    Ang bilis naman humaba ng thread na to.. i cant follow na... kung may nakasagot na.... ulitin ko nalang

    Cathy.... pwede nyo palabasin Sale- tax more or less 8%. Pag deed of donation nasa 15%. Estate tax nasa 1.25MILLION for the 1st 10million then 20% yung excess.

    Regarding sa attys. Fees... depende sa caliber ng lawyer yan... pwede nalang kita refer sa kakilala ko... sabihin ko nalang GF kita para mura... he he

    Nap pressure na ko sa Lola ko kasi araw araw tumatawag kung payag na ba ko na dun sa lawyer na mag pretend kami na hindi kami aware sa ibang heir. Mag absent daw ako sa work para matanong ko na daw sa lawyer, gusto ko naman mag knowledge ako pag pumunta ako and I am able to ask the proper questions.

    Yung Estate tax sa land based on the zonal or market value? Saka nalilito ako sa computation ng lawyer, yung isang property liit liit ng value 85k fee niya. May iba pang properties na mas mahal, e ano ba basis ng lawyer sa pag charge? depende ba sa value ng property?

    Ordinary lawyer lang kailangan namin, basta ma transfer at mabenta namin properties ng hindi nalalaman ng mga heir na ayaw namin

    the wife will say, "how can you say i don't exist? didn't we meet last xmas etc etc...? heto pa nga picture, a!"
    bottomline: "be fair. don't be greedy."

    there is no fair market lawyer's fees, if that is what you are looking for. he will charge what he feels is his due.

    I don't think we are being greedy. And no, we abhor that woman pero pinipilit niya sarili niya so they are not invited in any of our family gatherings. I am very passionate about this because it's land our family has owned for over a century. And it was not an easy decision to sell but my Lola is 90 and none of us are interested with it.

    Just because a woman opened her legs and got impregnated doesn't mean she gets a fair share. She is NOT blood. Family should be earned. I've seen them less than 20 times in my entire life. It really makes my blood boil when men lose their rationale on women (thinking with what is between the legs)

    you are wrong.
    she is entitled to her fair share.
    even the law is on her side.

    but, if you can think of a reason why she should be dis-inherited... ask your lawyers. there is such list of dis-inheritable deeds.

    OMG! I am so close to crying, I am so upset with this whole situation and I really feel for my Lola.

    Yes the "wife" is entitled but anyone with delicadeza should not show interest or go after it anymore. Even my own Mom who has been with my Dad since 1970, never nakialam sa mana ng Dad ko. And my Dad, the same.

    So why should a woman who got impregnated, stayed in a short relationship (less than 2 yrs) be entitled to a share. Just because kinasal. IMO mas deserving pa yung nakipag live in ng 10 yrs sa kinasal ng 2 yrs.

    What happened to the law na pag inheritance, walang share yung spouse?

    di ba pwede benta nalang ng mabilisan (palugi) yung properties, instead of pamana. tutal buhay pa naman lola ni cathy and mukhang target lang nila e wag lang mabigyan yun mga ayaw nilang "relative/s".

    Cathy... i can refer you to our lawyer friend... matagal cya sa Judiciary... as a Branch Clerk then nag private practice... sabihin ko nalang close tayo... or if you can also talk to our friend in Register of deeds and LRA... and my contact at BIR.. they know what to do... alam nila diskarte dyan.... pm me your number if your interested..

    Cathy's case will not be settled without money going to the daughter-in-law of her Lola.

    I know some lawyers will be willing to perform magic to let Cathy have what she wants. But the risk is always there. IMHO, they can feign ignorance on paper but certain facts in her case are easy to prove.

    In any case additional facts may be needed to see if reserva troncal can be made applicable

    i agree.
    the duty of the lawyer, is to provide his client with any and all advantages, that the law has to offer.
    he should not suggest, or even passively agree, that client violate the law.
