i bought (90k) mitsu gli 93 model in mindanao ave last Feb 9, 2011
the car shop told me that the CR was missed place
they said they will find it
they already ask for the payment of the car (85k)
but until now i havent got the CR for the car
i return the car to the car shop coz i cant use it
the registration of the car is expire already
and the car shop owner still wont return my money
saan po ba ako pwede mag file ng complaint about this
car dealer kasi its been a while di pa rin nya binabalik pera ko
from feb 9 to present.
mga dre advice naman.

Wag naman sana!
Kung lost OR madali lang po sana kasi may database naman sila (LTO) to back-track!

you can file a complaint sa barangay which has jurisdiction in mindanao ave. or you can go straight to the QC police department or NBI. (the tulfo brothers loves to handle that kind of cases too!)

the best thing to do first is to make a formal demand letter, serve it personally and be sure to have someone acknowledge its due receipt.. otherwise, send it by registered mail with return card..
after the grace period you stated in your demand letter, shall we say 5 days, and nothing positive was done by the shop owner, file a formal complaint before the barangay (actually, you can file it directly in court, if civil case, or to the fiscal's office, if criminal, depending on the analysis of your lawyer on what will be the best cause of action availing given the circumstances) filing in the barangay is being advised only if the other party is receptive in settling the problem amiably. although there's a law requiring it to be filed there first,it is not absolute and accepts certain exceptions like if you the parties are not residing in the same barangay unless they will agree to submit the case therein..
after the barangay, assuming no positive result, get a certificate to file action and from there, let your lawyer decide what will be the best for you... HTH

yung car naman is not HOT CAR
sinamahan ko pa sila sa main LTO sa Karingal ata yun
they have it stencil naman and ok naman process
kaso its been a while na inaasikaso nila ang CR ng
kotse and i came to the point na gusto ko na return
yung kotse.
wala nman kasi ako magagawa sa kotse kasi expired na
rehistro this month di ko na rin magagamit
badtrip pa dun kasi this is my 1st car
nag sinungaling kasi sakin car shop na missed place lang
yung CR ng kotse so i gave them chance to resolve that issue
nag taka ako kasi Feb 9 to present wala pa CR
iisip ko din na baka hindi nila nilalakad.
badtrip pa kasi sabi ng car shop
na trade-in lang daw sa kanila yun
and now pilit nila ako pinapakausap sa nag trade-in sa kanila
sabi ko i dont have any connection in that 3rd party person na involve
kasi sabi ko ang kausap ko ng KOTSE car shop di kung sino na tao
now im screwed.
mahal pa naman mag hire lawyer, i cant afford it
hindi nga mamahalin sasakyan na bili ko kasi hindi naman ako mayaman.
if in case they wont return my money back ba ka lalapitan ko na tlga si TULFO to help me with this car shop owner
i almost spend 19k for restoring the cars life to make the car in condition
and 85k payment for the price of the car and now i cant used it.
all i have here is the receipt of all the expense and deed of sale and receipt of the car it self.
if i file a complaint about this positive ba na mananalo ako?

I'm sorry to hear that you are in this kind of a situation, here are my thoughts:
1. I agree with the demand letter, send it to them and give them a grace period, if nothing happens then bring your case to the barangay that has jurisdiction over the establishment to mediate.
2. Here is another resolution, you can secure a duplicate copy of the CR with the original owner's name in order for you to have the car transferred to your name, but you must shoulder the additional expense. Have yourself do the paper works and not let them do it for you.
3. If you are really decided to have a refund and they won't budge then try what they suggested by going to media like the " Tulfo Brothers."

May 4th, 2011 09:33 AM #10kung ako sa TS yung number 2 ang gagawin ko, shoulder mo na lang lahat ng expenses sa pagsecure ng duplicate copy of the CR at pagtransfer ng ownership nung car plus other penalty charges, halos ganun din naman magagastos o masmalaki pa sa paghahabol nya sa nagbenta ng sasakyan, plus abala at sakit pa sa ulo. yung number 3 option mukhang malabo na mangyari yan, kung sa gastos lang sa pagaayos ng papel wala na mailabas, yun pa kayang whole amount nung car ang hihingin sa kanila.
