    75% for MILF in wealth sharing a ‘done deal’
    PE: Lands for Bangsamoro okay, but not territories, air space, seas
    No wonder the Moro Islamic Liberation Front (MILF) leaders and the western powers such as the US and the United Kingdom are happy with the Philippine peace panel’s Framework Agreement, as the new political entity to be known as the Bangsamoro, is to get a 75 percent share in wealth produced in the areas to be controlled by the NPE, or 75 percent of revenues generated, with the Philippine government getting a mere 25 percent share.
    MILF Vice Chairman for Political Affairs Ghadzali Jaafar, in a radio interview yesterday said this wealth sharing was a “done deal.”
    “What was discussed on the issue of wealth sharing is that the national government will be getting a 25 percent share that will be coming from the revenues of economic activity in (the MILF areas). The way I see it, the 75 percent-25 percent is already a “done deal.”
    Malacañang and its peace negotiators earlier had claimed that the wealth sharing agreement between the national government and the Bangsamoro region has yet to be discussed, despite the wealth sharing clause already included in the framework agreement which is expected to be signed by both parties on Oct. 15.
    But Senate President Juan Ponce Enrile does not see a problem in legislating a law for the establishment of the MILF’s NPE, provided the Bangsamoro will only be given lands, but not air space or seas, or large bodies of waters outside the normal municipal waters outside of the present regional

    territorial divisions.
    He added that the Bangsamoro political entity can serve as an “experiment” in testing the feasibility of a shift to parliamentary system of government.
    “There is in fact in the psyche of this country the desire to adopt a parliamentary system and I think this will be a good experiment to find out how a parliamentary system of government will operate. As far as I am concerned. I am not forcing my opinion on others, but I would risk this for this purpose and find out how good is a parliamentary form of government. This will be a model,” Enrile said as he contradicted the assertion made by Sen. Miriam Defensor-Santiago on the need to undertake first Charter change (Cha-cha) before the framework agreement in signing a peace pact with the MILF can be put into place.
    While it appears to be a “doable formula” to finally put an end to the decades-long struggle of the Muslim separatists, Enrile said it will require the passage of a law, just like the process in the Tripoli Agreement that led to the creation of Autonomous Region in Muslim Mindanao (ARMM).
    “Well, that will be provided by law. I understand that the agreement is not self-executing. It has to be translated into legislation. This is actually like a territorial division of the country especially designed for Muslim Mindanao and the Cordillera. It is in the Constitution.
    “In this particular case, we have already a provision in the Constitution establishing autonomous regions. As a matter of interpretation, you can provide for the ARMM and the Cordillera a formula similar to what was provided in the summary that I got. I have taken a position that we can solve this problem in Mindanao provided we only give them lands but not air space and seas, or large bodies of waters outside the normal municipal waters outside of our present regional territorial divisions. This is doable. They do not have any territory. When you talk of territory it involves the air space and the high seas,” Enrile explained.
    Since there already exists a constitutional provision authorizing the creation of an autonomous region, it could serve as a basis in crafting the needed legislation and not to amend the country’s Charter.
    “We have already done it before. The provision on Autonomous Region of Muslim Mindanao and the Cordillera were not self-executing. They needed legislation. We passed the legislation, so we can do the same thing here, because there is no territory in the political sense. When you are talking of a state you need a territory, you need a government, you need a people. Here, you have a government, you have a people, but there is no technical term as territory, as we know it in the definition of a state.
    “We will draft a new legislation that is why we formed an agreement. We recognized the need for a new legislation,” he said.
    Enrile said there is no need to shift in the current form of government as t remains under the supervision of President Aquino.
    But there will still be a plebiscite especially on the matter of the inclusion of other areas other than those covered by ARMM, the senator said.
    Still, Enrile said concerns over the emergence of a new armed group cannot be prevented.
    The matter will be subject of deliberations by Congress, adhering to the agreement as closely as possible, said Enrile.
    The MILF yesterday clarified that the framework agreement it forged with the governmentis not exclusive for MILF members but for the entire Bangsamoro people and other Mindanaoans amid pronouncements by the Moro National Liberation Front (MNLF) that the agreement was a mistake.
    Jaafar said that “whatever agreement will be reached is inclusive to everybody, it’s not exclusive for the MILF. It is inclusive of all the Bangsamoro people. It’s like a ship where everybody should go on board, it is just incidental that we (MILF) are steering the ship but it is not ours,” said Jaafar.
    The MNLF earlier branded the agreement between the government and the MILF as a mistake, citing the MILF has identical territory, the same people, culture and religion represented by the MNLF which signed a final peace agreement with the government in 1996.
    The MNLF also said that provisions of the final peace agreement with the government have not been totally implemented, in fact, it was not even half completed.
    Jaafar, however, maintained that the MNLF can freely join the “Bangsamoro” where elections would be held, when already established, for the people to choose their leaders.
    “They (MNLF can join the government anytime. As a matter of fact, many of them are in the government, brother Muslimin Sema who is the vice mayor of Cotabato City,” added Jaafar.
    Jaafar said that even the group of former MILF commander Ameril Umbra Kato, who founded the Bangsamoro Islamic Freedom Fighters (BIFF) after breaking away from the MILF, could also go back to the folds of the MILF and join the “Bangsamoro.”
    “The group of Ameril Umbra now is saying ‘let’s wait and see’…it means that they will first see whatever will agreed with finality, and if they feel it will address the Bangsamoro issue, they will go for it, they will join and I think they are telling the truth,” said Jaafar.
    Malacañang says there is no need to amend the Charter. Deputy presidential spokesman Abigal Valte said the creation of the Bangsamoro region as agreed upon by the government and the MILF does not need a constitutional change.
    Allaying fears expressed by Senator Santiago, who said a change in the Charter is needed to fulfill the government-MILF agreement regarding the creation of the Bangsamoro, Valte said: “Perhaps there is a difference in the legal opinion. However, as stated by Dean Leonen yesterday, there is no amendment required.”
    Asked whether the government is ready to assert its constitutionality, Valte said every stipulation of the legal framework agreement will be published and posted online to enjoin the regional stakeholders to join the discussion, even as she said the administration is prepared for a legal battle if only to prove that every little step that they took in formulating the legal framework agreement were consistent with the 1987 Constitution.
    “Again, proof positive of that is that we have opened the draft for discussions. On our end, at least from what we’ve been seeing so far, the feedback has been positive’, added Valte.
    Pressed for details as to how President Aquino intends to have the legal framework get past the legislative chambers of the Senate and the House of Representatives, Valte preferred legislative concurrence without necessarily dragging political allies,
    “We’ll see what will happen on the floor. As Dean Leonen said, whatever the outcome will be from the framework agreement that will have to go through both Houses” Valte noted.

    that Misuari pocketed funds allotted for the poverty alleviation program, as his
    supporters reportedly spent P42 million to buy high-powered weapons.

    The govt should be very cautious in this. when Marcos inked a deal with the MNLF, shortly after the MILF was born. if this deal happens ...
