I'm not sure that that's what the law says or means. What's sure is that if you are the cause of death or injury, you get a case whether it's your fault or not -- magaan nga lang ang kaso kaya naaareglo. Technically, yung MC na isa ang may kasalanan kaya kung mahuli siya, may kaso din siya -- IF mahuli (or if they even bother).
