    or talk to your insurance and ask them kung pwede waived ang participation and singilin na lang nila yung 2nd party..

    but yes.. never get into an agreement just for the participation.. mamaya ma deny pa claim mo sa insurance mo.. lalo na kung may quit claim ka na pinirmahan..

    The last time I had an accident we went to the nearest police station together with the bus driver to give our statement and get a police report for insurance claim. The police officer later on told the bus driver to pay me up Php2,000 or 3,000 (I forgot the exact amount) for the participation fee which I have to pay to the insurance since the bus driver is at fault.

    paano ba yan "participation fee"? dapat ba yung naka banga sa iyo o yung "at fault" ang mag bayad? kase kung ganun lang eh bangain na lang lahat ng bago sasakyan at bayaran lang naman pala ng "participation fee" ang katapat para ma abswelto dahil majority naman ng sasakyan sa pinas ay utang at panigurado may comprehensive insurance yan... malas na lang kung full payment cash binili yung sasakayan tapos wala insurance...

    the participation fee was resorted to, by the insurance providers, to discourage potential so-called low-quality claims, i.e., "yung kaunting galos lang na puede namang i-simonize", atbp.
    where the money is coming from, i do not think the insurance provider cares.

    it will only matter if you sign a quit claim don sa other party... kasi hindi masisingil nung insurance yun..

    i think, this is one thing many car owners do not know..
    that the insurance providers talk to each other regarding claims and stuff.
    and going into a written agreement with the other party without the insurance provider's approval, can tie their hands.

    Yes the participation fee was supposed to be paid by me but the officer insist that the driver must pay me the participation fee. But paying the paritcipation fee doesn't mean that the bus driver will be free of any accountability right? and we did not sign any waiver or agreement.

    that the "guilty" party pays for the participation fee of the victim, is but fair.
    it is only common sense, and should not to be interpreted as a quit claim.
