If we pay our taxes right, then walang mangongotong na taga BIR.

Let's face it, may mga businessmen naman talaga na gustong mag-underdeclare ng income, kaya they shouldn't be surprised if one day the BIR comes knocking on their door. Madali nang mag-audit ngayon because of VAT/EVAT, kasi nagkakaroon ng paper trail.

As responsible citizens, paying the right taxes is one of our primordial duties.

I have an estranged relative who is in the BIR. in fact 2 na sila sa BIR.

every 3 years, they have new Mitsubishi cars. they got lancer pizza in late 90's, space gear in early 2000, strada 2 years after and now a pajero. my relative was in a lower position in the lancer days hehehe turned out that they were tasked to monitor a dealer of Mitsubishi motors since day 1.

when I had a brush in with the BIR some 3 years ago, I casually asked my parents to call them and ask for their assitance. My dad said: "Wag na! lalo ka lang mapapagastos pag kinausap mo mga yun. yan pamilya talaga ng mommy mo blah blah blah" hahahaha

bad trip na bad trip kasi dad ko sa kanila kasi yun isang minana nila lupa sa grandparents ko, kinotongan pa ng real estate tax from guess who, and to think hati-hati pa sila magkakapatid (mom side) dun sa lupa sa will. my dad was helping them from the case kasi may landgrabber yun mana. Pro-bono na nga services nya eh kinotongan pa ng tax.

now my cousin just bought a three-story town house worth millions. (mga 3 years neophyte pa lang siya or is it acolyte sa BIR) ginawa pa nga ako ninong ng pamangkin ko. my dad casually excused himself from that family function hehehe.

an LA is issued and this is the start of an audit. hindi kailangan ng summons o subpoena... but if you ignore the LA, then it may lead to a SDT (subpoena duces tecum)...

from the LA, mahaba haba pa proseso bago umabot sa korte... mahaba ang "legal due process" (as provided by the NIRC - national internal revenue code) ... but of course, the higher it goes, ma force ka maglabas ng ebidensya ... ma force ka magbayad ng auditor (or accountant or lawyer or tax agent) .. lumalaki rin ang gastos mo...

as provided by law, ang tax fraud is a misdeclaration of your taxes paid by 30% or more... so legally, if you undervalue or undeclare at most 30%, lusot ka!

but kung ako namang ay matinong BIR, kahit yung 30% difference eh pipigain ko in an audit, baka may makita akong mga entries in the books na hindi mo alam paano maipaliwanag and may lead up to tax deficiency (whether the sales or the purchases were properly recorded is another matter)... minsan kasi sa interpretation nagkakatalo... ang nangyayari, since tayong mga businessmen ay in business to do business, sunod na lang tayo sa sinasabi ng examiner... kahit hindi talaga ganun... it's one of their ways of increasing tax collections - prey on ignorance of taxpayers

your receiving an LA can be questioned... BIR statistics show that they have a 1:50 ratio - meaning 1 BIR employee to 50 taxpayers ... grabe no...

so to make their work easier, each year, they come up with an audit guideline.. this is documented in an RMO (revenue memorandum order) wherein the commissioner and the finance secretary lists down criteria for those that will be audited... legally speaking, ito lang dapat ang makakuha ng LA... kung ang financials / tax payments mo does not fall under the selection criteria in the audit guidelines, you can question this in the proper forum para ma cancel yung LA.

most likely reason kung bakit ka nasama sa list ng may LA is you fall under the selection criteria, or you are in the blue book... so kung nasa blue book ka and talagang hindi ka nag fall under the selection criteria, you can question it without having to shell out money to grease their hands...

in a way, hindi din ganun kadali ang ipa entrap sila... especially if you're in the area for the long haul... maaaring yung isang nangingikil eh maipakulong mo or maipahiya mo.. but your business is still in that area and when the next tax season comes around, you'll still be facing them... wala namang guarantee na yng papalit eh magiging "pro-business" na susunod lang sa gusto nating taxpayer... either matino yng makaharap mo but sobra ka naman pahirapan at sangkaterbang tax deficiencies ang i-assess nya... or hindi sya matino na mas iipitin ka para makaganti dun sa nakalipas na taon...

i'm not saying na suportahan natin yung corrupt practice... but you just have to weigh everything...
