MANILA, Philippines – One of the key framers of the 1987 Philippine Constitution on Wednesday said the Filipino people should be outraged by the passage of a resolution seeking to convene Congress into a constituent assembly, minus the Senate.

In an interview with radio dzBB, Fr. Joaquin Bernas, who was a member of the 1986 Constitutional Commission, blasted House legislators allied with President Gloria Macapagal Arroyo who insisted on passing the measure allowing for a Senate-less constitutional assembly.
“Kasi pinaglalaruan nila ang Saligang-Batas at pinaglalaruan nila ang tao [They are toying with the Constitution. They have been fooling the people]," said Bernas, who is dean emeritus of the Ateneo de Manila Law School.
Bernas also echoed Nueva Ecija Rep. Eduardo Nonato Joson’s opinion that the approval of the measure was like “gang raping" the Constitution.
Asked how the public should react, Bernas’ reply in Filipino was, “Magalit (Be outraged)."
After a viva voce or oral voting late Tuesday night, the majority succeeded in approving House Resolution 1109, which calls for constitutional amendments through a constituent assembly that does not involve any Senate participation.
Prior to the voting, a number of opposition lawmakers waiting for their turn to question the controversial measure were slammed out when Maguindanao Rep. Didagen Dilangalen approved a motion to close debates.

I agree with Fr. Bernas. We should be outraged.
As it is, the people now in power have become fearless to push their agenda.
The church is no longer capable of moral persuasion.
The military is actually the last bastion. The generals may have been bought but there are quite a few out there who are more idealistic and perhaps more patriotic. But we have been brainwashed not to support a military junta.
But there will be come a time that any change will be welcome.

MANILA, Philippines—There is no reason to take House Resolution No. 1109 to the Supreme Court because what the majority members in the House of Representatives essentially did on Tuesday night was to announce that they would commit a crime, constitutionalist Fr. Joaquin Bernas said Thursday.
“To my mind, the only thing they achieved was that they shot their foot. They did not do any damage yet,” Bernas said in a forum at Ateneo de Manila University.
“What they said was, ’Ladies and gentlemen, we are going to violate the Constitution.’ But they did not violate the Constitution. That is why, to my mind, there is nothing yet to bring to the Supreme Court,” he said.
And if the House tries to bypass the Senate and takes proposed constitutional amendments to the Commission on Elections for a plebiscite, it will be “a fatal mistake,” Bernas also said.
“The amendments can only take effect if approved by a plebiscite, which they have to present to the Senate,” he pointed out.
Commenting on the possible extension of the terms of elective officials, Bernas said the Supreme Court and the military would play a part in pushing it through.
“So how real is the threat of extension? It is real only if the Supreme Court will cooperate … and more so the military,” he said.
The alternative, he said, might be a people power revolt similar to what took place in 1986. He noted that after that revolt, the justices of the Supreme Court were replaced.
“Justices might think of that if ever they are tempted to cooperate in the gang rape of the Constitution,” Bernas said.
Ball in their court
Even House Minority Leader Ronaldo Zamora said there was no reason to question HR 1109 before the Supreme Court because there was no controversy yet.
“Why should I walk into that kind of trap?” he said in a phone interview. “"The ball is clearly in [the House majority’s] court, not mine. I’m not going to make it easier for them by dancing to their tune.”
Zamora said he refused to believe that the proponents of HR 1109 only wanted to trigger a ruling from the Supreme Court on the proper way to conduct a constituent assembly (Con-ass).
“Of course not,” he said. “You can’t call a Con-ass just to drink coffee … Of course, you’re going to discuss amendments.”
He also said the difference in the opinions of the proponents of HR 1109 on what to do next meant that “they were not the masterminds” of the resolution

MANILA – Nagpahayag ng pangamba si Senador Rodolfo Biazon nitong Biyernes sa magiging reaksyon ng mga sundalo sa ginawang pag-apruba ng mga kongresistang kaalyado ng Malacanang sa resolusyon na magpapatawag ng Constituent Assembly upang amyendahan ang Saligang Batas.
Sa panayam ng media, pinayuhan ni Biazon, dating chief of staff ng Armed Forces of the Philippines (AFP), ang mga kongresista na bawiin ang Con-ass resolution upang maiwasan ang mga madugong protesta na posibleng humantong sa kudeta.
“What I am afraid of this if the instability translated into action in the streets, we are already beginning to detect some reactions from the soldiers. As a matter of fact I talk with retired generals, asking me what can we do," ayon kay Biazon.
“Soldiers might bring this on their own. We have witness EDSA 1 and 2…what if they say we did it two times and twice you frustrate us, If we grab power today baka ganoon ulit," babala niya.
Sinabi nito na may iba’t-ibang antas ng emosyon ang militar sa pagpasa sa Con-ass resolution dahil nakikita umano ng mga sundalo ang walang habas na paglapastangan ng ilang kongresista sa Saligang Batas na kanilang ipinagtatanggol.
“There are different level of degree of emotional involvement yung iba galit na galit, yung iba naman, they are seeing the mockery of the constitution," pahayag ng senador na dating heneral.
Kung hindi babawin ng Kamara ang Con-ass resolution, sinabi ni Biazon na mag-iiwan ito ng pangamba sa mga Filipino katulad ng takot na iniwan ng trahedya ng World Trade Center sa isipan ng mga Amerikano.
