    Anti-Marcos leader gets online death threat from ‘cop’

    Zena Bernardo Bernardo, one of the leaders of an online community group opposing President-elect Rodrigo Duterte’s pronouncement on the impending burial of deposed dictator Ferdinand Marcos at the Libingan ng Mga Bayani, has been the target of a death threat on Facebook.

    The person who posted the threat has been identified as Juvic Gultiano Pedotin–whom Bernardo claimed is a police officer, as his Instagram account photograph apparently shows.

    Kasabay ng "CHANGE IS COMING" ng ating papasok na pangulo na si Duterte ang pagbabago maging sa maliliit na yunit ng ating lokal na pamahalaan. Ngunit mali yata ang pagkakaintindi ng ilan sa pagbabagong ito. Dahil ganito ang nangyari...

    Nasa labas ako ng bahay namin, sa TAPAT MISMO ng bahay, may kausap kasi ako sa cellphone at sa kadahilanang "deadspot" ang bahay, lumabas ako para may maayos na signal. Pumatak ang ika-sampu ng gabi, hudyat para umuwi at pumasok na ng bahay ang MENOR DE EDAD. Hudyat din ito na magroronda ang mga opisyal upang manghuli ng mga lumalabag sa curfew, ng mga umiinom at naninigarilyo sa labas ng bahay, ng mga walang T-shirt, ng mga batang tambay sa computer shop at maging ng mga naka-boxer shorts lang na nasa kalsada.

    Nakaupo ako sa tabi ng poste, nakasalpak ang earphones at walang inaalala dahil WALA NAMAN AKONG NILABAG NA ORDINANSA. Huminto ang isang motor sa gilid ko, tinatawag niya yata ako, pero sa pangatlong "HOY" na ako lumingon. Maliit at payat yung lalaki. Sila ay mga tauhan ni COUNCILOR RANNIE LUDOVICA ng DISTRICT 2, QUEZON CITY.

    "SAN KA NAKATIRA?"... tanong ng lalaki.
    "DIYAN PO."... aking tugon, kasabay ng pagturo sa aming bahay.
    "PUMASOK KA NA"... sabi ng lalaki.

    Nag-aalangan pa kong pumasok dahil wala naman akong nilabag na ordinansa. Pero sabi ko sa sarili ko, "Sige na nga, 3% na lang din naman yung phone ko".

    Tumayo ako at papasok ng gate, nang huminto ang isa pang motor sa tapat ng gate namin, bumaba ang lalaking malaki ang katawan at mas matangkad kaysa kanina, at bigla akong dinakma sa batok.

    "PAPASOK NA KO. ITO ANG BAHAY NAMIN"... sabi ko sa lalaki.
    "AYAN NA NGA ANG BAHAY MO, PERO NASA LABAS KA PA AT HINDI TALAGA KAYO SUMUSUNOD SA PANUKALA. WALA TALAGA KAYONG ALAM."... tugon sa akin.

    Hinila niya ko at sapilitang isinakay sa isang L300 na sasakyan. Inis, galit, takot at kaba ang naghahari sa loob ko. Umikot pa kami ng barangay at naghahanap ng mahuhuli. Nagsakay ng mga bata, ng mga lasing at maging yung bumibili lang sa tindahan ay hinuli rin.

    NAIINIS AT NAGAGALIT AKO. "Anong nilabag ko sa ordinansa?". Wala naman ah. Kung hindi lang ako kristiyano at edukado, baka minura ko na sila. Nakakainis lang na sila mismo na nasa awtoridad ang mismong HINDI NAKAKAINTINDI ng ordinansa. Sabi sa ordinansa, 18 years old and below ang sakop ng curfew. Ito ang sabi:

    Quezon City Ordinance No. SP-9204, S-1972 - An Ordinance providing curfew hours in Quezon City for minors below 18 years of age from 10:00 p.m. to 5:00 a.m. daily, providing penalties for the violation thereof: and for other purposes.

    NATATAKOT AT KINAKABAHAN AKO. Nang pumasok kami sa Filinvest 2, sari't saring senaryo ang pumasok sa utak ko. Hala, may mga bakanteng lote dito at medyo madilim, baka saktan o patayin kami dito. Tinatanong kung ito ang pagbabagong sinasabi ni Duterte. Nasa tama pa ba ang ginagawa nila?

    Dinala ako sa batasan, sa opisina ni Ludovica at doon ko nakita ang maraming hinuli. Sa first floor, naroon ang mga menor de edad. Sa second floor naman ay mga above 18 years old. Hinati kami sa dalawang grupo, ang isa ay yung mga nakainom at nakahubad na talagang lumabag sa ordinansa, silayung mga ina-assist ng mga lalaking staff. At ang isa ay yung grupo namin, na wala namang nilabag at namataan lang sa kalsada. Pinag-fill up kami ng profile form. Pagkatapos nito ay kinuhanan kami ng picture na may hawak na pangalan, katulad ng sa kulungan. KATULAD NG MGA KRIMINAL SA BILANGGUAN.

    Dumating na sila Papa at Tita sa lugar. Nung makita kong hawak ng staff yung I.D. ko, honestly, natuwa ako at makakaalis na ko sa lugar na iyon. Ayaw pang tanggapin ang I.D. ko dahil walang birthday pero siguro dahil UP naman at mukha naman akong matino, pinayagan na ring umuwi. Hinatid ako pababa ng lalaking staff.

    "SIR, ANONG EDAD ANG SAKOP NG ORDINANCE?"... tanong ko sa staff.
    "AH.. EHH." tugon niya habang bumababa at tila hindi alam ang isasagot sa akin.

    Pagdating sa baba ay tinanong niya ang isa pang lalaking staff na nagbabantay sa pintuan.

    "ANO BANG AGE ANG SAKOP NG ORDINANCE?"... tanong ng lalaki. Muntik pa kong tumawa dahil AIDS imbes AGE ang pagkarinig ko.
    "KAHIT ANO. SA BABA ANG MENOR DE EDAD, SA TAAS YUNG 18 PATAAS."...tugon naman. Nawindang ako dahil parang hindi naman sinagot yung tanong.
    "KAHIT BIBILI LANG NG FOOD?"...tanong ko.
    "NATIYEMPUHAN KA LANG."...tugon niya sakin.

    Pagkauwi ng bahay, ako ang topic ng lahat. Gising silang lahat inaalam yung nangyari sa akin. Umabot ng ala-1:00 ng madaling araw bago humupa ang tensyon sa bahay.

    Halos hindi ako makatulog. Nagpupuyos at nanginginig ako sa galit. Yung pakiramdam na hinuli at ikinulong ka ng WALA KA NAMANG KASALANAN. Ganun pala yung feeling, yung pakiramdam na gusto mong ipaglaban yung karapatan mo.

    Bilang isang CHILD RIGHTS AND HUMAN ADVOCATE, naawa ako sa mga hinuli na wala namang nilabag. yung isa nga, umiiyak na sa takot. It can create traumatic experience for those people. Naaawa ako kasi yung ibang bumibili lang ng burger at bumibili lang sa tindahan ay basta na lamang hinuli. Yung iba nga matanda na at sapilitan pa ring isinakay sa sasakyan. Yung iba walang alam sa ordinansa kaya sumama na lamang sila.

    PAANO MAIPAPATUPAD ANG BATAS NG TAMA KUNG MALI ANG PAGKAKAINTINDI NG NAGPAPATUPAD NITO?

    Sa lunes, pupunta akong city hall para magreklamo. Nag-document at nag-photo op lang sila para siguro may mai-report si councilor. PERO MALI TALAGA. Tanggap ko yung mga nag-iinuman, tanggap ko yung hinuling nakahubad at yung mga menor de edad, pero yung iba na nasa hustong gulang na at wala namang ginagawang mali, sobrang nakakagalit.

    Comelec Blasted

    INCOMING Speaker and Davao del Norte Rep. Pantaleon Alvarez said Friday that the Commission on Elections decision to extend the deadline for filing the statement of contributions and expenditures (SOCE) for both winning and losing candidates during the May 9 polls was illegal.

    Alvarez said it was “too bad” that the poll body appeared to be adjusting its own rules for the Liberal Party and its standard bearer, Manuel Roxas II, who failed to meet the June 8 deadline for filing his campaign expenditure report.

    “Comelec is simply bending their own rules for accommodation,” Alvarez, a lawyer, said.

    Alvarez said the Comelec should have stuck to the deadline as a matter of following the law.

    The Comelec en banc on Thursday voted 4-3 to extend the deadline for filing of SOCEs until June 30 upon the request of the LP and other political parties who failed to meet the earlier deadline.

    The extension came despite a recommendation by the poll body’s Campaign Finance Office to deny the LP’s request because it would be unfair to other candidates and political groups that met the deadline.

    Alvarez, Duterte’s top choice for House Speaker in the upcoming 17th Congress, said election law clearly states that all candidates should submit their respective SOCEs within 30 days after elections.

    Outgoing Abakada Party-list Rep. Jonathan dela Cruz, chief campaign adviser of vice presidential candidate Senator Ferdinand Marcos Jr., said the Comelec en banc’s decision is a “clear lambasting not only of the existing law but the electoral system itself.”

    “What is the reason (for giving an extension). We can see the true motive. If they can violate strict election laws, how about other laws?” he said.

    De la Cruz said the Comelec owes the Filipino people an explanation as to why they allowed the extension.

    De la Cruz said late filing of SOCE could actually jeopardize the situation of Vice President-elect Leni Robredo, who ran under LP and defeated Marcos by a slim margin.

    “This is too much. The decision is a clear accommodation and special treatment for the LP,” De la Cruz said.

    Outgoing Kabataan Party-list Representative Terry Ridon described the Comelec decision as giving “VIP treatment” to both Roxas and his party.

    “The Comelec is clearly bending backwards for both LP and Mar Roxas,” Ridon, a lawyer, said.

    Re-elected Isabela Rep. Rodolfo Albano III echoed Ridon’s view.

    “The decision of Comelec en banc only shows their ignorance of the law,” he said. “They don’t even know their own rules.”

    In a TV interview, Comelec chairman Andres Bautista said the poll body was ready to defend its decision, but acknowledged that it was the prerogative of those who disagreed with it to bring the question to the Supreme Court.

    “You know, we’re used to court cases and we’re used to defending our decisions before the court. We see no problem in that. This is a very good point of law that should be discussed. We welcome the challenge,” he told GMA-7.

    Bautista also said it was within the Comelec’s authority to “relax laws” if their implementation “would be an absurd result.”

    Bautista was one of the three members of the en banc who opposed the extension, along with Commissioner Luie Tito Guia and senior Commissioner Christian Robert Lim, who wrote the CFO recommendation.

    The poll chief proposed accepting the late filing with the imposition of penalties.

    The four commissioners who voted in favor of the extension were Arthur Lim, Al Parreño, Rowena Guanzon, and Sheriff Abas.

    Bautista said the commissioners “wanted to extend because they were saying this was done before in 2010 and 2013.” They also considered the number of winning candidates who may be barred from assuming office, due to either personal non-submission or their parties’ failure to file, as in the case of LP, Aksyon Demokratiko, and the Pwersa ng Masang Pilipino.

    The commissioners opposed imposing a penalty because “someone might question it,” he added, though he noted that such was done for late filers for the 2013 polls.

    The LP, on the other hand, said it broke no laws with their late filing, saying their huge machinery prevented them from filing the SOCE on time.

    “The Liberal Party is a national party, with chapters all over the country. As part of due diligence, we had to await receipts, invoices, and information from all these chapters before we could file our SOCE. The deadline is one month after elections—very tight considering none of the other candidates has an organization as wide as ours, and we had to account for millions’ worth of expenses,” LP National Secretary-General Josephine Sato, said in a statement.

    “We officially informed COMELEC that we would be late and asked for an extension. Now, one week later, we have filed our papers. We did not disregard our responsibility and we certainly did not flout the law,” she added.

    The opposition United Nationalist Alliance (UNA), on the other hand, scored the Comelec for extending the deadline.

    UNA spokesman Mon Ilagan said that on May 10, the Comelec sent an official letter to all political party treasurers reminding them of the June 8 non-extendable deadline and the consequences of filing incomplete financial documents and the non-submission of SOCE on time.

    “The same law prohibits the winning candidates that you have nominated from entering upon the duties of their elective office should you fail to file your party’s SOCE,” the Comelec said in its letter.

    Ilagan said that the accommodation made by the Comelec in connection with the belated submission of Roxas’ and LP’s SOCE only shows the commission’s biases.

    “Today, we mourn the passing of the rule of law. Sadly, its final breath was taken away by a democracy-driven institution that is supposed to uphold the highest standard of integrity, impartiality and respect for the rule of law,” he said.

    The Marcos camp also expressed disappointment over the Comelec’s decision.

    “We are saddened because the government failed to implement our laws. Everybody is doing everything and made efforts to comply with the rule,” said Marcos’ campaign adviser and Abakada Party List Rep. Jonathan Dela Cruz.

    Na-bring up lang naman yang endo during the debates kaya naging usap-usapan. I don't think ANY of the candidates had that in their platform from the start. Syempre ginamit na lang nila yang "sosolusyunan ko ang endo" pang-akit sa mga botante.

    Duterte warns courts against issuing TROs on projects

    President-elect Rodrigo Duterte on Tuesday continued his tirade against corruption in government during a press conference in Davao City, this time focusing his ire at judges and the court system.

    After the announcement of his final picks for his official family, Duterte discussed alleged corruption involved in the issuance of temporary restraining orders by the courts.

    “I will be harsh. Basta corruption, I will be harsh. I am telling everybody. And I am sending somebody to the Supreme Court and I really don’t know kung sino ang kausapin doon to stop this practice of the judiciary, TRO nang TRO. And you cannot implement a project, you cannot go ahead even if there is the advice already because there is a TRO,” he growled.

    Duterte then alleged that there were judges who received bribes to halt developmental projects. “And the TRO simply means money for the judges. They have to stop it,” he said.

    Duterte then went on to say that any project he approves automatically meant it was not tainted by corruption.

    “When I certify, as President, that everything is okay, kapag mag-go signal ako, ibig sabihin niyan, walang corruption, that no money changes hands there,” he said.

    “Kung hindi kayo maniwala, wala akong pakialam. Basta ang pagkaalam ko, pinili ako ng Pilipino para sa trabahong ito. And sad to say na I was elected not really because they want me as a President na ano but simply to put a stop sa crime, corruption, and drugs,” Duterte said.
