    From a legal perspective, NO. He is still primarily liable for damages and harm. What he can do, is to claim remuneration or damages from car manufacturer, if he is to insist that he is faultless, and it is car manufacturer's fault.

    So to recap, if A damages B, A is liable to B, and B can claim from A. If A insists that he should be blameless, A should sue car manufacturer to recover the damages he paid to B and for other damages he may want to claim.

    By claiming SUA, the driver involved is essentially saying to the general public that it is not his fault and the blame should fall on the manufacturer/dealer and the rest of the world except himself.

    The driver can still be sued but in a SUA claim, he is appealing to the court of public opinion here and is portraying himself as a victim rather than the offender. And, if insured, he is also telling his insurance company to pay him as he is not negligent or at fault.

    He can always claim "fair reporting" and MMPC pa magbabayad kay Noli if nag kataon. Tapos 50k moral damages at 50k exemplary damages lang makuha nila.

    Actual damages from lost sales? Hirap patunayan nun in this case.

    High risk, low gain.

    Who would want a fight against ABS-CBN? I guess no one, not with broadcasting media powers in the Phils and existing (on non-existent laws) to protect people or companies from irresponsible journalism.

    MMPC is wise enough not to engage ABS-CBN or Noli de Castro to court as it will become a PR nightmare that will cost more in the long run.

    People are starting to shift away from t.v. and onto online platforms like youtube.

    SO, its control of the masses wont last.

    Kaya malaki kinikita ng mga broadcaster. Wala na akong tiwala jan kay Noli simula nung naging SUA preacher na sya.

    pero sa palagay nyo ba.

    may SUA ba talagang nangyayari or human error talaga..

    sana walang maka experience sa mga kasamahan natin dito .kasi kung magkakaroon sigurado bully lang aabutin dito ng hindi naniniwala sa SUA

    If SUA nga yang mga yan, edi sana dapat nag break yung kotse lalo na if gumamit ng hand brake, cable kasi yan.

    Ang break ay mas malakas lagi kesa sa engine mo, so most likely hihinto at hihinto ka. Yung mga nakikita natin parang hindi naman bumabagal eh. Tulad ng Nissan na yan, tapos bumanga sa jeep tuloy tuloy pa din ang takbo ng mabilis.

    OT - tips when SUA happened to your car. don't panic!! a matter of sec to do it...
    1st thing to do is press as hard as you can on the brake pedal. never ever pump the brake pedal.
    2nd - shift the A/T into neutral position
    lastly, switch off the car engine. There you go

    Yan ang tv news. Ang linaw linaw Crosswind, Adventure or Revo na involve sa aksidente. Malutong na malutong ang word na SUV ibabalita. Mga t*ng* ba writer or anyone of the PAs to correct it? Pinalalaki lang para mas matunog ang dating sa viewers. Para silang tabloid

    it depends doc, paano kung ang distance 50m or more pa from the impact? as I said earlier dont' panic... relak relak ka lang when SUA happened
