated election system (AES) provider Smartmatic altered the script at the Comelec transparency server in Manila on the night of election day, sans the necessary permission and authority from Comelec en banc.
"Petitioner asks the highest court of the land to stop the [Comelec] from proclaiming the winners of the last three slots for senators in the May 9, 2016 elections on grounds that the electoral process has been compromised and that the results the proclamation of which is sought to be stopped do not reflect the true will of the electorate.
"In allowing a foreign national (Marlon Garcia, said to be the Project Manager of Smartmatic) to breach protocol and manipulate the automated election system without authority from the [Comelec] En Banc, the Comelec reneged on its constitutional duty and obligation to oversee the conduct of clean, honest and credible elections," the petition read.
Tolentino also urged the high court to order the Comelec "to open the AES to forensic audit and investigation" and ensure that adequate measures shall be put in place by the poll body
to prevent a similar incident from happening again.

There was “widespread” cheating during the last elections perpetrated by the “Garci boys” at the Commission on Elections (Comelec), outgoing Senator Serge Osmeña III said on Thursday.
The “Garci” alluded to was former election commissioner Virgilio Garcillano, who allegedly conspired with then President and now detained Pampanga Rep. Gloria Macapagal-Arroyo to rig the 2004 polls.
“Why don’t you check the results? I was always in the survey then of all a sudden some senators were able to add two to four million votes to their totals,” Osmeña told reporters when asked why he did not make it to the Magic 12 in the senatorial race.
“May mga (There are) Garci boys,” he added.

Asked how the supposed cheating was done, the senator said: “I can just see the results. If I’m leading you by two million votes and then after election day, you’re leading me by two million votes, that’s four million votes. Nakuha mo in three days, four days? Imposible ‘yun (You gathered those votes in three days, four days? That’s impossible). Matagal na ako sa business (I’ve been in the business for a long time), I’ve been in politics for a long time. I know that’s impossible.”
Osmeña said the cheating was not limited to the senatorial races only.
“No there was a widespread cheating all over the country, iba iba ‘yung style nila,” he said.
“It’s widespread, practically in every province, local cheating, vote buying. I’m not even talking about vote-buying; vote-buying has become very normal. It’s very disappointing na na-spoiled na ‘yung mga botante, talagang inaantay nila ‘yan (It’s very disappointing that the voters have become spoiled already, that they are just waiting for the vote-buying to commence).”
Osmeña said the “Garci boys” in the Comelec, who have not been removed from their posts, were the culprits behind the cheating.
“Yung mga Garci Boys, andyan pa ‘yung mga Garci boys, hindi tinanggal (The Garci boys are still there; they were not removed)…Yes they are inside Comelec,” he said.
“Nag-offer pa nga sila e nagpapadala ng message sa akin: ‘Boss mag protection ka na.’ Sabi ko ayoko (They sent me an offer: ‘Boss, protect your votes.’ I declined).”
Asked how much the offer was, Osmeña said: “In the beginning, early on mga P10 a vote, pumili ka na (you choose). Let’s say, I want one million votes at P10, e di (for a total of) P10 million. ‘Yung mga iba maraming pera (others had a lot of money) ‘so give me five million votes at P10 (each),’ that’s P50 million,” the senator added.
He said the offer was made through common friends.
Despite his claim, Osmeña said he would no longer file an election protest, saying the process would be difficult since the cheating took place not only in one place but all over the country.

Sen. Sergio Osmeña III on Thursday said he was cheated in his reelection bid, blaming the “boys“ of former Comelec Commissioner Virgilio Garcillano of “Hello Garci” notoriety for his loss.
There was “widespread cheating” in the elections and this happened at the local level through vote buying, vote shaving and other ways, Osmeña said.
Earlier, Osmeña said he had accepted his loss. He had ranked between 6th and 9th in preelection surveys, but ended up 14th in the final tally, two spots away from the winning 12 senators.
Speaking to reporters on Thursday after the last Senate blue ribbon committee hearing on the $81-million cyberheist of Bangladeshi funds, Osmeña admitted being surprised by the election outcome.
“I was always in the surveys and then all of a sudden some senators were able to add two to four million votes to their totals,” he said.
Osmeña said he knew some candidates had paid for their votes.
He said he did not think Mr. Aquino was aware of the cheating, but that it was an “individual effort.”
Asked who was behind the cheating, Osmeña replied: “The Garci boys are still there. Yes, they’re still inside the Comelec.”
Garci or Garcillano is the former Comelec commissioner who sounded like the other party in a wiretapped phone conversation with then President Gloria Macapagal-Arroyo discussing her vote margin during the 2004 election.
Osmeña admitted he was approached by the Garci group through mutual friends and offered P10-P20 per vote but he did not bite.
“Vote buying had become very normal,” he said.
Other forms of election cheating included vote shaving, but this was minimal, hacking of flash cards and preshading of ballots, Osmeña said.
He said he did not plan to contest his loss as pinpointing exactly where the cheating happened would be difficult since it was widespread.
He said he intended to relax and do some fishing.
Asked if he would make another run for the Senate in three years, he replied: “Probably not. I might be happy with my wife.”

Sotto claims support of 11 senators for Senate presidency

Senator Vicente Sotto III is being considered by up to 11 senators for the Senate presidency, the lawmaker himself said in an interview on Friday.
Sotto, who will be serving his fourth term as a member of the Senate, said the group he is forming with several senators is considering him for the top post in the chamber.
"Officially, I have been considered. I have not aspired for it but the group we are forming is considering me as a possibility," Sotto said.
"Right now, kausap namin mga 11 pero nine kaming sigurado (sa grupo)," he added.
The number of votes a senator needs for the Senate presidency is 13.
Sotto is a member of the Nationalist People's Coalition.
Earlier, Senator Aquilino Pimentel III announced his intention to make a go for the post.
As the lone PDP-Laban party mate of incoming president Rodrigo Duterte in the Senate, Pimentel said he was seeking the post to be more effective in shepherding the next Chief Executive's legislative agenda.
Other likely candidates for the Senate helm are Senate President Franklin Drilon, who topped the senatorial elections; and Senator Alan Peter Cayetano, Duterte's running mate who placed third in the vice presidential race. —NB, GMA News

Sa isang okasyon ng malasing ang naturang Senate official, nagulat na lang ang magandang empleyado nang bigla siyang hipuan sa maselang bahagi ng kanyang katawan.
Bagamat pumalag ang empleyado, inalok pa daw ito ng manyakis na opisyal na makipagtalik sa kanya.
Hiwalay na kasi sa asawa ang magandang Senate employee kaya’t mukhang nagsamantala ang may pagka manyakis palang Senate official.
Dahil dito , nagsumite ng reklamo ang empleyado kayat nanganganib ang nabanggit na Senate official na masibak sa puwesto at mapagkaitanan ng lahat ng benepisyo na maari nitong matanggap sa pagreretiro.
Dating taga-media ang nabanggit na Senate official na may pagka-manyakis pala. Kilala din ito sa pagiging ma-epal kaya’t kadalasang kinaaasaran.
So Pia Cayetano, JPE, Jinggoy, Lito Lapid, MIrriam, and Bong Revilla are term limited and only Pia may re run for a senate seat on 2019. BBM, Serge Osmena and TG Guingona won't be senators after June 30...
