    ang katanungan ko po ay garne...
    meron po bang nasusulat tungkol sa apartment...
    i mean sa batas po natin...

    my friend asked me kasi kung di bawal yun ginagawa ng landlady nya...my friend is leaving her apartment. her landlady told her that the deposit is neither consumable nor refundable. sa pagkakaalam ko po kasi refundable ito o kaya consumable.

    atty. ano po ba talaga?

    ganito yan yung deposit kasi depende kung para saan, at ano ba ang napagkasunduan nila sa simula.
    pwede kasi niyang gamitin nalang ito pambayad sa rent niya bago siya umalis or mareretain muna ito sa landlord para kung meron kailangan pa repair sa nasira nila sa apartment or pambayad sa bills like tel,water,meralco. at kung merong subra doon lang ibabalik sa kanya.

    Ano bang nasa kontrata?

    Usually it should be refunded minus any expenses to return the unit to its previous condition at the time of renting, that may include repainting costs, cleaning costs, and any necessary repairs.

    Kaya dapat may move-in checklist at move-out checklist.

    Refundable ang security deposit. This is normally used to pay for damages incurred by the tenant, or for unpaid bills.

    For repairs or repainting, dapat sagot ito ng lessor. Kung sinagot ng tenant, it should be reimbursed by the lessor. More or less, ganito dapat yung pertinent provisions on standard rental/lease agreement contracts. (Ma-check nga mamaya)

    ganito po kasi ang situation, sabi ng landlady ay di pala consumable nor refundable ang deposit. parang ang mangyayari mapupunta na sa landlady yun deposit ng walang kahirap-hirap. sabi ng kaibigan ko na sa kanila(land lady) lang daw yun ganun sistema, sa iba kasi the deposit is either refundable or consumable. ang sagot ng landlady ganun daw ang rules nya. at may pinirmahan silang agreement. ano kaya maganda gawin sa sitwasyon na ito at ano po bang legality dito? she's asking for a legal advise actually.

    may pinirmahan nga sila, so wala na siya talaga habol dito?

    parang gustong manggulang ng landlady.. dapat sa goonsquad ito..

    kaya may deposit/advance e para pambayad yun incase meron damage, dapat ayusin sa apartment na iiwanan ng tenant, o kaya unpaid utility bills...

    yung mga damage e inde kasama yung due to natural usage...siempre kung meron sofa s subject to normal wear and tear yan and not considered as damage..

    security deposit is usually the first and last months rent or a combination of a few months' rent.

    1.) hwag na lang nyang bayaran ang last month's rent nya.
    2.) tignan ang details ng contract.
