Regine Velasquez underdeclared her assets worth P3+ Million daw. But, BIR Commissioner Parayno said they're not filing a case at this time. It's just a prima facie case of tax fraud if your assets vs. income are underdeclared by 30%.

BIR files tax evasion case vs Regine Velasquez
The Bureau of Internal Revenue (BIR) on Thursday filed a tax evasion case against singer and TV personality Regine Velasquez for her failure to declare P3.75 million in earnings from product endorsements.
BIR Commissioner Guillermo Parayno said the agency found that Velasquez understated her worth in her statement of assets and liabilities for 2003.
He said if found guilty, Velasquez will face a possible four-year jail sentence and fines on top of payment for tax arrearages.
"We are not filing a case of non-filing of declaration of returns for this time. We are saying that her having filed a return - the amount of the gross revenues or income declared is substantially understated by amount in excess of 30 percent, which under the national internal revenue code is prima facie evidence of fraud," he said in an ABS-CBN News Channel interview.
Parayno said Velasquez's tax declaration surfaced "under mysterious circumstances" last month after the agency started investigating her for possible tax evasion.
He said the tax declaration was filed last April 15, 2004 but was only forwarded to the BIR regional district office in March this year.
He said the singer filed her tax declaration at the BIR office in Caloocan City instead of Malolos, Bulacan, where she currently resides.
The tax declaration showed that Velasquez earned P7.7 million through product endorsements, TV and concert appearances for 2003.
Parayno said BIR counter-checked the tax declaration with other payees of the individual, which proved their case of underdeclaration of assets.
"We were able to get certification from other payees of [Velasquez]. If the percentage of underdeclaration is more than 30 percent then still there is a crime committed under the law," he said.
Velasquez, dubbed Asia's Songbird by local media, is a mainstay of the weekend noontime show "SOP" aired on Channel 7.
The BIR last week filed charges of tax evasion against actor Richard Frank Icasiano Gomez for failing to declare his income for the years 2000, 2001 and 2003.
Parayno said checks made by BIR showed that the actor had undeclared properties that can be considered as income, refuting an accountant's statements that Gomez did not earn income for the three years.
BIR records showed that Gomez only made one tax payment of P786,795 in documentary stamp taxes.
If found guilty of tax evasion, he said Gomez faces a possible four-year jail sentence and P100,000 fine on top of payment for back taxes.
The BIR is boosting its revenue collections to plug an estimated P50 billion leak in yearly government revenues due to tax evasion.
Internal revenue and finance officials earlier said they would make weekly announcements of the filing of tax evasion charges against individuals and establishments for large scale tax evasion.
Last week, the BIR and finance department filed tax evasion charges against officials of motor vehicle importer Italcar Pilipinas Inc. and Glo Herbal for not paying more than P100 million in back taxes.
The two agencies also sued officers of Philippine Telephone and Telegraph Corp. (PT&T), Excellance Weaving Mills Inc., Fitness by Design, Inc. and the Mendez Medical Group for the same violation.
